John Dunnavin vs Tho Mulhollan’s Exrs} Case. Gen’l issue, Stat Lim, payment, set off, release, Satisfaction & accord. Same Jury as in No 1 charged &c. Find the Def’t did assume & within 3 years, that there is a no payment of £24 or set off, that [there] is no release or Satisfaction & that there is no accord & assess the Plffs damages to £5 & Costs. Find the Defendants Testator did not assume to pay the Sum of £10 charged in the Plff Acct, that defendant’s Testator did assume within three years to pay the Plff the Sum of £29, that  he has paid £20 of the Sum and assess the Plff damages to £5 and 6d Costs.

Robert Campbell vs John Taylor} Case. Gen’l issue, Set off & Stat lim. Jury charged, to wit: Henry Pickard, Robert Carson, Tho Fitch, James Faucet, Armor King, James Wilson, Wm McDannell, Wm Love, Jno Justice, Leven Rhodes, Rich’d Hargraves, David Fossett. George Cleney, James Philips & Catlet Campbell are appointed to assess the Town property in Hillsborough for the year 1797.

Wm Galbreath Elliot vs John Galbreath} Covenant. Gen’l issue, Covenant performed & notice of set off, and the work was not completed by the Plaintiff. Sam Jury as in No 5 charged &c, find the Covenant declared on to be the act & deed of Defend’t, that the same has not been perform’d & that there is a set off of £18.12, that the work was completed by Plaintiff and assess the plaintiffs Damages to £508.18 & Costs.

16. Jno Stroud assignee &c vs Jno Taylor Esqr} Debt, Gen’l issue, payment & set off. Same Jury as in no 12 Charged &c, find the note declared on to be the act & deed of Defend’t, that there is no payment of set off & assess the Plaintiff’s Damages to £4.10.2 ¼. Princip 54.2 [totaling] 58.12.2 ¼.

17. Jno Hogan vs Jno Piper} Covenant, Paym’t at & after the day, notice of set off. Same Jury as in No 12 sworn &c, find that on the 25th day of January 1777 the Defendant paid to John Hogan the full amount of the Bond declared on with Int.

18. Jno Hogan vs Jno Woods} Covenant. Same pleas &c as in no 17, find that on the 12th October 1779, the Defend’t paid to John Hogan the full amount of the Bond declared on with Int.

On motion, Ordered that the two receipts shewn the Court in discharge of the two Defendants in the two abovementioned suits be delivered to Wm Duffy Esqr Atto &c & the same are accordingly delivered by S Benton.

27. Jeany Watson assignee &c vs James Watson Jr} Debt, Payment & set off. Same Jury as in no 5 charged &c, find the Def’t Guilty and within one year and that the Def’t hath not justified and assess the plaintiffs Damages to £5.0.0 & Costs. James Caston vs Stokely Donelson} Atta. Augustus Benton who was summoned as Guarnishee appearing & being sworn Sayeth that he some time ago purchase of Stockley Donelson a quantity of Goods for which he gave him his Bond to a considerable Amt & that since that time he hath made considerable payments previous to the levying this Attachment in his hand, that he is bound by his obligation in conformity to a Decree of the Court of Equity to convey to Joseph on behalf of Stockley Donelson to Joseph Brown a certain quantity of Land which when done will discharge as his concur??? & overpay his Debt to Donelson as aforesaid. [in left margin:] Guarnishee discharged by order of the Court.

Jno Washington vs Wm Courtney} Case, payment & notice of set off. Jury charged, to wit: Jno Horneday, Wm Harvey, Jacob Wilhoit, Michael Holt, Wm Gaunt, Tho Clark, David Allison, Jno Moore, Tho Robertson, Jno Millikin, Tho Lloyd, James Clendinen. Find that there is no payment & that there is a set off of a Tavern around to the Amount of £1.13 & assess the Plaintiffs Damages to £52.5.10 ½ & Costs.

Ordered that Wm Shepperd, Empson [Bird] & James Christmas settle with the County Treasurer for the year 1797.

3. The State vs Marg’t Phifer} Ind’t Pet Larc. Charged & pleads not Guilty. Jury Charg’d & Sworn, to Wit: Jno Horneday, Wm Harvey, Jacob Wilhoit, Mich’l Holt, Wm Gant, Thomas Clark, Dav’d Allison, Jno Moore, Thomas Robinson, Jno Milliken, Thomas Loyd, James Clendening. Find the Defendant guilty. New Trial prayed & granted.

The State vs Joseph Courtny} Ind’t as’t. Charg’d & pleads not Guilty. [Jury:] Thomas Hunt, Dav’d Umstead, Rob’t Fosset, Sam’l Clenney, Isaac Holt, Mark Durham, James Tate, Thomas Fosset, Rich’d Thompson, Thomas Lindley, James Milliken, Charles Kelley. Find the Defendant not guilty. Motion for prosecutor to pay Costs. Court being divided in Opinion, party takes nothing by his motion.

State of North Carolina v. A Negro Man Bob, the property of Wm Hunt of Granville County} Ind’t. Charged with having broken & entered the dwelling house of Sam’l Dick of Orange County & stole therefrom certain Goods the property of the said Samuel Dick as exhibited in the Said Charge. Pleads not Guilty. Jury Sworn, to wit: Jacob Wilhoit, Michael Holt, Wm Gaunt, David Allison, John Moore, Thomas Robertson, Isaac Holt, Robert Fosett, Robert Dixon, John Justice, Abner Tapp, John Carson. Find the Negro Bob abovementioned guilty in manner & form as set forth in the Charge. They further find that Wm Hunt the Owner of the said Negro Bob has in all respects Treated him as a kind Master & assess the and further find the said Negro to be of the Value of £200.

Pursuant to an Order of this Court, Wm Shepperd, Empson Bird & James Christmas who were appointed to settle with the County Trustee return as follows, to wit: Agreeable to an Order of the County Court of Orange to us directed, we have this day settled with David Ray of Hillsborough County Trustee & find a balance in the hands of the Trustee aforesaid of Three pounds thirteen Shilling & nine pence. Friday 31th [sic] August, Court met according to adjournment. Present: Wm McCauley, Jas Christmas, Sterling Harris} Esqrs.

Ordered that Rachel Morrow daughter of Wm Morrow Dec’d now of the age of nine years the 23rd day of May last be bound to Andrew Morrow to learn the Art & Mistery of a Spinster. [See Apprentice Bonds, image 337. See also accounting OCPQS 4/341.]

Ordered that Elizabeth Morrow Daughter of Wm Morrow Dec’d now of the age of Eleven years the 3rd day of April last be bound to Jno Morrow. [See Apprentice Bonds, image 333.]

Stephen Kenneday who was confined in the Gaol of this County under the Sentence of the Superior Court being brought into Court and after paying his Fine agreeable to the Sentence of the sd Superior Court & depositing in the hands of the Clerk the Sum of Seven pounds, which is to be applied toward the dis[c]harge of his fees in the Superior Court Save two pounds which was ordered by the Court to be paid his Council in this Court, made Oath that he was not worth 40. Sterling Money in any worldly Substance either in debts owing to him or otherwise howsoever over & besides his wearing apparel, working Tools & arms for Muster & that he has not at any time since his Imprisonment or before directly or indirectly sold, assigned or otherwise disposes of or made over in trust for himself or otherwise any part of his real or personal Estate whereby to Save or expect any benefit or profit to himself or to defraud

Any of his Creditors to whom is endebted. It is therefore ordered by the Court that he be discharged from his Confinement. £2 paid Robert Williams his Attorney in this Court. £5 remaining in the hands of the Clerk.

The State v. Negro Bob the property of Wm Hunt of Granville County} Charged & found Guilty of breaking open entering into & taking from the house of Samuel Dick certain Goods of the property of the said Samuel. Being brought to the Bar, received the following Sentence, to wit, That he Bob be taken to the public Whipping post & there receive thirty nine Lashes well laid on his bare back that each of his Ears be nailed to the Pillory & cut off & that he be branded on each Cheek with the brands usual on those Occasions – and that the Sheriff of Orange carry this Sentence into Execution between the hours of 12 & 2 o’clock on this day.

Ordered that a free Negroe boy called & known by the name of Moses of the age of 16 years some time in this month be bound unto John Bullock til he arrive to full age until to learn the art & mistery of a Potter. Issued [See Apprentice Bonds, image 314.]

On motion, Ordered that the attendance of Jesse Lynch, Moses Lynch & Thomas Fulton as witnesses in the Petition of And[rew] McCleary & wife vs Rich’d Hargroves & Ux & others be struck out of the Bill of Costs as it does not appear that the above persons were summoned as witnesses in the sd Case.

Ordered that a female child called Nancy Jackson the daughter of Mary Jackson Collins and the reputed daughter of Levi Whitehead and of the age of eight years the 10th day of April last be bound to Levi Whitehead until she arrive to Lawful age. Ordered that a Scire facias issue to Jno Hawkins the reputed father of a bastard Child born of the body of [Catherine] Charles Single Woman, to Shew cause why Exec at our next Court why Execution shall not issue against the said John for such allowance as the Court has heretofore made for the Maintenance of said Child. [See Bastardy Bonds, image 586, also OCPQS 5/123.]

Ellenor English vs James Carson} Caveat of the Will of David English Dec’d. Issue to be tried at this Term whether it be a Will or not. Jury charged, to wit: Jno Horneday, Wm Harvey, Jacob Wilhoit, Michael Holt, Wm Gant, Thomas Clark, David Allison, John Moore, Thomas Robertson, John Milliken, Thomas Lloyd, James Clendening. Find that is no Will. [See also administration OCPQS 5/418 & OCPQS 5/585, inventory OCPQS 5/629, partition of land OCPQS 6/152.]

Administration of the Estate of David English Dec’d is granted to Ellinor English who enters into Bond in the Sum of £500 with, with [sic] James Riggs, Thomas Jourdan & William McCanlis her Securities for her due administration. [But Ellinor soon died and James Carson was appointed to administer both her estate and David’s. See OCPQS 5/585.]

[OCPQS 5/461 - Aug 1798]

Ordered that Benjamin Burnsides the reputed father of a child delivered of the body of Mary Coble pay unto the said Mary Coble for the support & maintenance of the said Child Twenty Seven pounds in Annual Payments, to wit, Seven pounds for the first year & five pounds for each year thereafter until the whole shall be paid, the time of payment to commence from the birth of the aforesaid child, the said Benjamin Burnsides to be allowed the sum of Three pounds which he has already paid on the first payment. [See Bastardy Bonds, image 774.]

Ordered by the Court that the Guard be discharged from the publick Goal.

Michael Holt is appointed Deputy Surveyor for the County of Orange and qualified accordingly.

Catlet Campbell, Geo Cleney & James Phillips who were appointed Commissioners to Value the town property for Hillsborough for the year 1797 return the Valuation accordingly.

Ferabee Fossett vs Thos & Mary Fossett & others} Petition for Dower. Upon hearing the petition of Ferrabee Fossett and the Answer in this case, it is considered by the Court that the Petitioner is entitled to the Dower according to the prayer of her petition & ordered that the Sheriff summon a Jury of Twelve Free holders &c to go on the Land & lay off the Dower according to Law, and make return to next Court.

[OCPQS 5/464 - Aug 1798]

Ordered that Bowling Jolley the reputed father of a Child delivered of the body of Mary Dixon Single Woman pay unto the said Mary Dixon for the support and Maintainance of the said Child Twenty seven pounds in Annual payments (to wit) seven pounds for the first year and five pounds for each year thereafter untill the whole shall be paid. The time of payment to commence from the Birth of the aforesaid Child and he the said Bowling Jolley enters into Bond for the performance of this Order, and to keep the County indemnified &c. [See Bastardy Bonds, images 757, 776 & 929, also OCPQS 6/140.]

Ordered that Robert Simmons the reputed father of a Child Delivered of the body of Mary Whithead for the support and maintainence of the said Child twenty seven pounds in annual payments (to wit) seven pounds for the first year, and five pounds for each year thereafter to commence from the birth of the aforesaid Child and the said Robert Simmons enters into Bond for the performance of this Order and to keep the County indemnified &c. Ordered that Samuel Benton the reputed father of a Child delivered of the body of Alice Murphey Single Woman pay unto the said Alice Murphy for the Support & Maintenance of the said Child Twenty Seven pounds in Annual payments, to wit, Seven pounds for the first year & five pounds for each year thereafter until the whole shall be paid. The time of payment to commence from the birth of the aforesaid Child, And he the said Samuel Benton enters into bond for the performance of this Order & to keep the County indemnified &c. [See Bastardy Bonds, images 770 & 772, which indicate the child was a boy, presumably Calvin who was later the subject of Apprentice Bonds, image 347 along with a sister Dulconia, who the Apprentice Bond indicates was also an illegitimate child of Benton and Murphey, though her birth does not seem to be mentioned in the minutes or Bastardy Bonds. Less than a year after this, Benton deeded Alce Murphey Lot 86 in Hillsborough at ODB 8/348. Contrast OCPQS 6/334.]
