The State v. Negro Sam} Information, Burglary Jury Sworn: Thomas Latta, John Loy, Baxter Davis, Aaron Walker, John McCauley, William Faucett, William Holt, Wm M Ballard, Samuel Thompson, Thomas Vincent, William Palmer, Joseph B Shaw. Find the Prisoner Sam not Guilty of the Felony & Burglary as charged but Guilty of Grand Larceny. The Prisoner Sam being brought to the Bar and being asked by the Court why Sentence of death should not be passed upon him, he prays the benefit of Clergy, which is extended to him by the Court. The Court therefore Ordered that he be brought to the Bar of the Court and then be branded on the brawn of the left Thumb with the Letter T and that the Sheriff of Orange County carry this Sentence into Execution, and that the prisoner stand committed until the Costs are paid.

The State vs Thomas Bradford & Joseph Bradford} Jury Sworn: Joseph Rountree, Aaron Walker, William Holt, Thomas Latta, John Loy, William Faucett, John McCauley, William Palmer, Baxter Davis, John Hunt, Joseph B Shaw, Absalom Alston. Find the Defendants Guilty in manner & form as charged in the Bill of Indictment.

Ordered that Luke Peacock have notice served upon him to appear at next court and bring the body of Hemelius Patton a bound child, it being suggested to the Court that proper attention to the said child is not paid by the said Peacock, that Justice may be done in the premises.

A paper writing purporting to be the last Will & Testament of John Riggs dec’d was exhibited in open Court for probate which was caveated by Ezekiel Laws and John Guess, whereupon the Court doth Order that an Issue be made up to try the Validity of said paper writing, whereupon the following persons: Thomas Latta, Baxter Davis, John McCauley, William Palmer, Aaron Walker, William Faucett, Joseph Rountree, John Loy, Joseph B Shaw, William Holt, Absolam Alston, John Hunt who being impannelled & Sworn find that the said John Riggs did not devise by the paper writing purporting to be his last will & Testament bearing date 18th May 1803.

Ordered that Bennett Cole who has heretofore been the bound to Samuel Neville [OCPQS 8/288], remain in the Custody of Richard Blackwood until next Co and then be produced & that notice do issue to the said Samuel Neville to appear at next Co & show cause if any he can why the said Bennett Cole shall not be removed from his apprenticeship to the said Samuel Nevill. Ordered that Edi Patton daughter of Saly Patton aged fifteen years on the 23rd day of this month May 1812 be bound to John Thompson till she arrives at the age of eighteen years to learn the art of a spinster. [Bond not found.]

Ordered that William Whitted, William Cain Jr & David Yarbrough be appointed a Committee to examine & settle the Accounts of Doct’r James Webb Treasurer of Public Buildings and report to this Term.

The State vs Negro Sam} The prisoner Sam convicted of Grand Larceny was brought into Court and the Sentence of the Court was executed on him.

Anthony Maxwell Dixon a Constable heretofore appointed by this Court having been appointed an Officer in the Army of the United States & therefore virtually resigns his Office of Constable. Gray Barbee is therefore appointed Constable in & for the District of St Marks and enters into Bond with [blank]

Ordered that David Yarbrough, William Cain Jr & Henry Thompson Jr are appointed a Committee to examine the accounts of James S Smith esqr County Trustee & report to this Term.

Richard Owen a foreigner by Birth Comes into Court & takes the Oath of Allegiance to the State of North Carolina.

Administration on the Estate of Mary Sykes Dec’d is granted to Allen Sykes who enters into Bond with Reuben Smith his Security for the Sum of £100.

A paper writing purporting to be the last Will & Testament of John Pickard Senr [OWB D/351] was produced in open Court and offered for probate by Alexander Pickard Ex’r which was contested by James & Isaac Pickard. Whereupon the Court Ordered that an issue be made up between the parties aforesaid to try the Validity of said paper Writing.

Ordered that Neily Woods Son of Charity Woods now of the age of Seven Years in July next 10th day be bound to William Lewis until he arrives to lawful age to learn the Art & mistery of a farmer. [Bond not found.]

Ordered that Richard Freeman Adm’r of John Millison Dec’d have leave until next Term to return an Inventory of said Estate.

Ordered that the Sheriff Summon a Jury of good & lawful Men to enquire into the State of Mind of Mary Millison Widow of John Millison Dec’d and make report to next Term.

Administration on the Estate of Nicholas Durning dec’d is granted to Elizabeth Durning his widow who enters into Bond with Gray Barbee and James Durning her Securities in the Sum of £100.

Doct’r James S Smith comes into Court & takes the several Oaths requisite for the Qualification of Justices of the Peace.

Ordered that Michael Holt, Thomas Scott & Richard Henderson are appointed a Committee to examine what additional Sums shall be allowed the Clerk & Sheriff for their Ex Officio Services, who report that the Clerk be allowed Ten pounds & the Sheriff Twelve? Pounds ten Shillings.

Ordered that a Tax of One Shilling on each poll, one Shilling on each three hundred acres of Land and one Shilling on each one hundred pounds Value of Town Property be levied & collected for the payment of County Contingencies.

Ordered that a Tax of four pence on each poll, four pence on each three hundred acres of Land & four pence on each One hundred pounds value of Town property be levied & collected for the repair of Public Buildings.

Ordered that a Tax of One Shilling on each Black Taxable poll be levied & collected for the payment of patrolls.

Reuben Woods esqr resigns his appointment as Attorney for the County, Whereupon Thomas Ruffin esqr is elected in his place as County Attorney.
