It appearing to the Court that James Underhill has died Intestate, that no person claims to right of Adm’n on his Estate, It is therefore Ordered that James Davis be appointed Administrator ad Collegendum of the Estate of said dec’d.

Daniel Cloud & Wife vs Levi Whithed Admr} The Court adjudges & decrees that the Defendant pay to the Plaintiff Daniel Cloud & wife the Sum of £44.5.4 & that the Plaintiff pay all the Costs of Suit. And it is further adjudged & decreed that the other Plaintiffs have been fully paid & Satisfied, appeal prayed.

Ordered that a Tax of one Shilling & three pence be levied & collected for the payment of County Contingencies. Ordered that a Tax of Nine pence on each poll, nine pence on each £100 Value of Town property & nine pence on each three hundred Acres of Land be levied & collected from the payment of County Jurors.

Ordered that a Tax of Six pence on each poll, six pence on each £100 Value of Town property & six pence on each three hundred Acres of Land [be levied & collected] for the payment of repairs [to] our public Buildings.

Ordered that the County Trustee pay to William Merritt the Sum of Twenty one pounds five Shillings for Building a Bridge across Bens Creek & supporting Said Bridge for seven years out of any money public money now in his hands. [See Dunaway's Bridge Records, page 21.]

Ordered that the County Trustee pay to Rosannah Sears the Sum of Seventeen pounds Ten Shillings that Sum being the damages sustained by her on Account of a new road passing through her plantation as assessed by a Jury.

Ordered that the County trustee pay to Henry Sears the Sum of fifteen pounds it being the damages sustained by him on Account of a new road passing through his plantation as assessed by a Jury.

Ordered that a Tax of One Shilling on each black poll (except those living in the Town of Hillsboro} be levied and Collected for the payment of patrolls.

Mark Barbee is appointed Guardian to William Barbee an Infant under the Age of twenty one years & enters into Bond with Christopher Barbee his Sec’y in the Sum of £100.

On the petition of Mark Barbee & Wm Barbee by his Guardian, It is Ordered that Mann Patterson, Chesley P Patterson, John Moore, George Johnston & Reuben Boroughs be appointed Commissioners together with Hugh Mulhollan Surveyor to divide the Lands lying in this County devised by John Barbee Dec’d to his Sons Mark, Young & William & to report their proceeding to next Court.

Administration on the Estate of Sarah Turner is granted to James McCallon who enters into Bond with Robert Murdock & Henry Trolinger his Securities in the Sum of £200.

Leonard Carlton former Guardian of Wright House, Lewis House, John House & Salley House Children of Peter House comes into Court and resigned his Guardianship. Whereupon Ezekiel Trice is appointed Guardian to said Wright House, Lewis House, John House & Salley House.

Ordered that Leonard Carlton Guardian of Wright House, Lewis House, John House & Salley House Children of Peter House have until next Term to settle his Account of his Guardianship.

Ordered that William Barbee have leave to stop the old road leading through his plantation, the new road being now open.

Ordered that Leonard Carlton who [was] Guardian of Elizabeth and Polley Shaw House & who is now Guardian of Wright House, Lewis House, John House & Salley House Sell at Public Sale at Nine Months credit two Negroes Eliza & Jane the property of said Six children for the purpose of making a Division of said property among them.

Rebecca McCaddams Widow of James McCaddams Dec’d comes into Court and dissents to her husbands Will. [See OWB D/187.]

James McCaddams came into Court & qualified as Executor to the last Will & Testament of James McCaddams Dec’d heretofore proved in this Court.

Ordered that unless Henry Goodloe the Undertaker & Builder of the Bridge across Eno River near the Town of Hillsboro put the same in good repair on or before the first day of April next that Suit be commenced on his bond against him.
