State of North Carolina, At a county court of Pleas and Quarter Sessions begun and held for the county of Orange at the court house in the Town of Hillsborough on the fourth monday of February 1795 being 23 day of said month. Ordered that the Sheriff of Anson county who was amerced last term, be let stand over till next court by consent of John Williams atto for State and said Sheriff of Anson &c.

The last Will and testament of William Shannon Deceased was duly proved in open court by [Rachel] Crawford at the Same time Richard Christmas qualified agreeable to Law. [See OWB B/289.]

Administration of the Estate of Jas Miller granted to John Miller on entering into Bond with Wm Smith & Wm McMunn Securities in the Sum of four hundred pounds at the same time qualified agreeable to Law.

Remaining Jurors of the Original Pannel: Jeremiah Holt, Anderson Stroud, Walter McFarlin, Geo Johnston, Wm Mangrom.

William Rodgers is appointed overseer of the road from Rodgers field to Friddles land, and that the usual following hands work on the same (to wit): Peter Rich, Jarot Rich, Conrod Pile, George Hensro?, George Neese, John Sharp, Henry Cook, Colba Jackson, Peter Noe, John Noe, Henry Friddle, Mallachi Hatmaker, Francis Hatmaker, Robert Dixon, James Rodgers, Francis Holt.

Ordered that John McDannel be appointed overseer of the road from Rays ford to Whitheads Creek and the usual hands work on the same and keep said road in good repair as the Law directs.

Peggy Jamison comes into court and chooses Jane Jamison as Guardian and enters into Bond with William Hall and Joseph Hodge Securities in the Sum of two hundred & eighty pounds &c. Ordered that the  following hands work on the same ??: Wm Rhodes Jr one hand, Joseph Barbee, Wm Rhodes Sr, Mann Patterson, John Barbee, Young Barbee, Page Patterson, Mark Barbee, Wiled Patterson & two hands, Michael Hinchey, Benjamin Rhodes.

Tuesday morning nine o’Clock Court met according to adjournment. Present: William Nunn, John Rhodes, John Thompson} Esquires.

David Coble is appointed Overseer of the road from Christopher Cobles old place to Randolph line. Ordered that the following hands work on the same (to wit): John Long, John Clarke, John Spoon, George Smith, Henry Coyme [Henry Kime], William Woold, Adam Springer, Adam Smith & Henry Coble.

Joseph Wells is appointed Overseer of the road from Daniel Freemans to Christopher Cobles old place. Ordered that the following hands work on the same (to wit): Stephen Ward, Nathan Wells, Wm Wells, Jesse Wells, Jacob Cloud, Wm Pike, Levi Griffin, Alexander Hunter, Anthony Ward, Peter Stoner.

[Jury:] Sam’l Wilson, Charles Rountre, Zachariah Dickey, Rob’t Nail, Wm Smith, Wm Rodgers, Jacob Marshal, John Kelly, Rich’d Coope, Wm Elliott, Dan’l Freeman, John Reeves. 3. Augustus Benton vs Benjamin Smith} Gen’l Issue and set off. Jury Impannelled & Sworn find a that the Defendant did assume of the in manner as the Plaintiff has declared & their Verdict for the Plaintiff is a set off deducted of 17.13 & after did deducting the same assess his [damages] £86.10.6 & 6d Costs – an appeal prayed & Granted. Defendant enters into Bond with John Taylor & Nath Christmas who are approved by the court.

John Barbee is appointed overseer of the road in the room of Joseph Bennett, from the county line to the old muster ground near James Wilsons.

Samuel Freeman is appointed is appointed [sic] Overseer of the road from the road passing by Lindleys Store from Chatham county line to the fork of the road on Honeycuts hill in the room of Peter Foust.

The Last Will and testament of Henry Dunwiddie was duly proved in open Court by the oath of Jonathan Dollar one of the subscribing witnesses thereto & ordered to be Recorded at the same time Josiah Warren & Elizabeth Dunwiddie qualified as Executors &c. [See OWB B/292.]

Mary Doherty Records her ear mark a smoothe cross off both Ears with three Slits in each which makes the Ear in four pieces.

Ben Yeargain vs James Patterson} Plea Gen’l Issue. Jury Sworn, find Defend’t did assume Guilty & assess the Plffs Damages to £20 & 6d Costs, motion for new trial, rule to shew cause.

James Crawford is appointed Overseer of the road from Woodys ferry to James Tinnins in the room of William Ray.

Rob’t Faust comes into court & surrenders Wm Elliott in discharge of himself & said Elliott tenders Henry Faucett & security which is approved of by the court. A Tatom Walter Alves, John Thompson, Wm Nunn & Benj Lacy present.

Samuel Thompson Constable is fined 20/ for non attendance as Constable this Term & fine remited.

Ordered that Edmond Jones, Alex Piper & John Hogan be appointed to superintend the building of a Bridge over new hope Morgans Creek at M McCauleys mill to be let to the lowest bidder. [Per order at OCPQS 4/625. See also Dunaway's Bridge Records, page 18.]

Henry Thompson Jr vs Faucet & Riggs} T V A Plea not Guilty, Jury impannelled & sworn find Defendants not Guilty and assess Plffs Damages to £8 & 6d Costs.

Rob’t Campbell vs John O’Deir} on Motion of Samuel Benton & affidavit of Absalom Tatom it is considered by the court that the Sheriff of Wake county be fined ni si agreeable to Act of Assembly for failing to return the above Writ of Fieri Facias which was returnable to this Term. Ordered that Sci Fa Issue accordingly.

Jo Tate Thursday Morning 9 O’Clock Court met according to Adjournment. Present: Wm Nunn, John Thompson, John Sloss} Esqrs.

John Hogg, David Ray, William Kirkland, John Casey, Sterling Harris, Wm Courtney or any three of them are appointed to examine & settle the accounts and vouchers of the Estate of Frances Child dec’d with Frances Child Executrix and make return to next Court.
