Administration of the estate of Samuel Devenport Dec’d is Granted to Martha Davenport Widow of said Samuel & John Torentine Blacksmith. Ordered that they enter into Bond with James Turrentine & Rob Stuard Jr Sec’ys in the sum of £200. [See also guardianship OCPQS 5/566.]

Ordered that Wm Hendrick natural son of Ann Hendrick of the age of Five years on the ?? day of May last past be bound apprentice to Thomas Horne until he attain the age of twenty one years. [Bond not found.]

Wm Galbreath vs Joseph White} Case. Jury charg’d & Sworn, to Wit: Sackfield Brewer, Lewis Kirk, John Warren, Caleb Harvey, Edw’d Trice, James Combs, Henry O’Dannel, Mann Patterson, Tho Horne, Tho Vincent, James Walker, John Cole. Plaintiff called & non pross.

Henry Newsome vs Robert Trotter} Debt. Same Jury as above charg’d, find the amount of the Conditions of the Bonds declared on is £19.7 Virg money, out the sum of £4.4 was paid on [blank] the [blank which leaves a balance due by Defendant of £15.3 Virg money of the value of £25.5.0 No Carolina Currency & assess the Plaintiffs Damages to £18.1 & Costs. Jury charg’d, to Wit: And[rew] McBroom, James Doherty, John Breeze, Isaac Jackson, Thomas Durham, Daniel Watson, Dav’d White, Joseph Baker, Stephen Carruthers, Samuel Thompson, Henry Pickard, Caleb Harvey – find no payment, Satisfaction, or Set off & assess the Plaintiffs Damages to £62.8.7 & Costs. 191.14.6 Principal [totaling] £254.4.1. 12. John Carrington vs Lucy [or Leroy?] Mangom & Sion Bobbit} Same Jury as in No 11, find that there is no payment, Satisfaction or set off & assess the Plaintiffs Damages to £22.12. 69.13.5 principal [totaling] £92.5.5.

No 13. The plaintiff agrees that if on the trial of the petition Wm Mangum & others agt him there shall appear to be due to Wm Mangom a sum exceeding the forgoing Judgments Say in No 11 & 12, he will pay the Costs of them two suits & that in the mean time Execution stay until such petition is finally decided on.

Thomas Brooks vs Shadrach Ditto} Trespass. Same Jury as in No 11 charg’d & Sworn, find the defendant not Guilty.

Whereas it is suggested to the Court that Mary Moore & Ann Moore bastard Children of James Moore are in a State of want & distress, therefore ordered that the Sheriff take & bring to next court the aforesaid Mary & Ann that the Court may make such order relative to them as shall seem propper & needful.

14. Thomas Mulholland Exrs vs Wm & John Ray} Coven’t. Jury charg’d & Sworn, to Wit: Sackfield Brewer, Lewi Kirk, John Warren, Edw’d Trice, Dan’l Cloud, James Comb, Henry O’Dannel, Mann Patterson, Thomas Horne, Tho Vincent, James Walker, John Cole – find for the Plaintiff & assess his Dam to £57.10.0 & Costs.

Ordered that Mary McIntosh natural child of ??? Fury be bound unto Richard Hargroves for Six years from this date. [Bond not found.]

Ordered that Wm Freeman son of Samuel Freeman Dec’d aged 12 years the 13th October next, be bound to Richard Thompson to learn the art and trade of a Black Smith. [See Apprentice Bonds, image 305.]

Ordered that Polley Forrister Alias Chisenhall the natural Daughter of Nancy Forrester, at the time of the ???? of six years or thereabout, be bound apprentice to Lazarus Cates until she attain the age of Eighteen years of Age. [Bond not found]

Barney May is excus’d from the payment of a poll tax by reason of his being a Cripple.

30. John Estes vs Wm Nash Esqr} Case. Same Jury as in No 27 charg’d & sworn, find the Defendant did assume, that there is no paym’t or set off & assess the plaintiffs Damages to £41.17.1 & Costs.

34. The trustees of the University vs Alex Mebanes Exrs} Case. Jury Sworn, to wit: Enuch Collins, Nath’l McLemore, Henry Bason, James Strayhorn, Charles Collier, John Moore, Carnes Tinnen, Levi Hall, James Tate, Wm Horne, Rob’t Wilson, Isaac Hall – find the Defendant did assume & assess the plaintiffs Damages to £100 & Costs.

The trustees &c vs John Carrington & others} Debt. Same Jury as in No 29 Sworn, find the Bond declared on not paid. £200 to be disch’d on the payment of 10. With in from 12th October 95 til pd.

Same vs And[rew] Burke & others} Debt. Same Jury as above, find the Bond declared on no paid. £250 to be discharg’d on the payment of £124 with Int from 12th October 1795 til paid.

Present, the following Justices of the County: Absalum Tatom, James Carson, Empson Bird & John Hogg, Jno Sloss, Wm Shepperd, James Baldridge when Andrew Murdock Esq who [was] appointed Sheriff at last Term of this Court, offered as his Securities Rich’d Christmas, Dav’d Ray, James Mebane Sr & Wm Lytle Sr who are approved of by sd Justices who which sd Securities entered into Bond with the said Andrews as his Securities in the sum of £5000 Condition’d for his faithful performance of the office of Sheriff Generally, one other Bond in the sum of £2000 Condition’d for his duly Collecting, accompting for & paying the public taxes & one other Bond in the sum of £2000 Condition’d for his duly Collecting, accounting for & paying the County taxes & the said Andrew Murdock quallified took the oaths necessary for his quallification.

Wm Hall appear’d, quallified as deputy Shff of Orange County under Andrew Murdock high Sheriff.

Ordered that a Jury be appointed to lay off & mark out a road &c see petition

James Baldridge Esqr who was appointed Treasurer of the public buildings of this County by our last County Court now comes into Court and entered into Bond with Walter Alves, Wm Kirkland & Henry Thompson Sr his Secy’s in the sum of £2000 for the faithfull discharge of the office as Treasurer &c & at the same time took the oaths necessary for his quallification.

Joshua Horne & others vs Thomas Horne} Petition, this Case being argued by the Court on both sides, It is the opinion of the Court & they do order that the petition be dismiss’d & that the Defendant recover his Costs.

Messrs Cockran McKee? & Co vs John Fairman} On motion of John Williams Esq of Council for the Plaintiffs, and upon reading the ??? & return thereof issued on the Judgment in this cause, And it being Suggested by the Plaintiffs that the Defendant hath fraudulently made away with his property for the purpose of avoiding the payment of the Execution, it is order’d that notice in the nature of a Sci fa do issue to James Coghlin of Hillsbo in the County of Orange Storekeeper to appear at the next Court of Pleas & quarter Sessions to be held for the County of Orange to shew cause (if any he has) why ??? issue should not be made up, whether any fraud or concealment of the property aforesaid hath been made by the Defendant John Fairman to the ??? or whether the same hath been made over to avoid recovery of the plaintiffs afoursaid with Just & valuable Consideration & then & there to answer to the fraud & concealment before mention’d.

On motion of Wm Farmer by Wm Norwood his Atto, ordered that a Summons issue to Lewis Jones Sr guardian of Samuel Wilson, Greggory Wilson & ??ry Wilson orphans of Wm Wilson Dec’d to shew cause why he had not settled his acco’s as Guardian & why he shall not give new Security for his said Guardianship. Ordered that John Hawkins the reputed father of a natural born child of Catherine Charles pay to the said Catherine Charles six pounds a year for five years to commence on the 24th January of the present year for the nurture & support of a said Child. [a later note added:] Lodg’d in the office by Jno Hawkins for Capt Charles £12, and paid by S Benton to Michael Charles the 25th May 1797 as p rec’t. Jury Sworn, to Wit: John Casey, Caleb Harvey, John McKerrel, Tho Watts, Samuel Cleney, Gavin Alves, And Brooks Alex Piper, Rob’t Tinnen, Carnes Tinnen, Joseph Barbee Fras Frasier?, James Philips, James Combs. Juror Withdrawn.
12. The State vs Susanah Jackson} Ind’t Ass’t, the above Jury Sworn, find the Defendant Guilty in manner & form as charg’d in the In’t.

On motion of Catherine Tinnen widow of Rob’t Tinnen Dec’d by Wm Duffy her Atto, It being suggested to the Court that the said Robert had made a will which is produced & it appearing to the Court ?? ???? that the said will cannot be prov’d because the Subscribing Witness thereto are Legatees in the Will & refuse to release their Interest therein, Whereby the said Will is void in Law, It is therefore considered by the Court that administration ought to be granted as if no such will had been made and ordered that administration be, and it is accordingly to Catherine Tinnen & to Carnes & Robert Tinnen of the Goods & Chattels, rights & Credits that ??? the said Robert Tinnen Dec’d, they entering into Bond in the Sum of £300 with Henry Mason & Thomas McCracken Sec’ys for their due administration & the sd Admrs takes the oath necessary for their quallification. [OCPQS 5/125 - Aug 1796]

The treasurer of public buildings reports to this Court as followeth: To the Court of Pleas and Quarter Sessions of Orange County now siting, Treasurer and Superintendent of public buildings in said County reports that he has examined the Public Goal & fins it unfit for the safe keeping of the prisoners. He is of opinion that the said Goal at present may be repair’d & made sufficient with a small sum of money, that is to say, to may be put in as good or better situatio Condition as it has been for a Considerable time past. The Superintendent only waits the direction of said Court to proceed to the reparation of said Goal. The Court taking the above report into consideration are of opinion that they cannot at this [time] act on the said report as the act of the General Assembly in that Case requires that a majority of the Justices of the County shall be present when Commissioners are appointed to act with sd Treasurer in making Contracts &c.

The State vs Wm Lockard} Ind’t fraud. Same Jury as in No 12 Sworn, find the Defendant – Juror withdrawn.

Friday 26th August 1796, The Court met according to adjournment. Present: Sterling Harris, Wm McCauley, Absalum Tatom, John Hogg}.

On motion of Pumphret Herendon by Wm Norwood Esq his Atto and & the petition of the said Pumphret Herendon, ordered that Alexander Piper, Baxter King, Lewis K????, Benjamin Yeargan view, lay off & value one acre of land on both sides of Phills Creek at or near the said Herendons former mill seat for the purpose of having the same condem’d to the use of the said Herendon to build a water Grist mill & that Summons issue to Jno Stroud who owns the land on one side of sd Creek so to be view’d, valued & laid off, to come in at next Court agreable to act of assembly.

On the petition of Walter Alves Esqr for ???? for turning the public road at his own expence near his house from the Chappel hill where it runs to the South thereof, Ordered that the following Jury or either twelve of them lay off & mark out the road agreable to the said petition to wit: Wm Cain, Charles Dunagan, Tho Latta Sr, ?????? On motion of Wm Duffy Esq atto &c, ordered that ??? Whithead be appointed prochein ami for of Eleanor Whitehead to sue for the said Eleanor in the suit vs Fisher Clendennin.

John Casey, Wm Kirkland & Wm Whithead are appointed assessers of the town property for the year 1796.

It being represented to the Court now siting that the Court at last Term fail’d to examine the transcript of the Entry takers books of this County made agreeable to act of the last general assembly or to make an order in this regard, It is now order’d that Absalum Tatom, Sterling Harris, Wm Lytle, Wm Courtney, Jno Hogg Esqrs or either three of them be & they are hereby appointed to examine said transcript & the same having examined to grant a Certificate if to the end that the same may be returned to Sec’ys office in Compliance with the act in this ??? made & provided as abovesaid.

The Execution of a Deed from Gilbert Strayhorn to the Rev’d Wm F Thompson was duly proved in open Court by the oath of John McCauley one of the Subscribing Witnesses thereto & ordered to be Registered. [See ODB 5/485.]

The Execution of a Deed from Gilbert Strayhorn to New Hope Congregation was duly proved in open Court by the oath of John Mitchel one of the Subscribing Witnesses thereto & ordered to be Registered. [See ODB 5/486.]
