24. James Coghlin vs Thomas Oneill} Case. Same Jury as in No

On motion of Wm Duffy Esq Atto, ordered that Administration
of the Estate of Wm Watters Dec’d is Granted to James Moore who enters into
Bond with And[rew] Murdock & Wm Duffy Esqrs his Sec’ys in the sum of £2500
for the due administration of the sd Estate & takes the oath of an

Pettiford the Mother of the said boy of Nash County.
The Administration
of Alexander Moore Dec’d is granted Henry Moore who enters into Bond with Wm

Ordered that Elitha a female child daughter of Isbel Gibbs a
Single Woman of the age of two years the second day of Feb’y last be bound to
Francis Dunn to learn the art & mistery of a Spinstress until she arrive to
the age of eighteen years. [See Apprentice Bonds, image 277.]
Frances Dunn has leave to keep a Tavern at his dwelling
house in the Town of Hillsbo & enter into bond with Wm Hall & Nat’l
Christmas his Sec’ys for the discharge of his duty.
Ordered that Sam’l Rose the Son of Sam’l Rose who has been
absent from his family for these two years past, which boy is now fourteen
years of age the fifth day of this present Month be bound to Allen Sykes to
learn the art & mistery of a farmer until he arrive to the age of twenty

The administration of the Estate of George Shereden Dec’d is
granted to Tho King who enters into Bond with James Crawford & George
Sheredin his Sec’ys in the sum of £100 & takes the Oath of an

2. James Mills & Co vs Sam’l Dannel} Trover. Plaintiff
call’d & Non Suit at Feb Term 1797. Motion by the Plaintiff to set the non
Suit a side & rule to shew cause. On argument the Court are Equally divided
in their opinion & on the motion of Wherefore the rule is
discharged, whereupon Wm Norwood Esq Atto for the plaintiff prays an appeal to
the Superior Court, and Enters into Bond with Wm Hall his Sec’y in the sum of
£100 for the faithful pros thereof.

Enters into Bond as above.
James Mebane Jr vs Rob’t Faucit & Jno Taylor Exrs of
James Armstrong Dec’d} Citation to shew cause wherefore Cicero a negroe man
late of the estate of James Armstrong Dec’d should not be sold for the benefit
of the Estate of the sd Dec’d. Cause shewn by Rob’t Fausit & Jno Taylor

that from the acts of the Assembly respecting the liberation
of Slaves in this State and the Will of James Armstrong Dec’d [OWB C/88] the
late master & owner of the sd Negroe man Cicero, that the sd Cicero ought
to be liberated & set free from Bondage, and thereupon the sd John Taylor
& Robert Faucit Exrs as aforesaid filed their petition praying the Court to
liberate & set free the sd Cicero – on hearing whereof and the allegation
of the parties, and the arguments of their Council, The Court do order &
adjudge that the sd Cicero be discharg’d from Slavery and do liberate the sd
Cicero and set him free, and do authorize & licence the sd Cicero to go at
large and enjoy all the liberties or privileges of a free born Negroe, and that
the ??? aforesaid be discharged at the plaintiffs Costs.
Administration of the Estate of Hugh Ray Dec’d is Granted to
John Thompson Esq & Reubin Smith who enters into Bond with Charles
Christmas & Rob’t Faucet their Sec’ys in the sum of £200 for their faithful

Ordered that Jesse Joseph Pettigrew the son of Edi
Pettigrew who is now about the age of Eleven years be bound to Robert Hall to
learn the art & mistery of a Farmer until he arrive to full age. [See

Ordered that Tempe Hargroves daughter of Nancy Hargroves
Single woman now of the age of fou thirteen years of this month be bound
to Eli Harvey to learn the art & mistery of a Spinstress. [See

Mary Councilman the widow of Jacob Councilman is appointed
Guardian for her daughter Elizabeth & enters into Bond with Jno Loy &
Henry Loy her Sec’ys in the sum of £150. Also for her next daughter Catherine
& the same Sec’y in the same sum. Also for her third daughter Sarah same
Sec’y & same sum. Also for George her son the same Sec’y & same sum. [See

Ordered that Elizabeth Peak the daughter of Elizabeth Peak
of the age of Twelve yrs in the month of April last be bound to Samuel

Administration of the Estate of John Lamb Dec’d is Granted
to Elizabeth Lamb who offers Jno Taylor Enoe & Fred Williams Sec’ys for her
faithful adm’n in the sum of £100. Sworn.

Ordered that Theophilus Hayes the son of Mary Hayes Single
woman & of the age of six years on the 1st June next be bound to
William Turner to learn the art & mistery of a Farmer until he arrive to

Absalom Tatom Esqr came into Court and being duly sworn
saith that he saw Benjamin Smith sign seal & deliver as his act & deed
a Deed of Conveyance to James Hogg for one sixty fourth part of a tract of
County lying on the Waters of the river Kentucky, Green River, Cumberland,
Powels and Clinch Rivers and other branches of the Ohio, which was purchased
conveyed by the Cherokee Nation of Indians by two several Deeds of Conveyance
to Richard Henderson, John Williams, Thomas Hart, Nathaniel Hart, John Luttrell,
Wm Johnston, James Hogg, David Hart & Leonard Henley Bullock, and that the
said Absalom subscribed his name as a witness to the said Deed of Conveyance
from Benjamin Smith to James Hogg and that he also saw John Hogg at the same

The Execution of a Deed from John Elliott to Wm Carter was proved
acknowledged in open Court by the oath Wm Elliot who is the only brother
and heir at Law of the said John Elliot Dec’d & also by the Oath of
Jane Elliot who is the widow & relict of the said John Elliot. Also Sam’l
Hill being duly sworn in open Court made Oath the John Shy whose name appears
to be subscribed to the said Indenture as a witness attesting the Execution
thereof was a near relation of the sd Sam’l Hill & that he the said John
Shy is now Dead & that he the sd Sam’l was well acquainted with the manner
of the sd John Shy’s writing his name & had in his life time frequently
seen him write his name & having looked on the name of John Shy subscribed
as a Witness as aforesd saith that he believes the same to be of the proper

Thomas Lasley comes into Court & maketh Oath that he in
the year 1778 Entered a claim to 150 acres of Land lying & being in the
County of Orange and paid the purchase money for the same to John Butler then
Entry taker of the sd County and that the warrant a Duplicate on which the
Grant is claim’d is fairly and justly obtained without fraud and that he is
still entitled to a Grant for the sd Land that the sd Entry stands in the Entry
takes book No 658. And the sd Thomas Lasley also produces into Court the rec’t
of John Butler for the purchase Money which rec’t or hand Writing of Jno Butler
is proved by the Oath of Andrew Murdock Esq. Ordered therefore that the
Clerks attestation [note in left margin] attestation & County seal
affix’d & delivered to Tho Lasley 29th May 1797.

thereto agreeable to act of Assembly & forward the same to the Secretary.
Thos Lasley comes into Court & maketh Oath that he in
the year 1778 entered a Claim for 150 acres of land No 658 in the County of
Orange with John Butler then entry taker of sd County & that it appears
from the books of the sd Butler that a warrant iss’d for the same but never
came to the hands of the sd Thomas but was as he verily believes delivered to
one Joseph Wright a Deputy Survy’r who soon afterwards went away with all the
papers in his hands so that he cannot obtain a grant for the sd Land unless
this Court will make an order that the Clerk issue a Duplicate of the sd
Warrant. Ordered therefore that a duplicate issue.
On the oath Motion of W Duffey Esq Atto &c &
affidavit of James Baldridge & Charles Christmas Surveyor &c Ordered
that the Clerk issue a Duplicate warrant to the said James Baldridge for 250
Acres of land which it appears he entered with Jno Butler Esq as appears
from the by an Entry No 239 on the books of the sd John Butler former
Entry Taker &c.

On Motion of W Duffie Esqr Atto &c & affidavit of
Richard Cope & Charles Christmas Surveyor, Ordered that the Clerk attest a
rec’t here produced from under the hand of Thos Mulholland late Entry Taker
&c for the purchase Money of an Entry of 40 acres of Land made by him the
sd Richard Cope with the sd Thos Mulhollan Entry Taker as aforesaid & also
that the sd Clerk affix the County Seal thereto according to act of assembly
& issue a Duplicate warrant.
On Motion Wm Norwood Esqr Atto &c & affidavit of
James Anderson & Alex Anderson, Ordered that the Clerk attest the rec’t
here produced by the sd James & Alex from under the hand of Jno Butler
former Entry Taker &c for the purchase Money of Entry of 300 acres of Land
made by them the sd James & Alexander Anderson with the sd
Jno Butler Entry Taker as afsd & also that the sd Clerk affix the County
Seal thereto agreable to act of assembly.
On Motion of W Norwood Atto &c & affidavit of Jesse
Fulton, Ordered that the Clerk attest the rec’t here produced by the said Jesse
from under the hand of Jno Butler former Entry Taker &c for the purchase
money of an Entry of 200 acres of Land made by him the sd Jesse with the sd Jno
Butler former Entry Taker &c & also the sd Clerk affix the County Seal
thereto agreeable to act of Assembly & issue a Duplicate.

Stephen Ward & Charles Christmas Surveyor &c, Ordered that the Clerk
issue a Duplicate Warrant to Wm Ward for 364 acres of Land which appears by an
Entry No 607 the sd Wm Ward entered with the Entry Taker of Orange County in
the Month of Aug’t 1778.
On Motion, ordered that a duplicate warrant issue to James
Prosser for seventy two acres of Land which appears to have been entered by the
sd James Prosser as per Entry no 413.
On Motion, Ordered that a Duplicate Warrant issue to James
Tate for 150 acres of Land which appears to have been entered ?????? ???
by the sd James Tate as pr Entry No 274.

the Oath of John McCauley one of the Subscribing Witnesses thereto &

The Execution of a Deed from Memucan Hunt & William
Lytle to Absalom Tatom was duly proved in open Court by the Oath of Sterling
Harris who says the one of the Subscribing Witnesses thereto &
ordered to be registered. [See ODB 5/756.]
The Execution of a Deed from the Trustees of the University
to John Carrington was proved in open Court by the Oath of Bryson Dobbins who
says that the name of W Watters Subscribed as a Witness

to the said Deed as he believes to be the proper hand
writing of the sd William Watters Dec’d & there being no other Subscribing
witness, the sd Deed is ordered to be registered. [See ODB 6/8.]
The Execution of a Deed from the Trustees of the University
to John Carrington was proved in open Court by the Oath of Bryson Dobbins who
says that the name of William Watters Subscribed as a Witness thereto is, he
believes, the proper hand writing of William Watters Dec’d & there being no
other Subscribing witness, the sd Deed is ordered to be registered. [See ODB
6/9.]
The Execution of a Deed from Robert Jourdan to Mary Clark
was duly proved in open Court by the oath of James Baldridge & Tho Jourdan
the subscribing witnesses thereto & ordered to be at the same time
Ann Jordan acknowledged widow of Robert Jourdan whose name is thereunto
subscribing came into Court & relinquished her right of Dower in the said
Land mentioned in the said conveyance before Sterling Harris Esquire who was
appointed by the Court privately to examine her, the Deed is therefore ordered
to be registered. [See ODB 5/779.]
On Motion, Ordered
that a Dep Warrant issue to Wm Lytle for 25 Acres of Land, it appearing
by the Entry Takers books that the said Wm had formerly made that Entry &
no Warrant has yet issued. Vide Entry No 416.
Ordered by the Court
on Application of James Baldridge Esqr by Wm Duffy his Atto that a Caveat
entered against the administration granted at this Term by this Court on the
Estate of Alexander Moore Dec’d to Henry Moore & that notice issue to the
sd Henry to appear at the next Term to shew cause if any he have why the said
Order of administration should not be rescinded & that in the Mean time no
letters of Administration be issued. [See also administration OCPQS 5/229.]
