Order’d that Jno Pouge be appointed Overseer of the Road from Caswell Line to James Clarks Little River instead of Andrew McBroom.

James Carr & Alexander Tinning are excused from serving as Jurors this Term.

Christian Coble is appoint’d Overseer of the Road from Wells Saw Mill Road in the to the Randolph Line in the Room of John Wheeler.

Alex Malcom Wm Hendley vs Archibald Lytle} Appeal. Ded potestatum to issue to take deposition of Alex Malcom of Virginia.

Ordered that Ebenezer Dewit an orphan boy be bound to John Torrentine for the Term of Five Years from the first day of this Instant to learn the art and mistery of a Black Smith. [Bond not found. Ebenezer was re-bound within two years at OCPQS 4/224.]

[OCPQS 4/86 - Nov 1787]

Your Garnishee further says he has two bonds upon Wm Hor[n] payable to himself for £227 in the whole for Land this Garnishee sold the property of sd Chas Abercrombie, & which this Garnishee thinks are voidable because he thinks the title of the Land was not in sd Abercrombie at the time of sd Sale.

The Court adjournd for half an hour.

Court met agreeable to adjournment. Present: Jas Carrington, Wm Courtney, Wm Ansley} Esqs.

Henry Hargrove came into Court & made Oath that the Land with which he was charg’d as Taxable was a wrong return for that he never own’d nor gave in the same therefor the same is allow’d by the in James Carringtons Insolvent lists.

Abner Tapp came into Court & enters in himself with Wm Courtney & Jas Carrington Esqs in the sum £100 for the maintainence of a bastard Child he begat on the Body of Mary Peeks. [See Bastardy Bonds image 428, also OCPQS 4/105.]

[OCPQS 4/87 - Nov 1787]

State vs Alex’r McCracken} The following Jury being sworn Sam’l Thompson, Hugh McAdams, Jas Lockhart, Jas Gray, Stephen Loyd, Jo Moore, Ric’d Lauglin, Lewis Kirk, Robt Morrison, John Hart, John Barby, Reuben Smith find the Defendant not guilty in manner & form charg’d in the bill of Indict.

Joseph Baker is appointed overseer of the road from Col Alex’r Mebanes to Shaws old place in the room of And’w Murdock.

Ordered that a Tax for the Year 1787 be laid for this County of eight pence pr hundred acres of Lan & two shillings for each poll towards defraying the County charges for this Year.

Ordered that the following Persons be appointed as a Jury of view on the part of Jno M Whitney in a suit depending in this court wherein Jno M Whitney is Plaintiff & Jno Davis defen’t, to Wit David Mebane Jun’r, Jas Mebane, Edwd Wilson, Wm Nunn, Jno Hogan & Andrew Murdock. Thos Mulholland Surveyor.

State vs Wm Ansley Esq} The former Jury being sworn find the Def’t guilty & fine 5/ & cost.

Order’d that a road be laid off from Wake County Line near Frank Ross the nearest & best way thro Boyces Old Field to Hillsb & the following persons lay off the same To Wit Benj Peelor, Ab’m Whitaker, Jno Copley, Jno Cabe, Thos Gwinn, Jno Meacham, David Driskill, Israel Stantiford, Nich Farmer, Jno Green, Jno Edwards, Joshua Smith.

[OCPQS 4/88 - Nov 1787]

Ordered that Jas Pratt pay to Elizabeth Hastings the sum of Five pounds pr year for five years or during the Life of sd Child to commence from the birth of sd Child, to be paid annually. [See Bastardy Bonds, images 414 & 415.]

Ordered that Mark Patterson enter further Bond with additional Security in the sum of five hundred pounds for the faithful discharge of his duty as administrator to collect & take care of the goods & chattels, rights & credits of the Estate of John Patterson Deceased, agreeable to the power and authority he sustains under Letters of ad colligendum bona Defuncti which were lately granted to him by the County Court Orange. John Bryant & Jno Barbee offerd as Security & approved by the Court.  [See also administration OCPQS 4/114.]

This Order rescinded.

Jno Davis chooses Jno Woods Shff, Jno Wilson, Ralph Faucet, James Thompson, Jessee Miller & Samuel Thompson as a Jury of View & Jonathan Lindley Surveyor to examine lines & boundaries of the lands & questions between the said Jno Davis & Jno M Whitney.

Ordered that Jno G Rencher enters into Bond with Joseph Taylor, Jesse Benton & Robert Campbell Esqs Security in the sum of fifteen hundred pounds for the faithful discharge of his duty as Administrator ad Colligendum defunctis to collect & take care of the Goods & Chattles, rights & Credits of Jno Patterson deceas’d agreeable to the power & Authority invested in him under Letters Ad Colligendum boa Defunctis which same are hereby granted him by the County Court of Orange in the room of Mark Patterson who is hereby depos’d from the same because he doth not give sufficient security according to law &c.

[OCPQS 4/89 - Nov 1787]

Wm Glenn vs Chas Abercrombie} Wm Ansley Garnishee summon’d declares on oath that he is owing to Chas & Robt Abercrombie one bond to the amount of £200 – but what part thereof belongs to Chas Abercrombie he knows not.

Tho Holden vs Jno Kelley} Ordered that Thomas Mullholland & Mr Whithead lay off the Land in question agreable to the order of the Former Court.

Jno Barbee & Turner Herod are Deemd sufficient security for Mark Patter in his appeal from the letters ad Colligendum granted Jno G Rencher.

Henry O’Dannel is Deemed sufficient Security for Jno McDannel in his Bond for the indemnity of the parish by reason of a Bastard Child begotten by him &c. [See Bastardy Bonds, image 438 which seems to indicate that the mother was Elizabeth Cates.]

Jno Robinson appeard agreeable to his recognizance & pay’d his fine. Ordered that he enter into Bond &c.

Jno Robertson appeared and pay’d his fine. Ordered that he enter into Bond.

John Taylor is allow’d Ten pounds for his Ex officio services three months in the vacation of the Sheriff.

Saml Thompson, Stephen Loyd, Lewis Kirk & Richd Laughlin are fined 90/ each for their Non attendance at the Jury as Jurors. all excus’d from their fines. Samuel Thompson excusd for reasons shown on Oath.

94 Saml Dannel vs Ro Campbell} Appeal. Judgmt of the Justice  Confirm’d for £5.9.4 & costs of suit.

No 95 Tho Brown vs Jno Hatcherbaw[?]} Appeal. Judgmt of the Justice Confirmed. Barred by the Statute.

Ordered that any two Justices of this County admit Thomas House to Bail to appear at our next County Court the said House to be bound in the sum of £100 & two Justices will Securities in the sum of £50 each.

96. And Gibson vs Wm Galbreath} Case. Jury sworn to Wit Saml Thompson, Hugh McAdams, James Gray, James Stockard, Samuel Allen, Thos Faucet, Archibald Lytle, Norman Biggelow, Lewis Jones, Ro Morrison, Rich’d Laughlin, Jo Moore. Find for the Plaintiff & assess his dam to £0.16.5 & Costs.

And Gibson & Wm Galbreath, John Galbreath a witness seen in the forgoing Suit calld to appear and give Testimony & fails to appear. Issue S.F.

John McDannel is appointed overseer of the road in the room of Wm Ray from the Allemance to Whitheads Creek.

Wm Copland is appointed overseer of the road from his house to Mark Pattersons. Ordered that the following hands work under him under the same to Wit Ro Campbell, Thomas Trice, John Davis, Wm Sheppard, John Hust, Wm Loyd, Jo Hust, David Hall, Leonard Hayes, John Dannel, Christopher Dannel, Dan’l Watson, Dan’l Watson Jun.

On Motion of Jesse Benton Esq atto for John Cate the Presence of a Certificate from the Depty Secty ordered that the Sheriff Summon a Jury of good & lawful men to appear on the Premises & try a disputed claim of Land between Thomas Cate Enteror & John Cate Caveator, for about 200 acres on Bear Creek a branch of little Cain Creek Joining the lines of Thomas Cate & John Cate & make due return to the next Court. Will Lytle, Wm Ansley, William Courtney.

[OCPQS 4/94 – Nov 1787 – similar to OCPQS 3/691]

Whereas it appearing to the County Court of Orange that manifest injurys are rendered to Just Creditors by persuing the Docket as it genera[lly] stands, We therefor herby inform Suitors and others who have beausiness to do at the next County Court to be held for the County aforesaid that it is the intention of the Court to proceed on beausiness in the Following manner to Wit – On Monday the first day of the Term Qualify the grand Jury take probates of Wills, Deeds, grant Admr & the Second and third days to proceed to the trial of such cases as are brought on specialties, Assumptions and plaine Accounts. The fourth day prosecute the State beausiness, The fifth appeals form Warrants the S?? Assaults & Batteries and actions of Slander. Saml Benton.
