When the resignation of Morgan Hart Clerk of this Court was presented, read & accepted, whereupon John Taylor Jr was unanimously elected Clerk in his room & stead and entered into two several Bonds with John Taylor Sr, William Strudwick, William Shepperd, Samuel Benton, Augustus Benton and William Mangum his Securities & took the several Oaths necessary for his qualification. [John Taylor Jr went on to serve as Clerk of the Court of Pleas and Quarter Sessions for the next forty years.]

Wednesday 28th May 1800, Court met according to adjournment. Present: John Thompson, James Walker, Absalom Tatom} Esqs.

Ordered that Nancy Johnston Daughter of Vicey Johnston now of the age of twelve years be bound unto William McKee until she arrive to lawful age to learn the art & mistery of a Spinster. [Bond not found. She was previously bound at OCPQS 4/418.]

John Latta Jr one of the original panel is Excused for his non attendance at this term by reason shewn the Court on oath.

The State vs Christopher Stubbins} Ind’t Ass[aul]t, Charged & pleads not Guilty. Same Jury as in No 8 Sworn &c. Find the Def’t Guilty in manner & form as charged in the bill of Ind’t. [One cannot help imagining that the victim here was Nancy Carrigan who sued him for child support. See OCPQS 5/567, OCPQS 6/20 & OCPQS 6/144.]

The State vs John Mallery} The Def’t being in Gaol, it is ordered that the Shff bring him into Court for the purpose of having his Trial.

[OCPQS 6/19 - May 1800]

The State vs John Mallery} Ind’t Ass[aul]t. Jury Sworn to wit: William Crutchfield, Moses Cox, William McDaniel, John Milliken, Thomas Bradshaw, John McDaniel, Robert Faucett, James Murdock, William Murdock, Elihu Woods, James Comb, John Latta. Find the Def’t Guilty in manner & form as Charged in the bill of Ind’t. Whereupon the Court adjudged that he be fined 1d & imprisoned one house and from thence until the fine & Costs of this pros are paid. [See also OCPQS 6/20.]

The State vs Joseph Thompson} Ordered that Joseph Thompson the reputed father of a Child delivered of the Body of Jane Russell single Woman pay unto the said Jane Russell for the support & maintenance of the said Child twenty seven pounds in annual payments to wit seven pounds for the first year & five pounds for each year thereafter until the whole shall be paid. The term of payment to commence from the 1st May 1800 and the said Joseph Thompson enters into Bond with Wm McDaniel & Mary Cos his Sec for the performance of this order &c. recd 40/ of the first pay’t Wm Norwood Atto Law. Nancy Carrigan vs Christopher Stubbins} Ordered that Notice issue to the Defendant to appear at next Court and show Cause why Execution shall not issue against him for the Amount ordered by the Court to be paid by him to the plaintiff for the maintenance of a Bastard Child with which he is Charged as the reputed Father. [See Bastardy Bonds, images 789, 797, 802 & 87. See also OCPQS 5/567 & OCPQS 6/144.]

Charles Grimes of lawful age &c comes into Court & chooses Thomas Wilson his Guard who enters into Bond with Daniel Turrentine & Andrew McBroom his Sec in the sum of £100.

John Mallery being now in Gaol for the fine & Costs of an Indictment for an ass[aul]t on William Kirkland. It is represented to the Court that he hath not wherewith to discharge the said find & costs & conceives himself entitled to the Benefit of the Act of Insolvency and prays to be brough before the Court to the end thereof. Whereupon it is ordered that the said John Mallery be accordingly brought before the Court. John Mallery being now in Court and questioned as to his Worldly Substance ordered that the Oath of Insolvency be administered to him & that he be thereupon discharged. [See OCPQS 6/19.]

The Execution of a Deed from Edmond Herndon to James Compton was duly proved in open Court by the oath of John Sanders a Subscribing Witness thereto & ordered to be registered [See ODB 9/19.]

The Execution of the last Will & Testament of Hugh Woods was duly proved in open Court by the Oaths of Daniel Turrentine and Hugh Montgomery Subscribing Witnesses thereto & ordered to be recorded. At the same time the Executrix qualified. [See OWB D/1.]

The Execution of the last Will & Testament of Uriah Springer was duly proved in open Court by the Oath of Ebenezer Doan a Subscribing Witness thereto & ordered to be recorded. At the same time the Executors qualified. [See OWB D/5.]

Samuel Benton & James Walker Esquires who were appointed by the Court [OCPQS 6/21] to examine the accounts and Vouchers of Sterling Harris Esq Treasurer of Public Buildings for the Court of Orange have examined the Same and find his receipts to be the amount of Nine hundred & Ninety Seven Pounds seven shillings & eight pence and his expenditures including his Commissions on the Same to be of the amount of Nine hundred & Sixty nine pounds seven shillings which leaves a Balance in the hand of the said Treasurer of Twenty Eight pounds and Eight pence.

Court adjourned til 10 o’clock Tomorrow.

Thursday 29th May 1800, Court met according to adjournment. Present: Richard Cochran, James Carson, Sterling Harris} Esqs

It appearing to the Court that two Negro Slaves the property of James Hogg Sr, viz Tony & Toby are disabled by bodily Infirmities, It is therefore ordered that they be not in future considered as taxable property.

Ordered that Harmon Johnston Son of Vicey Johnston now of the age of 8 years the 20th last April be bound to Christian Peeler to learn the art & mistery of a Farmer. [See Apprentice Bonds, image 432.]

Michael Holt is appointed Processioner for the District of St Asaphs & took the Oath necessary for his qualification.

Present the following Justices to wit: Samuel Benton, Empson Bird, John Rhodes, Sterling Harris, Andrew Murdock, James Walker, James Carson, John Thompson, John Taylor, Rich’d Cochran, Wm McCauley, Absalom Tatom.

When they proceeded to lay the County Contingent Tax, to wit, 2/ per poll, 2/ on every 300 acres of land and 2/ on every £100 value of Town property. For the payment of the County Court Jurors 19d on each poll, 19d on every 300 acres of Land & 19 d on every £100 Value of Town property.

The County Trustee is allowed 3 pcent for receiving & 3 pcent for paying out monies by him recd from August 1797 til August 1799.

The Sheriff is allowed £50 for his Ex officio Services during the last year.

The Clerk is allowed £50 for his Ex officio Services during the last year.

Sterling Harris is unanimously elected Treasurer of Public Buildings for this County & enters into Bond with David Ray, Catlet Campbell & Empson [Bird] his Securities.

Samuel Turrentine Esq is unanimously elected Sheriff of this County & enters into Bond with William Kirkland, Catlet Campbell, Walter Alves, Andrew Murdock, William Mangum, Daniel Turrentine his Sec’s/

Thom Whithead qualifies as Deputy Shff of this County.

Ordered that William Powell Son of Mary Powell now of the age of 13 years next February be bound to Richard Cope to learn the art & mistery of a Tailor. [Bond not found.]

Administration of the Estate of Robert Thompson Dec’d is granted to Martin Palmer and Rich’d Thompson who enter into Bond with Robert Tinnen & John Faddis sec in the Sum of £1500.

Joseph Hodge comes into Court and resigns his Guardianship of Elizabeth Steel, Mary Steel, Sarah Steel, Nancy Steel & Joseph Steel orphans of John Steel Dec’d. [See also OCPQS 5/360.]

James Crutchfield is appointed Guardian to Sarah Steel, Nancy Steel & Joseph Steel and entered into Bonds with William Kirkland, Andrew Murdock and James Baldridge in the Sum of £1000 each Bond. [See also guardianship OCPQS 5/360.]

Elizabeth Steel & Mary Steel of lawful age come into Court & choose James Crutchfield their Guard who enters into Bonds with William Kirkland, Andrew Murdock & James Baldridge in the Sum of £1000 each bond. [See also OCPQS 5/360.]

Licence is granted to John Taylor Esq to keep a Tavern at his house at the University & offers Wm McCauley Esq his Sec’y. [Buck Taylor’s Tavern]

Samuel Benton, James Phillips & John Faddis are appointed assessors of the property in Hillsbo for the year 1799 & make return immediately to the Clerk’s office.

Benjamin Raney & Joshua Holt are appointed to inspect the poll of Election for Members of the Assembly West of Haw River at the insuing Election – And Michael Holt & John Gaunt are appointed Inspectors of the poll of Election for a Member of Congress at the insuing Election west of Haw River.

Empson Bird & John Cain are appointed Inspectors of the poll of Election for Members of the Assembly & Page Patterson & David Allison Inspectors of the ensuing Congress Election at Hillsboro.
