9. The State vs Joseph Marcum} Ind’t Assault, charged &
pleads not guilty. Same Jury as in no 6 charged &c, find the Defend’t not
Guilty. On motion, Ordered that Francis Moreland pay the Costs of this pros’n.
Ordered that the Sheriff pr??? Bring into this Court
tomorrow the Children of Wm Jackson now living with their mother in this Town
that the said children may be dispos’d of as the Law in cases like theirs does
direct, and that the Shff also give notice to Mrs Jackson, the mother of sd
Children of this measure. [But Mrs Jackson was apparently un-cooperative. See

Thursday Morning 31st May 1798, Court met

Adam Phifer confined in the Gaol of Hillsbo District for the
fees Due by him on a conviction & Judgment of Petit Larceny in the Superior
Court of said District Adam Phifer being brought into Court by order of
the Justices makes Oath that he is not worth 40/ shillings Sterling money in
any worldly substances either in Debts owing to him or other ways howsoever
over & besides his wearing apparel, working Tools & arms for Muster,
and it is therefore ordered by the Court that he be and is accordingly
discharged and released from his said confinement on the above account.

32. Cearns & John Tinnen vs James Tinnen’s Ex[ecuto]rs}
Caveat of the Will of James Tinnen Dec’d. Whether the paper writing offered to
probate in this Court purporting to be the will of James Tinnen Dec’d be
actually his will or not. Jury Sworn, to Wit: Baxter King, Rob’t Gray, James
Dunnagin, John Strayhorn, James Craig, Wm Fosset, Rob’t Fosset, Samuel Clenney,
Joseph Hambleton, Jehue Whithead, Dav’d Allison, John Bullock. Find & Say
that the abovementioned writing is the last Will & Testament of
James Tinnen Dec’d. [See OWB C/114.]

Ordered that the Sheriff of Orange be directed to take the
body of Susannah Jackson and commit her into Custody until she produce her
children to this Court, which children she has refused to deliver up in
contempt of the order of this Court [see Apprentice Bonds, image 339… having
shut the door of her house and declared that nobody should take her Children…]
made upon presentment of the Grand Jury that the said Children come within the
purview of the Orphan Laws of this State & ought to be bound out. [See
OCPQS 5/410-411.]
In the matter of Sam a Mulatto man son of Rachel formerly
the property of William Freeman late of Bertie County deceased on Petition of
Francis Child & Mary Doherty Children & Representatives of the said
William Freeman dec’d. On hearing the Petition of the said Frances and Mary,
praying that the said Sam a Mulatto man now residing in the County of Orange,
son of Rachel a Mulatto Woman formerly the Slave of the said William Freeman
deceased be set free. It being duly proved and made to appear to the
satisfaction of this court that the said Mulatto woman Rachel mother of the
said Mulatto man Sam had performed meritorious Services to her former Master
the said William Freeman deceased, and that he had in consequence thereof left
her and all her Children free and clear from bondage and Slavery for ever by
his last will and Testament [presumably filed in Bertie County] & it being
also proved that the said Sam is the son of the said Rachel and thereby
entitled to his Freedom & also that Robert Freeman the son of the said
William Deceased had due and legal notice that application would be made at the
present Term of this Court for the liberation of the said Mulatto man, It is
ordered and adjudged by the Court that the said Neg Mulatto man Sam be set free
and liberated from all Bondage and Slavery whatsoever and he is licensed by
this Court to go at large as a free man with all the Rights and privileges
belonging to a freeman of Colour and that he shall be known by the name of

Ordered that Solomon McGee Son of Tabby McGee be bound to
James Dunnagan until he arrive to lawful age to learn the Art & mistery of
a farmer. [See Apprentice Bonds, image 331. Solomon was re-bound to Exum
Elliott at OCPQS 8/388.]
Ordered that Jno Woody pay to Rebecca McMullen £5 annually
for 5 years for the Maintenance of a bastard Child begotten by the sd John on
the body of the said Rebecca & that he pay immediately £2 for the Expences
of lying in and Five pounds in advance for the first years allowance and it is
further ordered that the Annual payments shall begin be computed from
the birth of the Child. [See Bastardy Bonds, images 662, 730 & 877, also
OCPQS 6/103 which identifies the child as Samuel McMullen.]
Ordered that Elizabeth Jackson daughter of Susannah Jackson now
of the age be bound to Samuel Chambers until she Arrive to lawful age. [See
Apprentice Bonds, image 345. See also OCPQS 4/409. But one year later the
Jackson children were returned to their father OCPQS 5/570.]
Ordered that Pierceon Pierson Jackson son of Susannah
Jackson now of the age of Nine years last March be bound to William Brooks
until he arrive to lawful age. [See Apprentice Bonds, image 348. See also OCPQS

about the Age of Seven Years be bound to Samuel Chambers until she arrive to

Ferabee Fosset widow v. The Ex[ecuto]rs of Jno Fosset Dec’d
& others} On hearing the petition & the answer of the Executors by
which it appears that the personal property of the deceased (not including the
Negroes Jane & Betsey) has been disposed of in the discharge of the debts
of the deceased, and it appearing further that the said two Negroes have been
appraised by William Lytle & Wm Strayhorn according to the direction of the
Will, and it also appearing that the petitioner has received the bed &
furniture & the crockery ware bequeathed her in the Will, and the Value of
the Wench & Child the aforesaid Jane & Betsey amounting by the
appraisement aforesaid to one hundred and forty pounds, It is therefore ordered
& decreed by the Court by and with the consent of the Parties That the
petitioner shall receive from the said Executors (Defendants) the sum of forty
six pounds thirteen shillings & four pence being the one third part of the
Valuation of the sd Negroes which shall be a full discharge of all her claims
on the personal Estate of her late husband the said Jno Fosset, she giving bond
to refund a ratiable part in case Debt hereafter appear & property
sufficient should not be left in the ??? of the Executors to discharge them
persuing the directions of the Act of the Gen’l Assembly in that case provided,
and the petitioner shall be at liberty on tendering such Bond to take out ???
for the said Sum of £46.13.4 against the said Executors de bene propriis – and
the question of dower is reserved.

Friday Morning 1st June 98, Court met according

Ordered that John Laurence Son of John Augustus Laurence now
of the age Nine years be bound to William Partin agreeable to the Orphan Law.

Henry Thompson Jr offers his resignation as Standard Keeper
of this County.
Sterling Harris Esqr is appointed Standard Keeper of the
County of Orange who enters in bond with Henry Thompson Jr his Security in the
Sum of £50 and took the Oath necessary for his qualification.
Jno Taylor is appointed Overseer of the road from Samuel
Hopkins’s Mill to Abijah Massey in the room of Edmund Jones.

On the Election of Sheriff of this County by the Court
present are the following Justices, to wit: John Umstead, Sterling Harris,
James Carson, Arch’d Campbell, John Thompson, Empson Bird, James Christmas,
Benjamin Lacey, Walter Alves, William McCauley, William Lytle, William
Strudwick, John Rhodes, Francis Moreland, William Shepperd, Shad’k Forrest,
John Taylor, Robert Campbell, Hardy Hurdle – when Andrew Murdock Esqr was
elected Sheriff of Orange County.
Andrew Murdock Shff of Orange County is allowed £50 for his
Ex officio services as Shff for one year past, ordered that the County Trustee
pay the same.

of £50 for his Ex Officio Services for one year past & that the County
Trustee pay the same.

John Umstead, William Lytle and Sterling Harris who were
appointed by the last Court to examine the books of the Public Register of this
County and to ascertain the Value of the Services of John Estis the present
register in arranging said books & making Indexes to them report as
follows that £100 would be slender compensation for the services performed
in the premises by the said John Estis and the Court being satisfied with said
Report and the reasons on which it is founded, there being also a
majority of the Justices of the County present, do order that John Estis
Esquire Public Register of Orange County be allowed and he is accordingly
allowed One hundred pounds in full compensation for service performed in
arranging and reducing to order the Scattered page of the ancient Registers
Books of this County of Orange and for making 4332 pages of Indexes to the
names and deeds therein contained & that the County Trustee pay the same.
On motion of Wm Duffy Atto &c, Ordered that such bills
of sale as are now in the Clerk’s office & not recorded & such other
bills of Sales as may hereafter come into the Clerk’s office after the Clerk
shall make the necessary Certificate of the proofs of the Execution thereof be delivered
over by the Clerk to the register for registration.
Administration of
the Estate of David English during the Continuance of the Suit respecting the
Will of David English of the Estate of the Estate said David English is
granted to Ellinor English the Widow of the deceased David English who enters
into bond with Robert Gray & James Armstrong her Securities in the Sum of
