Ordered that Samuel Turrentine Shff &c be allowed in his Settlement

It appearing to this Court by the affidavit of Samuel Turrentine Sheriff of Orange that he hath lost or mislaid an Order for the allowance of £50 to the Clerk of this Court for the year 1799 and it being acknowledged by the Clerk that the said Order was paid & taken up by the said Sheriff, Ordered therefore that he the said Sheriff be allowed the Same in the Settlement of his accompts with the County Trustee.

On the Suggestion of Jno A William Atto &c that Nathaniel Christmas the Subscribing Witness to a Deed from John Trousdale to the Trustees of the University of N Carolina is an Inhabitant of a foreign State & that the said Jno Trousdale is dead, It is Ordered that a Commission do issue to take the Deposition of said Nathaniel relative to the Execution of said Deed. [See OCPQS 6/304 & OCPQS 6/380 for further probate issues. This deed after finally being proved was recorded at ODB 11/142.]

Amey Ross of lawful age comes into Court and chooses William Brannock for her Guardian who enters into Bond with Joseph Ming & Alexander Robbs his Securities in the Sum of £500. [See also administration OCPQS 5/327 & OCPQS 6/255, inventory OCPQS 6/629, slaves to be sold OCPQS 6/362, litigation OCPQS 6/581.]

Wm Fossett a natural born Son of Elizabeth McCaddams of the age of three years the 2nd day of this present August is bound to Hugh McCaddams to learn the art of farming. [See Apprentice Bonds, image 376.]

Elizabeth Rickets of lawful age comes into Court & chooses James Moore her Guardian who enters into Bond with Charles Christmas & Valentine Moore his Securities in the Sum of £1000. [See also administration OCPQS 5/361.]

Administration on the Estate of James Nichols Deceased is granted to William Kirkland & James Yarbrough who enter into Bond with Duncan Cameron and William Norwood his Securities in the sum of £100.

John Carrington vs Arenah Carrington & others} On Motion of Duncan Cameron Esq Atto &c for administration to be granted to Arenah Carrington & William Cain on the Estate of James Carrington Jr Dec’d the late husband of the said Arenah Carrington. John Carrington by William Duffy Esq his Council enters a Caveat against the said Administration & moves for a Continuance thereof to the next Court under the Act of 1715. But the Court refused the said continuance & there being no reasons offered to the Court wherefore administration should not be granted agreeably to the motion of the said Arenah Carrington by her Council, The Court do adjudge & order that the Administration be granted to Arenah Carrington, Geo Cain? & William Cain on the Estate of the said James Carrington Jr dec’d, from said Judgment the said John Carrington prays an appeal. Ordered that the Sheriff bring into the next Court the following children viz Nathaniel Revill, McLin Revill & Cary Revill to be bound out. [See OCPQS 6/252.]

Ordered William Ashley Son of Mary Ashley (widow) now of the age of Eleven years the 20th February last be bound to Wm Mangum to learn the art & mistery of a Farmer. [See Apprentice Bonds, image 381.]

Ordered that Andrew Crabtree son of Nelly Crabtree now of the age of fifteen years be bound to William Crabtree Sr to learn the art & mistery of a farmer. [See Apprentice Bonds, image 395 & 396.]

Catlet Campbell, John Casey & William Kirkland are appointed to examine the accompts & vouchers of David Ray County Trustee for the last year & make report to this Term.

Ordered that Archibald Crabtree natural Son of Elizabeth Crabtree now of the age of Twelve years be bound to James Crabtree to learn the art & mistery of a farmer. [See Apprentice Bonds, image 392 & 393.]

Jury Sworn: William Hogan, James Hastings, Owen Lindly, Robert Faucett, Geo Carrington, Aaron Walker, Abner Tapp, John Holden, James Clendenin, James Johnston, Thomas Brewer, James Mason. Find the Defendant Guilty in manner & form as charged in the Bill of Ind’t. Motion in arrest of Judgmt. Ordered that the Judgment be arrested.

Samuel Goodwin v. Africa Parker, Thomas Faucett, Eli Collins, Kenneth Anderson & Thomas Watts Sec’s} Motion by Plff Judgment against the said Africa Parker & his sureties on his bond for the prison bounds. The Defendants by their Attorney plead 1st that there is no escape. 2nd that the prisoner was retaken upon fresh pursuit. 3rd that the prisoner voluntarily returned within Twenty four hours. Replication & issue as to the first plea. 2nd that the prisoner was retaken out of the bounds upon fresh pursuit & brought back to close custody. Gen’l Demurer to the 2nd & 3rd pleas. Jury charged, to wit: Wm Hogan, James Haistings, Owen Lindley, Robert Faucett, George Carrington, Aaron Walker, Abner Tapp, John Holden, James Clendening, James Johnston, Thomas Brewer, James Mason. Find that there was no escape. The Court are of Opinion that the Plff take nothing by his Motion. Ordered that the Defendants pay their own Witnesses.

James Clendening, James Johnston, Samuel Shaw, Alexander Russell & Robert Thompson are appointed a patroll in & for Capt James Clendening’s Company, they relinquishing all & every emolument that they may be entitled by Law to receive by Law for their Services as patrolls.

Charles Christmas, Thomas Brewer, Thomas Griffin, Parham Kirk are appointed patrolls in & for Capt Charles Christmas’s Company, they relinquishing all & every emolument that they may be entitled by Law to receive for their Services as patrols.

William Shaw, Samuel Allen, John Galbreath, Brown Mebane are appointed patrolls in & for Capt Hodges’s Company, they relinquishing all and every emoluments that they may be entitled by Law to receive for their Services as Patrolls.

The State vs Joseph Morgan & others} Ind’t Riot, Charged & pleads not Guilty. Jury charged & sworn: Joseph Wood, Sam’l Carson, James Wilson, Wm Hendley, James Finley, Jesse Towel, John Towel, John Casey, James Webb, John Johnston, William Kirkland, James Yarbrough. Find the Defendants Guilty in manner & Form as charged in the bill of Ind’t.

Henry Newton one of the Executors named in the last will & Testament of George Newton Dec’d [OWB D/44] proved in this Court at last Term [OCPQS 6/198], comes into Court and qualifies accordingly.

The State vs Joseph Morgan & others} Ind’t Riot. Ordered that Joseph Morgan & William Flinthim pay a fine of five Shillings & be imprisoned until Twelve o’Clock on Tomorrow Week & thereafter until the fine & costs are paid. Ordered that James Morgan pay a fine of five Shillings & be imprisoned until Tomorrow 12 oClock & thereafter until the fine & Costs are paid.

On Motion, Ordered that Francis Nash Pay unto Sarah Roberts the Sum of Twenty seven pounds viz in five annual payments. [See Bastardy Bonds, images 594, 596, 598, 692 & 953.]

Africa Parker v. Sam’l Goodwin & others} Petition to be discharged under the Act for the relief of Insolvent Debtors. On motion for leave to amend the petition by adding the name of William McKerall, the Court adjudges that leave shall not be given to amend. Appeal prayed & granted.
