James Burrows, Sam’l McCrackin, James Heart, Rich’d Cochran, John Strain, James Stockard, Isaac Holden, Thomas Cole, Jerry Holt & George Madden are fined nisi for not attending as Jurors at the Sheriffs call.

On motion of Elizabeth Morgan wife of John Morgan by William Duffy her Attorney, Ordered that a Writ De Lunatus Inquirendo be issued to the Sheriff of Orange County for the purpose of Inquiring by the Inquest of a Jury according to the Acts &c of the Lunacy of the said John Morgan of said County that this inquest on return of the said Writ may do what of right ought to be done in the premises &c.

Writ Writ and Verdict of the Inquest of the above order returned this Term, return Quashed because a term had not intervened between he issuing and the return of the Writ. Ordered that a Writ as above issue returnable to the next term.

Joseph Armstrong is appointed Constable in Hillsborough District.

Thomas Whithead is appointed Constable for St Asaphs District, offers Wm Steele & John Thompson Securities who were approved by the court.

Samuel Hill is appointed Constable in the Town of Hillsborough & offers Sterling Harris & Eli Hill who were approved of by the Court.

Ordered that William Lytle, Sterling Harris & Absalom Tatom esquires or any two of them and they are hereby appointed to examine the present Sate of the Entry takes Books of the county and report at next Term what part of such Books are necessary to be transcribed in order to their preservation that they as same time report what in their Opinion will be the expence or value of the work by them determined necessary in this regard. Ordered that the entry taker be and he is hereby required to bring to the Town of Hillsborough the Books of his office now in his possession at such time as he may be thereto required by order under the hands of said three commissioners or any two of them.

Ordered that John Fairman who is the reputed father of a base born Child begotten on the body of Polly McDade pay to the said Polly McDade four pounds annually for five years for the support and maintainance of said Child. [See Bastardy Bonds, images 641 & 643.]

Samuel Benton is appointed Deputy Clerk to Abner Benton Bruce Clerk of Orange county court at same time Qualified in open Court.

Thomas McCulloh is appointed overseer of the road from Caswell line to John Slosses.

Jacob Garrison is appointed Overseer of the road from the fork of the road near the meeting house to where it enters on the Caswell road near John Slosses.

Ordered that an Order made [blank] Term for oppening a road from John Carringtons to wake county line the nearest and best way towards Raileigh, Ordered that that order be renewed and that the Sheriff Summons a Jury to lay off the same.

John Johns is appointed overseer of the road leading from Hillsborough to Caswell old court house from James Clarks creek to the county line.

James Mebane is appointed Overseer of the road from David Mebanes to Mary Slones branch.

Sampson Woods is appointed overseer of the road from Benjamin Forrists to Johnstons old Store, ordered that the following hands work on the same and keep said road in good repair as the Law directs [blank]

The Execution of a Power of Attorney from William Mebane to James W Lackey & John Lackey was duly proved in open court by acknowledgment of William Mebane and ordered to be Recorded. [Not found in ODB or OWB.]

Ordered that a girl Child called & known by the name of Charlotte Ray aged 7 years old the 29th day of August last be bound to Isaac Link [or Isaac Lint?]. [See Apprentice Bonds, image 226 where Robert Ray consent to Charlotte being bound & 227 which calls her Charlotte James.]

Thomas Cole & James Mebane are excused from any further service as Jurors this court.

A major[it]y of Justices present, Ordered that a tax of two shillings one very 300 acres of Land and two shillings on each Taxable 100£ of taxable property property in the Town of Hillsborough be laid, collected and accounted and ?????ed for for the year 1794 and be applied to defraying the contingent charges of the county and also the Sum of two shillings on each taxable Poll &c.

Ordered that the Sheriff of the County for the year 1793 be allowed the Sum of thirty pounds for ex officio services for that year. Ordered that the county treasurer pay the same.

Ordered that the Clerk of the county be allowed the Sum of twenty pounds for extra official services for the year 1793. Ordered also that the Clerk be allowed the Sum of Ten pounds for making out Lists of Taxable property for the year 1793. Ordered that the county Treasurer pay the same.

On motion of Martha Patty Williams by Samuel Benton her attorney for an Habeas Corpus to issue to Thomas Nelson the reputed father of a child which the Martha said Patty was some time ago delivered of which said Child the said Thomas has lately forceably taken, and yet detains from the said Patty which she by her sd Atto saith he is as is suggested not warranted by the Law of this State to do, Ordered therefore that the said Thomas Nelson do bring into this court immediately the said child of Patty Williams which he hath so taken & detains that the cause of her his detention of the said child by this court may be enquired into and right done therein and that the Sheriff notify the said Thomas Nelson of this Order immediately and make return to this court. An affidavit of John Dugger, Ordered that he be released from paying a poll tax for the year 1793 and that John Sloss Sheriff be allowed the same as Insolvent &c.

William Hall come into open Court and qualified as Deputy Sheriff under Joseph Hodge esquire &c.

Joseph Hodge Esquire Sheriff appoints William Hall his deputy who is approved of by the Court. William Hall Deputy Sheriff comes into Court and took the oaths necessary for his qualification.

Pursuant to an Order Court made this Term for an Habeas Corpus to issue to the Sheriff of Orange to bring into court the Base born child begotten on the Body of Patty Williams by Thomas Nelson and now in possession of the said Thomas, ordered that the said Thomas Nelson deliver up the said child to its mother Patty Williams. Ordered also that the said Thomas Nelson pay the said Patty William five pounds yearly for five years to commence from the birth of said child, and that he the said Thomas enter into Bond with Security to keep the county of Orange indemnified by reason of said Child for the maintainancy and keeping of the said child. State vs Solomon Barlow} Ind’t Pettit Larc’y. Jury Sworn find the Defendant Guilty in manner and form as charge in the Bill of Indictment. Ordered that the Sheriff carry the Defendant to the public whiping post and give him thirty nine Lashes on his bare back.

Hugh McAdams is fined for his non attendance as a Juror at the Sheriffs call. fine remitted.

State vs Stephen Madden Jr} Ind’t Petit Larceny, charged and pleads not Guilty. Jury Sworn find the Defendant Guilty as in manner & form as charged in the Bill of Indictment, reasons in arrest of Judgment filed by the Defendants Atto which is by Order the Court ordered to be argued tomorrow.

Agreeable to the Petition of William Merritt exhibited to this court, Ordered that he have leave to build a public Grist Mill on his own Land on Morgans creek – objected to and to be argued tomorrow. Rescinded on Motion to the court. [See Dunaway’s Mill Records, page 31.]

Samuel Hughes assignee &c vs William & John Ray} Case. Jury impannelled and Sworn. Plaintiff called and non suited. Motion by William Duffy atto to set aside non suit, It is considered by the court that the non suit be set aside and the cause reinstate, then a motion for leave to amend the Declaration by striking out the word Thomas and inserting the word Samuel, It was considered by the court, that the amendment be made agreeable to the Plaintiff’s motion.

The State vs Stephen Madden Jr} Indictment, Petit Larceny, motion in arrest of Judgment, reason in arrest of Judgment over ruled. Ordered that the Defendant Madden receive twenty lashes on his bear back at the public whiping post. In Custody the Sheriff for the fees.

George Horner is appointed Constable in the District of said Maries [sic] tenders as his Security Wm Hall and John Hogg who were approved of by the Court and enter into Bond with Security in the Sum of £[blank].

Joseph Armstrong is appointed Constable in Hillsborough District and offers John Armstrong & Stephen Hart Security which was approved of.

William Andrews is appointed Constable in St Thomas District and enters into Bond [with] Wm McCauley & William Kirk Securities which was approved of by the court.

Reuben Smith is appointed Constable in Caswell District and enters into Bond with James Christmas & James Turner which was approved of by the court.

The Court being informed by some of their members of a Law having passed last Session for classing the Justices in separate and distinct classes for the purposes of Holding the Court of Pleas and quarter Sessions of the county, but the Laws having not come to hand the court new present to observe any inconvenience that may or would arise from not complying with the Law at this Term which is necessary as it to them suggested, do class the whole magistrates of the county into one class.

William Courtney Esquire is appointed Chairman of this Court.

Joseph Hodge Sheriff of Orange County comes and informs that said Court, that the public Jail of the county and district of Hillsborough is not in good and sufficient repair, not sufficiently strong to secure the prisoners that are or may be commited to the same.

Edmund Jones is appointed Overseer of the road from Bolings creek to the road leading from Hillsborough to Abijah Masseys. Ordered that the following hands work on the same: Matthew Colter, James Craig, Leonard Parten, Edward Jones, James Pattison, David Craig, John Pendergrass & the hands of Edmund Jones.

Ordered that the Overseer of the road to the Westward of Haw river at Trollingers ford, and the overseer of the road on the east side of said ford be and they are hereby commanded to work of said ford from the banks of their respective sides of the said river to the center of said river and that each of the said Overseers be furnished with a copy of this Order.
