The above being a majority of the Justices of Orange County, they proceeded to Elect a Treasurer of Public buildings, when Sterling Harris Esqr was unanimously Elected and offers for his Securities [blank] who are approved of by the Court.

The Execution of a Deed from Benjamin Rhodes to John Shepperd was duly proved in open court by the oath of John Edwards a Subscribing Witness thereto & ordered to be registered. [See ODB 7/433.]

The Execution of the last Will & Testament of David Carson Deceased was duly proved in open Court by the Oath of Robert Carson a Subscribing Witness thereto & ordered to be recorded. At the same time the Ex’r qualified. [See OWB C/127.]

On Motion of Wm Duffy Esqr Atto &c, ordered that an Execution issued from the Clerk’s Office of this Court returnable to the present Term in the name of Wm Guess agt John Sneed be set aside & the property which was sold under the said Execution be restored by the Sheriff to the said John Sneed, It being the opinion of the Court that the said Execution issued irregularly.

Wm Rainey returns the List of Taxables by him taken in the Dist of St Asaphs for the year 1799.

Sherwood Dunnagin is fined 20. For not answering at the call of the Sheriff.

On the Petition or Robert Dickens & William ????? to correct an Error in the Certificate of the Surveyor mentioned in the petition, and also an Error in the said Pattent, that the said Error be certified to the Secretary by the Clerk of this Court according to the Act of the Gen’l Assembly, that the Course 43 chains East be made West 43 chains in the 2nd Course from the Beginning in the said Grant & Pattent.

James Carson vs Wm Shepperd} Case, Gen’l issue, Stat Lim, Payment, set off, Satisfaction. Jury charged &c, to wit: Absalom Holt, John Stroud, Charles King, John Piper, John Whitesides, James Horton, John Comb, Lewis Rhodes, Wm Forsyth, Robert Wilson, Wm Philips, Christopher Barbee. Find the Def’t did assume & within 3 years that there is no payment, set off or Satisfaction & Assess the Plff’s Damages to £44.10.3.

John Dunnaven vs Wm Butler} Guarnishment. Same Jury as in No 5 charged &c. Find that the Defendant has in his hand £50 of the property of James McMurtry which is condemned to the use of the Plff in his Suit agt James McMurtry.

8. Andrew McCulley vs Robert Wilson} Case, Gen’l issue. Jury charged &c, (to wit): Jno Stroud, Charles King, John Piper, James Horton, Levin Rhodes, Wm Forsyth, Wm Philips, Christopher Barbee, Lewellin L Wall, Wallis Herndon, Jno Whitesides, Sherwood Dunnagin. Find the Def’t did assume & assess the Plffs Damages to £5 & Costs.

The Sheriff returns that the Jury whom he summoned in obedience to an Order of the last Term to view the two roads in dispute between Henry Mason and Joseph Hambleton, met in the premises and unanimously agreed that the road passing by the said Joseph Hambletons should be kept open and work’d.

Administration of the Estate of William Augustus Richards is granted to August Benton as the greatest creditor, he entering into with bond Benjamin Yeargan & Mathew McCauley in the sum of five hundred pounds. [See also personal property to be sold OCPQS 5/527 & OCPQS 5/565, accounting OCPQS 5/650.]

Matthew Patton is appointed Guardian to his Brother Samuel Patton, he entering into Bond & security with Thomas Whitted & David Raney in the Sum of Three hundred pounds.

Administration the Estate John Nelson Deceased is granted to Joseph Clendenen & Eli McDaniel they entering into Bond with Jno Ray & Rob’t Patton in the Sum of five hundred pounds. [Apparently this was superseded by OCPQS 5/494.]

Order by the Court that Jacob Deblin son of Jacob Deblin Deceased be bound to John Chapman to ??????????? until he arrive to the age of twenty one years to learn the art & mistery of a Taylor. [See Apprentice Bonds, image 316. See also accounting OCPQS 5/304, guardianship OCPQS 4/406.]

[OCPQS 5/527 - Feb 1799]

Administration of the Estate of William Stanford is granted to Samuel Couch who offers Thomas Couch his Security in the Sum of Two hundred & fifty pounds, at the same time the Widow came into Court & relinquished her right of Administration to the said Samuel Couch. [See also guardianship OCPQS 5/631.]

John Scott, Wm Forsyth & Samuel Hayes appointed a Patrole for the village & neighborhood of the University.

On motion of Wm Norwood Esq Atto &c, Ordered that Augustus Benton Admr of the estate of Wm Richards Dec’d sell by the Sheriff the personal Estate of the said Dec’d and make return to next Court. [See also administration OCPQS 5/526, personal property to be sold OCPQS 5/565, accounting OCPQS 5/650.]

Simon Williams is appointed Guardian to Allison Williams who is under age for the purpose of Answering a Petition filed in exhibited to this Court by the nam Joseph Courtny & others for the Partition of Lands of the Estate of the late William Courtny Dec’d. Joseph Ray is appointed Overseer of the road from James Clark’s Creek to the forks of the road beyond William Clark’s with the usual hands.

John Bragg is appointed Overseer of the road in the room of Charles Trice from Charles Trices to Chatham Line with the usual hands.

Sherwood Allen is appointed Overseer of the road in the room of Thomas Holden from the Chappel [St. Mary’s Chapel] to Wm Jacksons with the usual hands.

Joseph Hastings is appointed Overseer of the road from Andrew Collins’s at the valley above his fence to Rockey Creek or the place to which he formerly worked with the usual hands and all convenient hands not appointed to work on other roads, together with the hands of Thomas Baker.

George Foust is appointed Overseer of the road from Rays ford on the Allamance to Whitteds Creek with the usual hands.

David Mebane is appointed Overseer of the road from his own house to Mont Willing with the following hands: Samuel Kirkpatrick, Lewis Jones, John Cheek, James Nelson, George Johnston, Jonathan Jones, Matthew ?????, Thomas Jones, Aquilla Jones Sr, Aquilla Jones Jr, John Williams, Charles Carroll, James Gilstrat, Brown Mebane, Samuel Shaw & John Nelson.

In consequence of a Petition of a number of the Inhabitants of this County exhibited to this Court & filed, the opening of a New Road from John McRory’s to Caswell County Line to join the road leading from said Line to Paine’s Ordinary, It is ordered that the Sheriff Summon the following persons to mark off & lay out the same: James Mebane Jr, James Hutcheson, Jesse Fulton, ???? Ordered that the following persons lay off & mark out a road the nearest & best way from Franklin Street in the Village of the University into the old Raleigh road, viz: Matthew McCauley, William Nunn, David Craig, Sam’l Hopkins, Lambert Robinson, Bennet Watson, John Daniel, Benjamin Yeargan, Joseph Caldwell, Samuel Holmes, James Craig & Edward Jones & make return to next Court.

Joseph Courtney & others vs Allison Williams & Wife} Petition. This cause coming on to be heard on the Petition & answer, it is ordered by the Court that Absalom Tatom, William Kirkland, David Ray, Catlet Campbell & James Philips be & they are hereby appointed Commissioners to partition & divide into four equal parts as near as may be as to Value of the said several Tracts of Land in the petition mentioned with the Value in Money of the difference between the several Allottments shall pay to or receive from another for the difference in Value, whether that difference arise from the nature of the Soil or from the Intervention of the Widow’s Dower or from both or any other Cause and a plat or plats of such Division to make according to Law, which together with a report of their proceedings they are hereby required to return to this Court on the fourth Monday of May next. Allison Williams & Wife by Simon Williams Jr Guard &c vs Joseph Courtney & others} Petition. This cause coming on to be heard on Petition & answer, it is ordered by the Court that the Sheriff of Orange County to summon a Jury of good & lawful Men to attend on the premises specified & lay off the Dower of the Petitioner Martha according Law and thereof put the petitioners into possession that is to say one equal third part of the Tract of 440 Acres and also one equal third part of the several other Tracts mentioned in the petition & return the Verdict of a Jury & his proceedings thereon to this Court on the 4th Monday of May next.

John Scarlett is appointed Overseer of the road in the room of Tho Lacock near Ben Forristers to Eno River with the adjacent hands.

James Ray is appointed Overseer of the road in the room of John Warren from Forresters Creek to Hillsborough.

Wm Bowles is appointed Overseer of the road in the room of Wm Fitch from the North fork of Little River to the South fork with the usual hands.

David Raney is appointed Overseer of the road in the room of Thomas Nelson from Gilbert Strayhorns to Raineys Branch with the usual hands.

William F Strudwick is appointed Overseer of the Road from David Mebanes to Robert Duncans with the usual hands.

Alexander Pickard is appointed Overseer of the road from Ball’s Creek to Mont Willing in the room of Henry Pickard with the adjacent hands.

Zachariah Dickey is appointed Overseer of the road from Person County Line to Clarks Creek with the usual hands in the room of Andrew McBroom.

Absalom Tatom is appointed Overseer of the Road leading to Woody’s Ferry from Hillsborough in the room of John Faddis, Beginning at the fork of the roads at Samuel Thompson’s & from thence to Andrew Colling’s to the Valley above the house with his own hands, Henry Hasting’s hands, William Hastings, D?? Collins, Alfred Moore, Frederick Taylor, James Pratt, John? Barton, George Pratt, Samuel Thompson and the convenient hands not appointed to work on other roads, together with the assistance of all the hands appointed to work from Samuel Thompson to Baker’s old place on Hogans road from Thompson’s to the fork leading to Woody’s Ferry and the Overseers of either road shall when necessary call upon the Overseer of the other to meet at Thompsons for the purposed of working on that part to the fork.

John Mitchel is appointed Overseer of the road from Samuel Thompson’s to Baker’s old place in the room of James Roney? With the following hands, to wit: William McCauley, Felty? Craig, Johnston Craig, James Craig Sr, James Craig Jr, Joseph Mallett, James Mitchel, John Mitchel, George Long, Richard Fossett, James McDade & his Brother, Archibald Nelson, Thomas Pittman & James Kerr & all other convenient hands not appointed to work on other roads together with the Assistance of all the hands appointed to work from Samuel Thompson’s to Andrew Collins’s, viz, from Thompsons to the fork that Leads to Woody’s ferry and the Overseer of either road when necessary call upon the Overseer of the other to meet at Thompson’s with his hands for the purpose of working from Thompsons to the Fork.

Ordered that John Wheeler be appointed Guardian to Charity Wells who enters into Bond with Nathan Wells his Security in the Sum of Two hundred & fifty pounds.

Ordered that Nathan Wells & Joseph Wells Admrs of the Estate of Jesse Wells Dec’d be allowed £3 as Commission for their trouble in the Management of sd Estate. [See also administration OCPQS 4/611, guardianship OCPQS 6/577.]
