Ordered that in future, the first three days of the Term be
set apart for the trial of Civil & State Causes viz the two first days for
Civil business & the third day for States business and that such thereof as
remains unfinished shall be done on the other days if necessary – That in future
no Deed or Will be admited to probate, administration Granted, Guardians or
overseer of roads appointed or any other business (except the Civil &
Criminal business) only on the three Last days of the Term except in the
probate of Wills or any other matter which may require the Intervention of a
Jury – That the Clerk furnish the Sheriff with eight Copies of the above order
to be posted up in different part of the County, asl one Copy to be delivered
to every Constable in the County in order that the said Constables may give

Ejectment. Same Jury as in No 7 charg’d &c, find the Defendant Guilty of
the Trespass in Ejectment as laid in the Plaintiffs Declar & assess the

Wm Andrews who was sworn as Constable to attend the Grand
Jury this Term being called by the Sheriff at the door of the Court house &
failing to appear, ordered that he be discharged from his further attendance at

The State vs Thomas McDowel} P Larceny. Jury Sworn &
charged, to Wit: Sam’l Nelson, Jehu Whithead, Thomas Armstrong, Martin Parmer,
Jno McCauley, Wm Bradford, William Durham, Jno Paul, James Mebane, Jno
Strayhorn, Jno Daniel, Jno Nelson. Jury charged and Sworn find the Defendant
Guilty in manner 7 form as charg’d in the bill of Indictm’t find that the
goods & Chattels mention’d in the Declaration Indictm’t were the
Goods & Chattels of Jacob Thomas & not of Empson Bird & that if the
Law is for the Defendant they find him not Guilty, but if the Law is is
not for the Defendant then they find him Guilty.
It is considered by the Court on argument upon this Verd’t
that the Defendant Thomas Dowel go without bail.

10 o’Clock 2d March 1797, The Court met according

On motion of Wm Duffy Esq Atty for James Mebane Jun ordered
that Robert Faucit & John Taylor exrs of James Armstrong Dec’d appear at
this Term on Saturday & shew cause wherefore Cisero a negroe man late of
the estate of the sd James Armstrong Dec’d who is now going at large should not
be sold for the benefit of the estate of sd James Armstrong Dec’d. -> The

It being represented to this Court that Thomas Pettigrew,
Joseph Pettigrew & Nancy Pettigrew [Nancy Johnston?] orphan Children of
[blank] who were bound to Andrew Patterson [OCPQS 4/418] are now going [blank].
Ordered that Andrew Patterson appear at at [sic] our next Term to shew cause
wherefore the sd Children should not be remov’d from him, & that the Shff
bring the said Children then before this Court. [This order is located at

John Bullock vs Adam Marley} O Atta. Robert Marley
Guarnishee being sworn says that he has nothing of Adam Marley in his hands or
possession, but that he knows that Joseph Ming is Indebted to Adam Marly Marly
[sic] by note of hand in the sum of Sixty dollars which note is in the hands of
the sd Adam Marley wife which is condem’d for the use Ordered that an alias
atta issue agt Joseph Ming, and that the perishable property Levied on by the
atta agt Adam Marley be sold by the Sheriff.

Ordered that And[rew] Brooks appear before this Court
immediately & shew cause, if any he has, wherefore Jonathan Johnston who
now stands bound as an apprentice to him the sd Andrew should not be removed
from the said Andrews service. [Having been bound to Brooks OCPQS 4/511, and
soon re-bound to Robert Eaton OCPQS 5/180. This order is located at Apprentice

On motion, Ordered that Wm Courtny appear & shew cause
on or before Saturday next to this Court, wherefore he shall not file a note of
hand on which he gave Judgment in behalf of Cain & Ray agt Wm Jackson Jr.
Wm Chizenhall vs John Marcum} In????s Execution. Ordered
that a Sci fa issue to the heirs of Marcum to shew cause wherefore the Land
levied on shall not be sold.
Ordered that the Sheriff furnish procure the Staffs to
be six feet long each, with black tops for the use of the Constables in
Court & that the same be furnishable at next Court.

Andrew Brooks who was Cited to appear & shew cause why
his apprentice Jonathan Johnston should not be discharged from his Service
[OCPQS 5/179], having now appear’d & being willing to release the said
Jonathan Johnston from his services &c, the sd Jonathan is accordingly
released from his apprenticeship with the said Andrew. [Ending his indenture to
Brooks from OCPQS 4/511.]
Ordered that the sd Jonathan Johnston be bound to Robert
Eaton for four years from this date or until he arrives to Lawful age to learn
the art & mistery of a house Carpenter & the said Robert is to give the
said Jonathan three years schooling. [Bond not found.]
Ordered that Sarah Jones an orphan Girl of the age of
fifteen years the 25th July next be bound to John Marshil until she
arrive to Lawful age to learn the art & mistery of a Spinstress. [See
Apprentice Bonds, image 285. But this was not what Sarah’s mother Hannah Jones
had wanted, see OCPQS 5/140.]

On motion of Wm Farmer by Wm Norwood his Atto, ordered that
a Summons issue to Lewis Jones St Guardian of Samuel Wilson, Griggory Wilson
& Mary Wilson orphans of Wm Wilson Dec’d to show cause why he has not
settled his acco as Guardian & why he shall not give new Security for his

Orange County, Greeting. Whereas William Cain, John Cain & David Ray hath
Complain’d to me one of the Justices of the Peace for said Court, that William
Jackson stands Justly Indebted to them on a note, not exceeding six pounds five
shillings and delays payment, you are therefore Commanded to take the body of
William Jackson & have him before some Justice of the Peace for said County

Goaler, the Clk & Atto relinquishing their fees.
John Ray & Rebeckah Campbell witnesses in the Suit of

The Capias ad Satisfaciendum which issued out of this office

Ordered that Andrew Murdock Esqr Sheriff &c be and he is
hereby appointed Collector of the Taxes levied for the purpose of building a
Goal and he the said Andrew enters into Bond with Jno Thompson & Wm
McCauley Esqrs his Securities for the faithful collection & accounting for
the Same in the Sum of one thousand Pounds.
Whereas at last November Term [OCPQS 5/169] an Order passed
and was published directing that all Guardians should appear at the present
Term to give an Acct of their Guardianships and Whereas many Guardians have
failed to comply with said Order, therefore Ordered that the Clerk Issue Scire
facias a Summons to all delinquent Guardians to render their Accts at next

Daniel Freeman is appointed Overseer of the Road from the
Cross Roads on Freeman’s Hill to the great road that leads to Wooddie’s Ferry
on Haw River in the Room of Jno Morrow. Ordered that the following hands work
under him, viz: Jno Allen, Jacob Stout, William Marshill, Charles Stout, Will’m
Aston?, Joel Brown, Peter Stout, Peter Stout (mountain), Jose Stout, Joseph
Stout (Son of Samuel), Humphrey Williams, James N????, Wm Gappens, Jno Hopson,
Adam Rhinehart & Will’m Harvey and that he the said Daniel Freeman cause

Neil Farmer is appointed overseer of the Road leading from
Ansleys Mill towards Raleigh from Ellibees Creek to the Hillsborough road by
Joseph Dixon’s in the room of F Moreland
with the usual hands and such adjacent hands as are not appointed to work on
any other road and ordered that he the said Neil Farmer cause the said road to
be kept in good repair.
James Pratt is appointed Overseer of the Road from the fork
of the Road near Samuel Thompson’s to Thomas Mortis’s in the room of Samuel
Thompson. Ordered that the following hands work on the road under him, viz: Sam’
Thompson’s one hand, James Ch?? the usual hands.
Ordered further that the hands under Wm Lytle and James
Pratt overseers of the Roads leading to Town by Sam’l Thompsons join in working
on the road from the forks at Sam’l Thompson’s to the River and that the said
James Pratt cause the above mentioned road to be kept in good repair.
Thomas Durham is appointed Overseer of the Road from James
Tinnens to Robert Moore’s in the Room of Henry O’Daniel. Ordered that the

that he the said Robert Hall cause the said Road to be kept in good repair.
Daniel Foust is appointed Overseer of the Road from
Hunnicut’s Hill to the Chatham line in the room of Samuel Freeman dec’d.
Ordered that the usual hands work upon said Road under him and that the said
Daniel Foust cause the said road to be kept in good repair.
John Umstead is appointed overseer of the Road from the
Tanyard to the middle of the River at Mrs Benton’s Mill. Ordered that the usual
hands & the adjacent hands that are not appointed to work on any other road
work upon the road under him & that the said Jno Umstead cause the said
Road to be kept in good repair.
Sam’l Benton is appointed Overseer of the Road from the Town
of Hillsboro to the middle of the River at Mrs Benton’s Mill. Ordered that the
usual hands & those adjacent who are not appointed to work on any other
road work under him and that he the said S Benton cause the said road to be
kept in good repair.

Sam’l Ector is appointed Overseer of the Road from Stony
Creek to Quaker Creek in the Room of Philip Walker. Ordered that the usual
Hands and those adjacent who are not appointed to work on any other roads work
under him and that he the said Sam’l Ector cause the same to be kept in good
repair.
John Fitch is appointed overseer of the Road from Buckhorn’s
to the Caswell line in the Room of John Dawby[?]. Ordered that the usual hands
work under him and that he the said John Fitch cause the said road to be kept
in good repair.
Thomas Cook is appointed Overseer of the Road from the County
line to the old muster ground near James Wilson’s in the room of John Barbee.
Ordered that the usual hands work under him and that the sd Thomas Cook cause
the said road to be kept in good repair.
Daniel Carleton is appointed Overseer of the Road from the
Cross Road at William Cain’s Quarter to Charles Trice’s plantation. Ordered
that the following hands work under him, viz: Thomas Trice, Edward Trice,
Robert Campbell, Samuel Daniel, Wm Sheppard, James Sheppard, Leonard Carlton,
Jno Leigh, Jack Bingum ??? Robert, Thomas Daniel, Daniel Carlton and that he

Stephen Thompson is appointed Overseer of the Road from the
Town of Hillsboro to Col Sheppards Lane in room of Jno McKea. Ordered that the
usual hands work under him & that he the said Stephen Thompson cause the sd
Road to be kept in good repair.

John Nichols is appointed Overseer of the Road from the
South fork of Little River to the fork of the Road within two miles of
Hillsborough in the room of James Clark. Ordered that the usual hands work upon
the said road under him and that the said John Nichols cause the said road to
be kept in good repair.
John Warren is appointed overseer of the road from Foresters
Creek to Hillsboro in the Room of James Miller. Ordered that the following
hands work upon sd Road under him, vis: James Miller’s hands, Joseph Shaw’s
hands, Hortons [sic], Geo Ray, Rob’t Stuart, Jno Torrentine, Jno Jameson, James
Comb, John Comb, Sam’l Cloud, Rich’d Thompson & John Warren and that the
said Jno Warren cause the said road to be kept in good repair.
David Ray is appointed overseer of the road from the South
fork of Little River to Foristers Creek. Ordered that the following hands work
upon said road under, viz: Robert Ray, John Ray & David Ray’s hands and
that the sd David Ray cause the said road to be kept in good repair.
Wm Duke is appointed overseer of the road from John
Carrington’s to the Granville Line in the room of Jno Wilburn. Ordered that the
said Wm Duke Cause the said road to be kept in good repair by the labours of
the usual hands.

John Knight is appointed Overseer of the Road from Flat
River to the East prong of Little River at James Watson’s in the Room of Thomas
Horton. Ordered that the usual hands work on the said road under him & he
the said John Knight cause the sd road to be kept in good repair.
Henry Nail is appointed Overseer of the Road from
Hillsboro to Branton’s old place in the Room of James Faucet. Ordered that the
usual hands work upon sd Road under him & that the sd Henry Nail cause the
sd Road to be kept in good Repair.
John Foust is appointed Overseer of the Road from Collins’s
to Quaker Creek in the room of Jno Thompson. Ordered that the usual hands work
under him & that he the said Jno Foust cause the same to be kept in good
repair.
John Piper Sr is appointed Overseer of the Road from Wm Ansley’s
Mill in the Room of Jno Piper Jr. Ordered that the usual hands work in said
road under him & he the sd Jno Piper Sr cause the sd road to be kept in
good repair.
David Rainey is appointed Overseer of the Road from David
Mebane’s to Rob’t Dunkins. Ordered that the usual hands work upon said Road

hands work under him, viz: Jose Barbee, Mann Paterson, Jno Barbee, Wilie

Self and that the said Joseph Barbee cause the said Road to be kept in good

Anderson Stroud is appointed overseer of the road from
Frederick Loyds to Chatham County line in the room of Licias Durham, Ordered

North fork of little River to the South fork in the Room of Jno Thompson.

Benjamin Forresters to Enoe River at Wm Cabes in the Room of Tho Latta Jr.
Ordered that the adjacent hands work on said road under him and that the said
Tho Laycock cause the said road to be kept in good repair.
Daniel Baldridge is appointed overseer of the road from
Person County line to the nine mile post in the Room of Wm Shannan. Ordered
that the following hands work under him, viz: Jno McCanlis, John McCulloch,
James McCulloch, Robert Baldridge, Wm Shannan, John Porterfield, Robert Clark,
William Baldridge and that he the said Daniel Baldrige cause the said road to
be kept in good repair.
John Armstrong is appointed overseer of the Road from the
Mile post to the end of James Clark’s land. Ordered that the following hands
work under him, viz: James Baldridge, Joseph Armstrong, Thomas Armstrong, James
Armstrong, George Ray and Thomas Jorden and that the said John Armstrong cause
the said Road to be kept in good repair.

Andrew McBroom is appointed Overseer of the road leading
from Hillsboro to Caswell old Court House from James Clarks creek to the County
line in the room of John Johns. Ordered that the usual hands work under him and
that the sd Andrew McBroom cause the said road to be kept in good repair.
Allen Sykes is appointed Overseer of the road from Mount
Willing to Taps pond in the room of Nathaniel McLemore. Ordered that the usual
hands work under him & he the said Allen Sykes cause the said road to be
kept in good repair.
William Crabtree is appointed Overseer of the Road from the
Widow Borlands Creek rot the first fork leading off from Cates’s Creek in the
Room of Alexander Borland. Ordered that the following hands work under him,
viz: Joseph Moore, Thomas Crabtree, Samuel Crabtree, Abraham Crabtree,
Alexander Borland, Jacob Moulder, William Cooke, Thomas Scarlet.
Henry Younger is appointed Overseer of the road from Mr
Sloss’s road to Troling[er]s road. Ordered that the following hands work under
him, viz: Henry Younger, James Riple, John Lain, Hardy Hurdle, John Sloss,
Alexander Robs, Stephen ???, Jonathan Jordan’s hands, William Dickey, William
????, William Osborn, Martin Hurdle, Lewis Disheng [Dishon],

Jacob Morton, Joseph Younger & Adam Marley and that he
the said Henry Younger cause the said road to be kept in good repair.
William Horn is appointed overseer of the road from Raineys
Spring Branch Gilbert Strayhorns to Raineys Branch. Ordered that the
following hands work under him, viz: William Horn, James Strayhorn two hands,
James Nelson two hands, Thomas Nelson, Charles Carrol two hands and that he the
said William Horn cause the said road to be kept in good repair.
William White is appointed Overseer of the road from
Rainey’s Branch to William Rhodes’s. Ordered that the following hands work
under him, viz: William White, David Rainey, James Rainey, Joseph White, Joshua
Horn, Edward Horn, William Rhodes Sr two hands, James B Horn two hands &
that he the said William White cause the said road to be kept in good repair.
John Cain is appointed Overseer of the road from Murphey’s
branch to William Cain’s Mill road. Ordered that his own hands work upon the
road abovementioned at his store & plantation on Little river, Thos Dosset,
Joseph Armstrong, David Watson, Henry Hunt & hands, Barney

Cates & his hand & that he the said John Cain cause the said road to be

William Cain is appointed Overseer of the road from his Mill
road to the Chapel [St. Mary’s Chapel]. Ordered that the following hands work
under him, viz: George Carrington & his hands, Charles Sh???? & William
Dunnagin’s Sr & Jr with their respective hands, James Dunnagan, Levi Cole,
James Full?? & William Warren with their hands, William Cain’s own hands,
John Cain’s hands at his home plantation, Henry Bunch & Stephen Carrel
& their hands, William Clark & hands, John Kelly & hands.
James Hogg or in his absence Capt Lytle is appointed
Overseer of the road from the middle of Enoe at S Thompsons to the Camp Spring
or Conner’s Spring. Ordered that James Hogg’s hands, Capt Lytle’s & Samuel
Thompson’s hands work upon said Road and that the said James Hogg or Capt Lytle
cause the said road to be kept in good repair.
David Strayhorn is appointed overseer of the road from
Conner’s Spring to the fork of the road before William Cain’s in the room of
Capt Lytle. Ordered that the usual hands & all adjacent hands that are not
ordered to work on any other road work under & that the said David
Strayhorn cause the said road to be kept in good repair.

William Laws is appointed Overseer of the road from
Granville Line (on the Petersburg road) to Flat river. Ordered that the
following hands work under him, viz: George Laws Sr & his hands, George
Laws Jr & hands, David, Jacob & Richard Umstead with their respective
hands, William, James & John Pettigrew, Reuben Baxter, Peyton Maddison,
William, John, Abner & Jeremiah Roberts with their respective hands &
Jesse Cozart & that he the said William Laws cause the said road to be kept
in good repair.
Richard Bennehan is appointed Overseer of the road from Flat
River to Little river on the Petersburg road. Ordered that all his own hands at
his different plantations work on said road and that he the said Richard
Bennehan cause the said road to be kept in good repair. Ordered further that in
case the freshet should injure said road in the low grounds of either river, it
shall be the duty of said Richard Bennehan & William Laws [to] unite their
hands and cause the same to be kept in good repair.
Walter Alves is appointed Overseer of the road from Little
river to the end of the new road at Murphy’s Branch. Ordered that the following
hand work under him:

viz: Walter Alves’s own hands at both his plantations, Hugh
& Allen Cain & their hands, William Leathers’ Sons John William &
Fielding with his negro Lewis also John Watson & his Son and that the said
Walter Alves cause the said road to be kept in good repair.
John Woods (Sheriff) is appointed Overseer of the road from
the Chapel [St. Mary’s Chapel] to William Jackson’s. Ordered that the following
hands work under him, vis: John Woods’s own hands, William Clenny, James Cain,
James Latta Jr and their hands, John Latta Sr’s hands, William Lewis, John
Duglas’ hands, Thomas Horne Jr, John & Thomas Holden & hands, Isaac
Holden & hands, James Dougherty, William Faucett, Douglas & David
Copeland & their hands, William Woods, Sherwood Allen, William Whithead
& hands, William Jackson & hands & he the said John Woods cause the
said road to be kept in good repair.
Henry Nail is appointed Overseer of the road from William
Jackson’s to Hillsborough. Ordered that the following hands work under him,
viz: Henry Nail, Samuel Carson, William Picket & hands, John Estis’s hands,
Thomas Barton’s hands, Eli Hill & hands, William Courtney’s hands &
that he the said Henry Nail cause the said road to be kept in good repair.

Edward Harris is appointed Overseer of the road from the
Wake Line near John Alston’s to Richard Bennehan’s store on the new road
crossing at Kennon’s Mill. Ordered that the following hands work under him,
viz: John Alston’s, John Pryor Smith’s, Charles Kennon’s, Richardmond
Harris’s, Edward Harris’s, Elias Farmer’s, Benjamin Jones & Sons & that
he the said Edward Harris cause the said road to be kept in good repair.
James Walker is appointed overseer of the road from Richard
Bennehan’s Store to James Walker’s branch. Ordered that the following hands
work under him, viz: Robert Ashely & Sarah Horton’s hands, Anthony Rickets,
Francis Rickets, Robert Duke, Hardiman Duke, Tyree Duke, Taylor Duke, Samuel
Vaughan, Thomas King, Robert Harris, Nathaniel Harris, John King, Thomas
McFarlane, Henry Horton, Cuthbert Burton, William Montgomery, Lazarus Tilly,
John Tilly Jr, Archer Harris, James Walkers hands on both sides of the river,
Thomas Hunt’s hands, Thomas Horner’s, George Horner’s, Joseph Ellis’s hands,
Leonard Waggoner’s, Mark Harris, James Horner and that he the said James Walker
cause the said road to be kept in good repair.

Thomas Parish is appointed Overseer of the road from James
Walker’s branch to Ansley’s road. Ordered that the following hands work under
him, viz: John Gerard, Jacob Gerard, Thomas Parish, Allen Parish, William
McFarlane, Hubert Sims hands, James Carrington’s Sr hands, Anselm Parish’s
hands & William Carrington & that he the said Thomas Parish cause the
said road to be kept in good repair.
Ordered that the Several Overseers of roads in this County
shall have power to summon such hands to work as are living adjacent to their
several roads & not particularly ordered or accustomed to work on any other
road so that they be not compelled to work more than twelve days in a year.
