[OCPQS 4/1 - Feb 1787]

David Bradford appointed overseer of the road from Collins to Hambletons Branch.

Wm Lytle & Wm Waters esqs qualified as Justices of the Peace.

Court adjourns until to morrow morning 9 O’clock.

Tuesday morning February 27th 1787, Court met according to adjournment. Present: Eli McDonald, Jno Ray, Jas Freeland & Wm Waters} esqs.

Conrod Long is appointed overseer of the road instead of James Wilkins.

Benjamin Lacy is appointed Overseer of the road from Frederick Loyd’s Spring to Chatham Line.

William Woods is appointed Overseer of the road instead of John Nichols

Richard Williams is appointed overseer of the road from Chatham Line to Cane Creek instead [of] Jno Lindsey.

Drurah Johnson is appointed overseer of the Road from Bennehan’s to the Town road instead of Charles Mannen.

Garret Garrison is exempt from serving as a petit juror to this Term.

Jacob Bason is appointed overseer of the road instead of Timothy Hughes.

Wm Dawley is exempt from paying Poll Tax.

Samuel Parks is allowed ten shillings for summoning the inhabitants Chatham District.

Ordered that the Sheriff of Orange summon the following persons as Jurymen to attend the next Superior Court (viz): John Armstrong, Wm Hall, Matthew McCawley, Wm Tate Marrew, Capt Robt Hunter, John Tinnen, John G Rencher, Alex Mebane, Wm Lytle, Jno Hogan, Edward Guin.

George Thomas is exempt from paying a Poll Tax.

Ordered that an orphan Child named William Dickson aged five last October be bound to Alexander McCracken. [Bond not found, but see OCPQS 4/104.]

No 134 Jno Hogan vs Wm Stroud} Case. Jury Sworn viz Jno Strother, Jas Craig, Wm Sheppard, Thos Durham, Andw Ross, Wm Kennedy, Elias Turner, Wm Galbrath, Isaac Bracken, Geo Garrison, Wm Murray, Timothy Hughes. Find for the Plaintiff & assess his damages to one penny & costs of suit.

[OCPQS 4/3 - Feb 1787]

Ordered that a commission issue to take the Deposition of Susannah Umstead immediately without the presence of either party, to wit Jesse Benton plaintiff & Wm Sheppard Defendant.

On motion of Jno Holden for the Division of a Tract of Land Bequeathed to Sundry Legatees of the will of Isaac Holden [OWB A/57] – ordered that the County Surveyor with William Whitehead with James Lattey partition the said Land agreeable to the said will & the parties (to wit): Jno Kelley who claims four fifths of said Land & Jno Holden Jr claims one fifth do consent to the same & to cast Lots for their Several shares unless otherwise determined by consent.

Thomas Cassals is appointed overseer of the road instead of Jno Weems.

Ordered that an orphan child named John Larimore aged [blank] be bound to William Hays. [Bond not found.]

License is Granted Thomas Faucit to keep a Tavern at his now dwelling house.

No 13 M Henry vs James Lundey} Case. Non Suit. Same Jury as to No. 134 except Samuel Piper in the room of William Kennedy.

Ordered that an orphan child named William Wilson aged 2 years 20 April next be bound to Reuben Smith. [Bond not found.]

Benjamin Rainey is exempt from Serving as a juryman at this Term.

Edward McDade is exempt the payment of a Poll Tax.

Peter Rightsman is appointed overseer of the road from Hillsborough to the first branch above Robert Nelson’s.

Ephraim Carrington is appointed Constable for St Mary’s District.

Edward Trice is appointed Constable for St Marks District.

James Taylor is appointed Constable for Hillsborough District.

William Accles is appointed Constable for Orange District.

James Kennedy is appointed Constable for Chatham District.

William Andrews is appointed Constable for St Thomas District.

Administration of the Estate of John Rutherford is granted to Jane Rutherford at the same time she entered into Bond with Securities in the sum of five hundred pounds.

James Taylor, Archibald Camell & James Kennedy sworn as Constables.

Administration of the Estate of Robert Woodey is granted to Jane Woodey at the same time entered into Bond with Securities.  [See also inventory OCPQS 4/14, guardianship OCPQS 4/198.]

Jesse Benton vs Wm Sheppard] Case. Jury Sworn to wit: Isaac Bracken, Geo Garrison, Moses Crawford, Wm Galbrath, Wm Tate, Matthew McCawley, Wm Copland, Stephen Kirk, Stephen Hart, Wm Whitehead, Jno Bowls, Robt Cheak. The Defendant consents to take no exceptions against any one of the Jury- find for the Plaintiff £11.2.1. William Sheppard’s affidavit to an acc’t against Jesse Benton for 8 bushels & 3 pecks salt sold & delivered to Jesse Benton at £2.12/bushel for which sd Benton was to have credited said Sheppards Bond in the 1782.

Jacob Richards is Qualified as Constable within the District of Hillsborough.

Daniel Green & William Andrews are Qualified as Constables agreeable to act of assembly.

Edward Trice is Qualified as Constable within the District of St. Marks.

Ordered that a Bridge be erected over Flat River at or near the Land of John Carrington at a place known by the name of the Island Ford. John & James Carrington are appointed managers. [See Dunaway's Bridge Records, page 9.]

Jonathan Lindley Esq Qualified as a Justice & took his Seat on the Bench.

Ordered that a Bridge be built across Eno at the ford near Hillsborough and that John Estes, Wm Lytle, William Waters, William McCawley & John Hogan Let & Superintend Building said Bridge. [See Dunaway's Bridge Records, page 12.]

Wm Eccles Qualified as Constable for the District of Orange.

Ordered that a Ded Issue to take the Deposition of Robert Abercrombie a resident of Georgia now in this State giving 10 days previous notice as also a Dedimus to take Deposition of Col Archibald Lytle De Bene Esse in the suit of William York against John Hogan.

Mark Patterson vs William Mebane} Case. Jury Sworn to wit Isaac Bracken, Geo Garrison, Wm Galbrath, Joseph Tate, Moses Hutchens, Wm Hobs, John Strother, Samuel Craig, Abner Tapp, Thomas Brooks, Robert Gray. Find for the plaintiff and assess his damages to £200 & costs of Suit.

James Hasting is appointed Overseer of the road instead of Moses Austin from Eno River at the Town ford to William Mortisses with the hands adjacent to the sd Road.

Ordered that one half of James Hoggs hands work on Whiteheads Road and the other half on Strayhorns road.

Robert McIntire, Martin Cole, James Lunday & William Cummings are appointed Patrolers for the Town of Hillsborough.

The Execution of a Deed of trust from Philip Pendleton & wife Martha to James Carson & Richard Thomas was duly proven in open court by the oath of Jacob Lake one of the Subscribing Witnesses thereto & ordered to be Register’d. [See OWB B/9.]

Agreeable to the prayer of Petition Exhibited to to [sic] this Court, Ordered that a new road be Laid off & marked out the nearest and best way from Will Partins to Hillsborough and that the following hands Lay off and mark out the same and make return of this to next court (to wit): John Hart, Charles Johnson, Joseph Kirklin, John Craig, John Gettes, James Hart, George Johnson, Alexander Strain, William Burns, William Blackwood, William Kennedy & Luke Browning.

William McCabe is appointed overseer of the road from Eno Ford near his own plantation to Cates Creek with the hands most convenient.

Thomas Horn is appointed overseer of the road from a branch near Lazarus Cate’s to Eno near Wm McCabe’s and that the following hands work under him (to wit): John Horn & son, John Coles, Howel Hunt, Thos Horn’s son, Elijah Dolten, Henry Dolten with others most convenient.

Lazarus Cates is appointed Overseer of the road from Ansleys Mill near to his own plantation with the hands most convenient.

The Inquisition held on the body of John Hawkins deceased is returned & ordered to [be] recorded.

Ordered that John Crouse have Leave to leave to Build a mill on his own land and that the same Become a publick mill. [See Dunaway’s Mill Records, page 35.]
