State of North Carolina, At a County Court of Pleas & Quarter Sessions begun & held for Orange County at the Court house in Hillsboro on the 4th Monday in February AD 1803 in the year of Independence 27th. Benj’n Williams Gov &c vs Hugh Lovins & others} Jury charged, to wit: Isaac Holden, Eli Lindsey, James Strayhorn, Thomas Armstrong, Morgan Hart, James Dixon, William Hogan, William Durham, James Doherty, Richard Freeman, Mark Durham, William Hobson. Find that the Defendant Bond declared on is the Act & Deed of the Def’ts, that there is no matter of excuse that the Defendants were not prevented by indisposition & that James Moore the person interested has sustained Damages by the breach of the Condition of the said bond to the Amount of £12.2.10 ¾ & Costs.

Thomas Copley is fined 10/ peremptorily for swearing in open court and ordered unto custody until the fine is paid.

Thomas Copley appearing in the Court house drunk and repeatedly swearing in the presence & hearing of the Court, It is Ordered that the said Thomas Copley be fined in the Sum of Ten Shillings and that he be taken into Custody by the Sheriff & by him detained until the said fine be paid. Hugh Snelling vs John Lankston} Debt, Genl issue payt set off. Find that the Defendant did not assume, his set off being larger than the Plaintiff’s Damages Demand.

James H Bowman vs Charles Cotton} Jury charged: Isaac Holden, Eli Lindsy, James Strayhorn, Thomas Armstrong, Morgan Hart, James Dixon, Wm Wilson, Johnston Craig, Thomas Cate, John Adams, Constant Perkins, James Patterson. Assess the plaintiffs Damages to £179.7/7 & Costs.

Bruce & McKerall vs Augustine Dishon Jr} Same jury as in No 33 charged. Assess the Plff’s Damages to £2.10.9 & Costs.

Walter Alves, Catlet Campbell, Joseph Moore, Joseph Clendening & Zachariah Herndon esqrs appeared & took the several Oaths necessary for the qualification of Justices of the Peace.

Ordered that a Commission issue to take the deposition of Nat Christmas to prove the Execution of a Deed from John Trousdale to the Trustees of the University. [See OCPQS 6/223 & OCPQS 6/304. This deed eventually recorded at ODB 11/142.]

The Execution of the last Will & Testament of Absalom Tatom Dec’d was duly proved in open Court by the Oath of Wm Norwood a Subscribing Witness thereto & Ordered to be recorded. [See OWB D/94.]

The Execution of a Deed from Abraham Swagerty to John Fairman was duly proved in open Court by the Oath of Joseph Dixon a Subscribing Witness thereto and ordered to be registered. [RESEARCH]

The Execution of a Deed from John Fairman to Thomas O'Hara was duly proved in open Court by the Oath of John Casey a Subscribing Witness thereto & ordered to be registered. [See similar document at OWB B/288.]

Wednesday Morning 2nd March 1803, Court met according to adjournment. Present: Sterling Harris, Joseph Clendening, Sam’l Benton} esqrs.

John & Solo[mon] Morgan} Petition for division of Land. Ordered that Pleasant Henderson, Augustus Benton & John Daniel three of the Commissioners appointed to divide the Lands between the petitioners be allowed the Sun of £0.15/ p day during their attendance on the Division. Ordered that John Daniel be allowed 20/ pr day for his Services as Commissioner & Surveyor on the division of the Lands mentioned in the petition. [RESEARCH]

[OCPQS 6/384 - Feb 1803]

Thursday Morning 30th March 1803, Court met according to Adjournment. Present: James Carson, Sam Benton, Catlet Campbell, Walter Alves} esqrs.

Administration of the Estate of Joseph Green Dec’d is granted to Jacob Green who enters into bond with John Casey his Security in the Sum of £500.

Susannah Bird of lawful age comes into Court and makes choice of William Bird her Guardian who enters into Bond with William Whitted & Richard Bird his Sec’s in the Sum of £500. [See also administration OCPQS 6/272, widow's share OCPQS 6/273, guardianship OCPQS 6/385.]

It appearing to the Court that the age of Nathan Hargiss who was ordered by the Court at the last Term [OCPQS 6/358] to be bound to John Breeze was misrepresented to the Court and that the said Nathan Hargis is of the age of 18 years on the 20th January last, Ordered that the Clerk make out his Indenture accordingly. [See Apprentice Bonds, image 445.]

[OCPQS 6/385 - Feb 1803]

Jehu Bird of lawful age comes into court and chooses Mary Bird (his Mother) Guardian who enters into bond with Jehu Whitted Sec’y who enters into Bond in the Sum of £500.

Mary Bird is appointed Guardian to Frances Bird and Infant of Empson Bird dec’d & enters into Bond with Jehu Whitted Sec’y in the Sum of £500. [See also administration OCPQS 6/272, widow's share OCPQS 6/273, guardianship OCPQS 6/364.]

Administration with the Will annexed of the Estate of James McMunn [no such will found in OWB] is granted to Robert Smith who enters into Bond with Jacob Huggins and [blank] his Sec’s in the Sum of £500. The Widow of the said James McMunn being in Court & consenting that the said Robert Smith be appointed Administrator.

Thomas Woods is excused for his non attendance as a Juror at this Term for reasons shewn the Court on Oath.

George Carrington is appointed Guardian to James Carrington Orphan of James Carrington Orphan of James Carrington Dec’d who enters into bond with Isaac Holden & Elihu Woods his Sec’s in the Sum of £1000. [See also administration OCPQS 6/233, caveat OCPQS 6/225, perishable property to be sold OCPQS 6/255.]

Administration on the Estate of Wm Cate Decd is granted to Elizabeth Cate his Widow who enters into bond with John Cate & James Turrentine his Sec’s in the Sum of £250. [See also accounting OCPQS 6/417.]

Ordered that the Administratrix of Wm Cate Dec’d have leave to sell the perishable Estate of Wm Cate Dec’d.

Ordered that Sarah Manning be appointed Guardian of Cynthia Manning Orphan of Charles Manning Dec’d & enters into Bond with Joseph Brittain & George Carrington his Sec’s in the Sum of £200. [See also administration & widow's share OCPQS 6/193, guardianship OCPQS 6/387.]

Ordered that William Merritt be allowed the Sum of Sixty pounds for building a Bridge over Newhope Creek at the place where the road leading from the University to the City of Raleigh crosses the same and that the County Trustee pay the Same.

David Ray & Jesse Rice are appointed Auditors to examine the Account of Jane Riggs & John Ray Administrators of the Estate of William Jameson Dec’d and also to examine & settle the the [sic] Account of Samuel Riggs & Jane Riggs Guardians of the Orphans of William Jameson Dec’d and report to next Court.
