On the Presentment of the Grand Jury to this Court of certain orphan Children who are proper objects for the care and attention of this Court, It is Ordered that the Sheriff have the said Children before this Court on friday next that the said Children may be bound out or otherwise disposed as this Court may find proper. And that the Clerk give public notice at the Court house door of this order. [Note that at least two of the three children whose fate were taken up the following Friday at OCPQS 5/564 were free people of color, which makes one wonder what the Grand Jury was up to here.]

13. The State vs Jno McCauley (Irish)} Ind’t for keeping a disorderly house, charg’d & pleads not Guilty. [Jury:] Wm Nunn, Isaac Holden, Wm Picket, Jacob Umstead, David White, Joseph Hodge, David Parker, Christopher Barbee, Josiah W Dixon?, Jno Ward, Wm G? Durham, Jno McCulloch. Find the Defendant guilty in Manner and form as charged in the bill of Indictment. It is considered by the Court that the Defendant be deprived of his Licence and be fined 40/ & Costs. [Revoking his tavern license which had been granted at OCPQS 4/466.]

[OCPQS 5/560 - May 1799]

17. The State vs Sherwood Dunnagan} Ind’t Assault, charged & pleads not guilty. Jury charged, to wit: Wm Montgomery, David Strayhorn, Jno Thompson, Hugh Mulhollan, Robert Walker, Jesse Clark, James Hart, Tho Atkinson, Burris Eastridge, Hugh Curruthers, James McCulloch, Robert Faucett. Find the Def’t guilty in manner and form as charged in the Bill of Ind’t. Sentence of the Court that Sherwood Dunnagan be Imprisoned until 12 o’Clock on Saturday next, that he pay a fine of 20/ and that he continue in prison until the fined & Costs of this pros be paid. Motion for appeal.

The State vs Same} Ind’t Ass’t, charged & pleads not Guilty. Same Jury as in No 17 sworn &c, find the Defendant not Guilty. It is the Opinion of the Court that Charles Dunnagan the prosecutor pay the Costs of this Ind’t.

The State vs Tho Nelson} Ind’t, Pleads not Guilty. Same Jury as in No 13 sworn, find the Defendant Guilty in manner & form as charg’d in the Bill of Ind’t.

James Walker and Robert Hodge are appointed to inspect the poll of Election for Members of the Assembly on the East Side of Haw River to be held at the Court house in Hillsborough.

Friday Morning 31st May 1799, Court met according to adjournment. Present: Sterling Harris, Empson Bird, Walter Alves} Esqrs.

Ordered that Paul Kennon an Orphan Boy Son of Laurence Kennon now of the Age of [blank] be bound to John Carter to learn the art and mistery of a farmer. [Bond not found. He was also summoned & bound at OCPQS 5/638-639.]

Ordered that John the son of free Mary now of the age of Twelve years Aug next be bound to William Horton until he arrive to lawful age to learn the Art & mistery of a Carpenter. [See Apprentice Bonds, image 324.]

Ordered that James Son of Free Mary now of the age of eight years Aug next be bound to And’w Brooks until arriving to lawful age to learn the art & mistery of a Carpenter. [See Apprentice Bonds, image 322.]

[The preceding three orphans are apparently the same ones whom the Grand Jury brought to the Court’s attention earlier in the term at OCPQS 5/557. Two of them (at least) would appear to be free people of color.]

[OCPQS 5/565 - May 1799]

Administration of the Estate of Benjamin Hall is granted to David Hall who enters into Bond with Joseph Dixon and Thomas Horn his Securities in the Sum of £500.

On Motion of William Norwood Esqr Atto &c, Ordered that Augustus Benton Adm’r of the Estate of William A Richards dec’d have leave to sell the loose plank, Scantlin and Lumber laying on the Lott of the Estate of the said Richards at the University. [See also administration OCPQS 5/526, personal property to be sold OCPQS 5/527, accounting OCPQS 5/650.]

Administration of the Estate of John Patton deceased with the Will annexed [OWB C/128] is granted to Tho Whitted who entered into Bond with James Thompson and Reuben Smith his Securities in the Sum of £1000.

John McDaniel is appointed Guardian to William Patten and enters into bond with James Mebane & William Kirk in the Sum of £1000.

[OCPQS 5/566 - May 1799]

Margaret Loy is appointed Guardian to Joseph, Daniel & Elizabeth Loy orphans of Henry Loy dec’d who enter into Bond with [blank] & [blank] her Securities in the sum [of] £200. [See also administration OCPQS 5/360.]

Ordered tha[t] Margaret Loy Guardian &c be allowed to sell a tract of Land containing 125 acres of the Estate of Henry Loy Dec’d whereon the sd Henry lately liv’d, for the purpose of satisfying the Debts of the Dec’d. [Loy sold 100 acres in 1801, though it does not say she is selling as guardian. See ODB 10/55.]

Alexander Steward is appointed Guardian to John Devonport orphan of Sam’l Devonport Dec’d who enter into Bond with James Ray his Security and [blank] in the Sum of £500. [See also administration OCPQS 5/106.]

On Motion of Wm Duffy Atto &c, it ordered that Christopher Stubbins the reputed father of a Child of which Nancy Carrington hath been lately delivered pay until [blank] £5 p Annum for five years, the [corrected at OCPQS 5/567.]

[OCPQS 5/567 - May 1799]

Ordered that Richard Cates the reputed father of a Child delivered of the body of Mary Hastings single Woman pay unto the said Mary Hastings for the support and Maintenance of the said Child Twenty seven pounds in annual payments, to wit, Seven pounds for the first year and 40/ of the first payment to be paid on issue, five pounds for each year thereafter until the whole shall be paid. The time of payment to commence from the birth of the sd Child and he the said Richard Cate enters into bond for the performance of this Order and to keep the County indemnified &c. Rec’d of Rich’d Cates 40/ SB. 10th Sept 99 rec’d of S Benton 40/ for Mary Haisting. /Absalom? Hastings/ [See Bastardy Bonds, images 787, 793, 795, 874, 1012 & 1037, also OCPQS 6/61.]

Ordered that Christopher Stubbins the reputed father of a Child delivered of the body of Nancy Carrigan single Woman pay unto the said Nancy Carrigan for the support and maintenance of the said Child Twenty seven pounds, five annual payments, to wit, Seven pounds for the first year and five pounds for each year thereafter until the whole shall be paid. The time of payment to commence form the birth of the said Child. And he the said Christopher enters into bond for the performance of this Order and to keep the County indemnified &c. [OCPQS 5/568 - May 1799]

Present the following Justices when the Court proceeded to the appointm’t of a Sheriff for the ensuing year in the room of A Murdock whose time expires with this Term: E Bird, Wm F Strudwick, James Christmas, Walter Alves, James Carson, Wm McCauley, James Baldridge, Benj Lacey, Jno Umstead, Francis Moreland, Jno Thompson, Sterling Harris, Jno Rhodes, Wm Shepperd, Wm Raney, Shad Forrister, Jno Taylor, James Moore. When the Shff Samuel Turrentine was Elected was Elected by a majority of four votes, Who is Commission’d by the Governor & Quallified accordingly.

Andrew Murdock Shff of Orange County is allowed £50 for his Ex Officio Services as Shff for one year past. Ordered that the County Treasurer pay the Same.

Ordered that the Clerk of Orange County be allowed £50 for his Ex Officio Services for one year past and that the County Treasurer pay the Same.

John Estis Public Register for the County of Orange is allowed £13 for blank Books furnished in his Office and ordered that the County Treasurer pay the same. [Evidently Deed Book 8 and perhaps 9.]

Ordered that John Taylor, Wm F Strudwick & Jno Umstead Esqrs be appointed to examine the Accts and Vouchers of Wm McCauley Guardian of the Orphans of David Craig Dec’d and make report to next Term. [See also accounting OCPQS 5/528, guardianship OCPQS 4/522, OCPQS 4/523 & 5/612.]

On the Motion of William Jackson and ????? with the Consent of Samuel Chambers, It is Ordered that the said Samuel Deliver to the said William, Betsey Jackson and Sarah Jackson two of his Children heretofore bound by this Court to the said Samuel [OCPQS 5/410-411], and that the said Samuel be discharged from the future care and tuition of the said Children.

Ordered that a County tax be levied & Collected as follows, to Wit: 2/6 on every poll & 2/6 every three hundred acres of Land for County contingencies, 1/ on every poll & 1/ on every three hundred acres of Land for the payment of jurors, /3d on each poll & /3d on each three hundred acres of Land for building a district Goal & /3d on each poll & /3d on each three hundred acres of Land for arrears of said tax for said building, amounting in the whole to 4/ on each poll & 4/ on each three hundred acres of Land.

The memorial of Jesse Rigsby of Orange County being read & Stating that in an action between a party of Militia Commanded by Capt Abraham Allen & a partie of Tories at Lewis Kirks in the year 1781 he rec’d a wound through his body by which he is much disabled & often rendered incapable of Labour and also claiming an allowance to be made him under the directions

of an Act of the General Assembly pass’d at Hillsbo in the year 1784, entitled an “Act for the relief of such persons as have been disabled by wounds or rendered incapable of Procuring for themselves & families Subsistance &c. The Court appointed Doctors John Umstead & Barnabas O’Farrel to examine the said body of the said Jesse Rigsby & report their opinion thereof to this Court immediately.

Doctors Umstead & O’Farrel having seen the wound of Jesse Rigsby make the following report: That it is their opinion that the said Rigsby is by reason of the said wound rendered unable to perform his ?? ??? Labour at least two thirds of his time in consequence a ?????? and that they had examined Baxter King & Benjamin Yeargan Neighbors of the said Jesse Rigsby whose evidence tended to the support of their said opinion. Wherefore the Court do order & direct that the Clerk are of opinion that the said Jesse Rigsby ought to be allowed the sum of £20 for one year to come & do order that the Clerk Certify to the next General Assembly accordingly.

It being represented to the Court now sitting that there is a Manifest Error in the date of the probate of the last Will and Testament of Colo John Luttrell Deceased [OWB A/240], and now stand on the Record of the said Will, That the same appears to be of the date of February Session 1781, whereas it ought be of the date of February 1782, Wherefore the Original Will of the said Colo John Luttrell Deceased and all the Records of this Court touching the same are produced here now to the Court. And it appearing first by the Minute Docket of this Court, that the said Will was admitted to probate at February Session 1782 and next by the Certificate of the Clerk on the back of the Original Will of the date of February Session 1782 according with the said Entry in the said Minute Docket and it being also known to the Court now here that the Decease of the said Colo John Luttrell was subsequent to the date of the probate his said will as it now stands on the Book of Wills wherein it is recorded and from which Record, Copies thereof have hereto fore issued the Court therefore satisfied with the Manifestation of the said Suggested Error, do order that the same be immediately corrected by the Clerk so that the probate of the said Will as it stands of Record in the Book of Wills be made to bear the proper day of February Session 1782, and thereby accord with the Minute Docket of the Court & Certificate on the said Original Will – Be it known therefore that at a County Court of pleas and Quarter Sessions begun & Held for the County of Orange at the Court house in Hillsborough on the fourth Monday of February 1782, The Execution of the last Will & Testament of Col John Luttrell Deceased was duly proved in open Court by the Oath
