State of North Carolina, At a County Court of Pleas and Quarter Sessions begun and held for the County of Orange at the Court house in Hillsbo on the [blank] day of August being the 4th Monday of sd month and year of our Lord one thousand seven hundred & ninety five 1795. Geo Long & Geo Clincey two & James Morrow three of the Original Pannel are Excused by the Court from their their [sic] attendance as Jurors for reasons shewn the on oath.

Ordered that Jane Smith an orphan girl child of the age of 14 years in September next be bound to John Minnis until she arrive to the age of Eighteen years to learn the art & mistery of a Spinstress. [See Apprentice Bonds, image 225.]

Ordered that William Ray Esqr, James Patterson & Obid Green or any two of them audit the accounts of John Albright Ex’r of Jacob Albright and report the state of the same to the Court at next Term.

The Trustees &c vs Charles Collier & Rob’t Campbell} Debt. Judgment confess’d by Charles Collier & Rob’t Campbell persons[?] for £33.10 with Int from 12th October 1794 til pd & Stay Ex 3 months.

James Morrow one of the original pannel is excused from his attendance as a Juror at this Term by reason of his not being a freeholder.

Charles Collier is appointed overseer of the road from the fork above Geo Dannels across new Hope to the next fork over long branch with the following hands: Mrs Searses, John Moore, Col Greens, Frances Barbers, Geo Dannels, Chas Colliers, John Robinsons.

James Rogers one of the original pannel that was fail’d to appear at last Court and was fined appears and offers his Excuse to the Court which is is [sic] ordered sufficient and his fine is remited.

Jane Atwood a single woman offers as security for the maintenance of her bastard child Anne, Thomas Atwood in the sum of one hundred and fifty pounds to indemnify and save the County from expence by reason of the birth or maintenance of said Child Anne who entered into bond accordingly. gave Bond. Tuesday Morning 25th Aug’t 1795, Court met according to adjournment. Present: James Carson, Rob’t Campbell, Hardy Hawkins, A Tatom} Esqrs.

Jeremiah Holt who was fined at February Court for not attending as a Juror appears and for reasons shewn on oath the Court remits his fine.

Benjamin Lacy, Jonathan Lindley & Arch’d Campbell or either two of them are appointed to examine the accos and vouchers of Geo Madden & John Baker adm’rs of Thomas Baker dec’d & to make report to next Court.

6. Wm Brooks vs And[rew] Brooks} Slander. John Barlow a witness for the Plaintiff called on his Spa & find £20 Sci fa to issue. Sci fa is’d to Feb 96. Jury charged and plaintiff call’d & non Suit. [See also OCPQS 5/49 for more on Barlow’s absence.]

8. Herman Husk vs Joseph Weeks} Case. Jury charg’d, Plaintiff call’d & non Suit.

15. And[rew] Gibson vs Stephen Conger & Isaac Dorris} Debt. Jury charg’d. find the Bond to be the act & Deed of the Def’ts, that the same if of the value of £80, that there is no set off & assess the Plaintiffs Damages to £7.4 & Costs of suit.

20. James D Bradley Assignee &c vs Benjamin Jones} Jury charg’d. Dan’l Green & Geo Stone witnesses summ’d for the Plff was called on their Spa & ????, fin’d £20 Sci fa for failure. Released by Plaintiff. Plaintiff call’d & non suit.

21. Wm Ellegard Admr &c vs James Carson Esqr} Covenant. The above Jury sworn & charged, find the Covenant to be the act and deed of the Def’t and that it is not performed, and as Defeasance[?] & assess the Plaintiffs Damages to £172.08.3 ¾ & 6d costs.

John Hughes is appointed overseer of the road from Dav’d Mebanes lane to Edw’d Pickets lane cross road. Ordered that the following hands work on sd road: Dav’d Mebane, Wm Tate, Thomas Tate, James Tate, Jno Armstrong, James Mebane Jr, Jacob Jeffries, Jno McCartney, Edw’d Wilson, Jno Douglass, Henderson Douglass and the hands of Wm Strudwick.

25. Jno Wair vs Thomas Mulholland} Debt. The above Jury sworn & charged. [no verdict given]

26 Auston Willis vs Tho H Perkins} Case. The above Jury charg’d, find the Defend’t guilty, that there was no release or satisfaction & assess the Plaintiffs Damages to £24.15 & 6d Costs.

[OCPQS 5/33 - Aug 1795]

On motion of Jno Williams Esq Atto for Sarah Rickets, ordered that a Writ of Habeas Corpus issue to Absalum Roach commanding him to bring before this Court now siting the body of Polly Rickets daughter of the aforesd Sarah Rickets and the reputed child of sd Absalum Roach, that the same was child may be disposed of in such manner as the Court may direct. rule inlarged for Habeas Corpus and the child to be brought up the 3d day of next Court. [See Bastardy Bonds, image 613.]

Wm Ray to whom at last term was granted Administration de bonis non on the Estate of Jno Ray deceased offers as his securities John Ray Major & John Thompson Esquire in the sum of £500 who are approved of by the Court. Bond executed accordingly. [See also administration OCPQS 4/397 & OCPQS 5/12, guardianship OCPQS 5/361.]

On the Petition of Martha Loyd Widow of Stephen Loyd deceased and of Henry and Stephen Loyd Infants by their Guardian the said Martha and of Thomas Loyd, It is ordered by the Court that Henry Morris, Isaac Morris, William Anders, Thomas Brewer and Thomas Loyd all of Orange County be and they are appointed Commissioners to distribute and lay off all the real Estate of which the said Stephen died seized and possessed in the County of Orange aforesaid, in such proportions as by the several acts of assembly in such case made and provided is directed, that is to say allowing the widow one third part in value of the said land including the mansion house & distributing the remainder in Equal proportions between the said Henry, Stephen and Thomas. And the said Commissioners are hereby ????uled to return under their hands and seals to the next Term of this Court what they shall have done in the premises & how they have distributed said Land, together with surveys of each plat of Land. [OCPQS 5/34 - Aug 1795]

On the In the Suit of Samuel Guthrie agt Wm Oneal, the Defend’t prays an appeal to the Sup Court and offers Tho H Perkins & Charles Doud Securities.

Court met agreable to a[d]journme[n]t. Present: James Carson, A Tatom, Walter Alves} Esqrs.

Hanah Clark the widow and relict of Wm Clark Dec’d comes into Court and relinquishes her right of administration of the sd Dec’d’s estate. Whereupon administration of the estate of the sd Wm Clark Dec’d is granted to James Clark & Thomas Clark sons of the sd Dec’d who enters into Bond with Wm Clark & Dav’d Faucet their Securities in the sum of £750, and they quallified as such.

James Holston is excused from the payment of a poll tax by reason his infirmity.

Administration of the estate of John Lewis Dec’d is granted to Wm Lewis who enters into Bond with John Wood esq & Wm Wood in the sum of £750 and they quallified. [See also guardianship OCPQS 5/53.]

28. Henry Trolinger vs Benjamin Thomas} appeal. Jury sworn & charg’d, to Wt: Rich’d Stanford, Alex Straine, Wm Stroud, James Walker, James Tate, James Clark, John Woods, Dav’d Faucet, Jno Armstrong, Thomas Clark, Jas Kirkpatrick Francis Baldridge, Jno Caine. Plaintiff call’d & non suit.

29. James Christmas vs John Kirkpatrick} appeal. Jury as above charg’d & plaintiff call’d & non suit.

Jno Caine vs Equilla Rhodes} Caveat. The Sheriff returns into Court a general Verdict for John Caine, and it is agreed by & between the parties who are here present that each of them will pay his own Atto in the above case & divide equally the payment of the other costs. /Jno Cain/ /Aquila Roades/

The State v. Isaac a negroe Slave, the property of Wm Lytle Esq} Jury, to Wt: Francis Baldridge, Wm Stroud, Rich’d Stanford, James Tate, James Baldridge Walker, Dav’d Faucit, John Armstrong, Lewis Kirk, James Pratt, Dav’d Allison, Dav’d Ray, John Woods Shff. Africa [Africa Parker] a Negroe man slave the property of Wm Courtney & Silvia a woman Slave the property of Jno H???? Sworn on behalf of the State. Find him Guilty in manner and form as charged in the accusation.

On motion, ordered that Jacob, James & John Dablin & Fanny Dablin orphans of Jacob Dablin [Deblin] Dec’d be brought by the Sheriff of Orange County to next Court to be held on the 4th Monday of November to have Guardians appointed & to be bound out to some trade or calling if necessary. Thursday morning 27th August 1795, Court met according to adjournment. Present: James Carson, Jno Hogg, A Tatom} Esqrs

State vs Isaac a Negroe man the property of Wm Lytle} Pet Larc. It is ordered by the Court that the sd Negroe man Isaac be taken to the public whiping post between the hours of 5 & 6 7 in the afternoon of this day & there receive 39 lashes on his bear back well laid on and that the Sheriff of Orange carry this order into Execution.

State vs Thomas Morgan} Ind’t As’t. Jury sworn, to Wt: Rich’d Stanford, James Walker, Wm Stroud, Alex Straine, James Tate, Francis Barldridge, Wm Rider, Owen Lindley, Thomas Oneal, Francis Dunn, Thomas Horne, James Philips - find the Defend’t not Guilty. On motion ordered that Walham Wood the pros pay the costs of this prosecution.

[OCPQS 5/39 - Aug 1795]

Joseph Hodge Shff &c enters into Bond with Rich’d Stanford, Wm Hall, Reubin Smith, Thomas Whithead & Wm Lytle Esq his securities for the due Execution of his office as Shff and for the Collection and accounting for the Public & County tax & the sd Joseph Hodge takes the oath of office When James Carson, Jno Hogg & Absalum Tatom Esqs are on the compose the Court.

Ordered that John Rives be appointed overseer of the road from Francis Wilkersons land to buck horn branch and that all convenient hands work thereon: Sam’l Whitesides, John Walker Jr, John Walker Sr, Phillip Walker, John Trousdale, Rich’d Cope, George Cope, George Boyd, Andrew Walker, Alex’r Faddis, Peter Elmore & Jacob Thomas. Copy issued.
