The Grand Jury Impanneled & Sworn (to wit): John Hogan foreman, Ben Yeargan, John McDannel, Wm Cain, James Hastings, Wm Walker, James Jackson, Rich’d Christmass, Edward Wortham, John Holden, John Cain, Wm McKees, Wm Jackson, Davis Strayhorn, Joseph Collins.

Joseph Sloss Constable Sworn to attend the Grand Jury this Term.

Ordered that the following Jury view and lay off a road from the University to Chatham line on the road which leads to the red field ford the Island & others (to wit): Wm Pendergast, Edmund Jones, Wm Picket, Thomas Connelly, Alex’r Piper, Sam’l Piper, Jno Hogan, Abraham Piper, John Fann, Ben Yeargan, Abijah Massey, Matthew McCauley, John Connally, John Wilson, John Owin, Hermon Colter, ??? Dannel & James Patterson and make report to next court.

Ordered by the Court that William Blackwood is appointed Overseer of the road from the forks of the road in the big meadows to Robert Bakers spring branch in the room of John Freeland. Ordered that he keep the same in good repair as the Law directs.

Ordered that Letters of Administration of the Estate of John Dick deceased be granted to Elizabeth Dick the Relict of the said John Dick deceased Ordered that Letters of Pendente lite of the said on what an appiate? was pray’d by William Dick the father of the deceased & Granted on giving Security. Ordered that Letters Pendente lite issue to the said Elizabeth Dick & She offers James Baldridge, James Carson & Hardress Hawkins esquires which was approved of by the Court, and she qualified accordingly.  [See also accounting OCPQS 6/357 & OCPQS 6/406, guardianship OCPQS 4/613 & OCPQS 4/588, removal from guardianship OCPQS 6/334.]

Ordered by the Court that Allen Cain is appointed Overseer of the road from Granville Line to little River in the Room of Jeremiah Roberts, ordered that he keep the same in good Repair as the Law directs.

Ordered that the following hands work under John Hughes who is appointed Overseer &c: Alex Mebane, Joseph Loyd, Wm Davis, Jacob Jeffers, Jno Armstrong, James Tate, ???? Dunn, Wm Strudwick, Jno Douglass, David Douglass, Henderson Douglass, Jennet Mebane.

Ordered that Letters of Administration be Granted to John Forrest on the estate of Matthew Forrest deceased & he enters into Bond with Alexander Russel in the Sum of one hundred pounds &c.

Henry Thompson Sr comes into open Court and qualified for the safe & true keeping of the standards of Weights & measures agreeable to Law.

The Execution of a Deed from Moses Crawford to John Simpson was proved in open court and ordered to be registered. [See ODB 4/737 & ODB 4/719, recorded twice.]

John Hodge is appointed Gu[a]rdian to Matthew Ray Orphan of Robert Ray deceased on giving Bond & Security.

Thomas Wilson is appointed Overseer of the road from Person line to Thomas Griffins spring branch in the room of Andrew Griffin. Ordered that the usual hands work on the same.

[OCPQS 4/501 - Nov 1793]

William Watters & William Lytle Esquires who were appointed to examine the accounts & vouchers of John Walker esquire County Treasurer for the years 1790 & 1791 report that the same is Just and true. Ordered that the said Committee destroy the vouchers.

Ordered that John Walker esquire be allowed the Sum of thirty pounds fifteen shillings 7 six pence which appears to be the balance due him &c.

Kenneth Anderson who was appointed Constable last Term comes into court and resigns his office as Constable &c.

Ordered that William Belvin have leave to keep a Tavern at his now dwelling house in the County of Orange on giving Bond and Security.

Agreeable to the Petition of John Hogan, Ordered that the following hands open a road from from [sic] Collins creek John Gwins to the road leading from (Hillsboro to the University) to Collins Creek, to wit: Martha Loyd, Isaac Morris, James Riggins, Thomas Loyd, Rich’d Morris, Ezekiel Brewer, Wm Hobson, Thomas Cate, Lewis Kirk, Henry Edwards, John Edwards, Stokes Edwards, Sylvanus Edwards, Thomas Atwood, James Bawl, Wm Stroud, Wm Lloyd, James Loyd, Sam’l Caruthers, James Morris, Henry Joy, Savis Joy, John Curtis, David Hogan, Jno Hogan Jr & Owen Loyd.

Tuesday Morning 10 o’Clock Court met according to adjournment. Present: John Taylor, James Carson, John Liddle} Esquires.

William Blackwood is appointed Overseer of the road from the forks of the road in the big meadows to Robert Bakers spring branch in the room of John Freeland.

James Cheek is appointed Overseer of the road in the room of Ezekiel Brewer.

Administration of the Estate of Sam’l Patton is granted to John Patton & Robert Patton & they entered into Bond with Ruben Smith Security in the Sum of three hundred pounds and qualified accordingly.

Allen Edwards is appointed overseer of the road from Whitehead Creek to Lindsley in the room of Jesse Towell.

William Hastings is appointed Constable in Orange District & enters into Bond and qualified accordingly.

Peter Foust is appointed Overseer of the road from honeycuts hill to Chatham Line. Ordered that the following hands work on the said road (to wit): Jacob Marshal, John Marshal, Jacob Johnston, Daniel Foust, Samuel Freeman, Moses Honeycut, Robert Johnston, Nathan Dicks, Major Brooks, Tinse Massey, Ebenezer Brown, Humphrey Williams, Adam Rynard.

John Morrow is appointed Overseer of the road from freemans road upon the mountain to the main road that leads to Woodies ferry, the following hands work on the said road: Wm Harvey, Andrew Morrow, Joel Brown, Charles Stout & sons, Isaac Stout, Joseph Stout, Peter Stout ?? James Neal & hands, Dan’l Freeman, John Allen, Wm Marshal, Jacob Stout

Ordered that Henry Edwards be appointed Guardian for the Infants within named to Defend this suit and the said Guardian and the within named Thomas Snipes being present in Court & acknowledge Notic[e] of this Petition. Ordered that Writs issue to the Sheriffs of Orange & Chatham for the purposes within mention[ed] to allot & set off the petition[er]s Dower and shear of her late husbands real & personal Estate agreeable to the acts of assembly on that Call made. Ordered also that the perishable property of Peter Willis deceased be sold except the slaves &c Negroes considered as perishable property. Administration of the Estate of Jacob Councilman deceased be Granted to William Ray esquire and he enters into Bond with Henry Loy & Andrew Gibson his Securities in the Sum of three hundred pounds.  [See also guardianship OCPQS 5/233, land to be sold OCPQS 5/362.]

Administration of the Estate [of] James McMahon Deceased be Granted to Obed Green and he enters into Bond with William Ray & Reubin Smith his Securities in the sum of forty pounds.

[OCPQS 4/505 - Nov 1793]

Ordered that George Laws, William Laws, John Cain, Eli Wood, James Walker & John Wood Sheriff are appointed Patrolers Saint Maries District for one year.

Administration of the Estate of James Hart deceased is Granted to Thomas Hart on giving Bond & Security agreeable to Law.

Ordered that the Sheriff Summons the following Jury to view and lay off a road the nearest and most convenient way from Hillsborough to the University (to wit): Jno Gattis, Jno Craig, James Craig Sr, Jno Strain, Alex’r Strain, James Craig Jr, John Caldwell, James Gaddis, Alex’r Gattes, Jos Kirkland, John Freeland, Wm Blackwood, Wm Burnes, Wm Strayhorn, Wm McCauley & report to next Court &c.

Robert Walker is appointed Overseer of the road from the North fork to the South fork little River in the room of Joseph Woods. Ordered that the following hands work on the same (to wit): Charles Ray, Jno Riggs, Jno Hall, John Watson, Geo Newton, Edward Worthem.

November 26 1793

At a Called Court for the Trial of a Negroe Slave Jack the Property of Absalom Tatom esquire. Present three Justices & four free holders who were Summoned to attend, proclamation being made by the Sheriff for the presentment to appear, none appearing he is therefore discharged. [See NCAH Slave Records, image 10.]

On the Petition of John Hogan, Ordered that the following hands be appointed to clear out the road according to Law from John Grimes’s to Collinses creek (to wit): the hands of Rich’d Cate Sr, James Tinnen, Sam’l Ashe, Jesse Shy, Jno Lindsay hands, Nath’l Robertson, Athanatious Robertson, Athanatious Lindsey, Benj Davis, Robert Milikin & sons James Milikin, Charles Milikin, John Ray, Wm Ray, Jno McDannel, Eli McDannel & John O’Dannel and that Benjamin Davis be Overseer of the same.

Wednesday Morning 27th November 1793 Court met according to adjournment. Present: Andrew Murdock, Wm Lytle, Jonathan Lindley} Esqrs.

Petit Jury Sworn (to wit): Josiah Warren, James Latta, John Woods, Jo Woods, Alexander Boling, Owen Lindley, Henry Fossett, Sam’l Thompson, John Dannel, Abner Tapp, James Walker, John Armstrong. No 7. Alexander Campbell vs Robinson Mumford} Debt. Jury Impannelled & called & non suited, an appeal prayed an[d] granted on giving Bond & security.

Thomas Farmer vs Wm Ray & Wm McAdams} Execution. On motion of Joseph Taylor Atto for William Ray in custody it appears that the Judgment & Costs are satisfied as appears by receipt. Ordered that the said Ray be discharged.

James Combs is appointed Overseer of the road from little river below Robert Wilsons to the Town of Hillsborough in the room of Theophilus Thompson.

Ordered that John Davis be released from Sam’l Earles Indenture who was bound to the said Davis &c. [See Apprentice Bonds, image 53.]

No 9 Benjamin Thomas vs William Trousdale} Case. Jury Sworn find Defendant Guilty and assesses the Plaintiffs Damages to 1d & 1d Costs.

Reuben Holt is appointed Constable in Orange County for one year & qualified accordingly.

John Jackson is appointed overseer of the road

John Wilson is appointed Overseer of the road from the County Line to Nevels creek. Ordered that the convenient hands work on the same & keep said road in good repair as the Law directs.

Pomfret Herndon is appointed Overseer of the road from Nevils creek to John Hogans. Ordered that the convenient hands work on the same and keep said road in good repair as the Law directs.

Ordered by the Court that James Holt is appointed Overseer of road in Saint Marks District in the room of Mat Clinton of Joseph Nicks from Samuel Mays Cross Rode to Pealers fork.

Ordered that Jonathan Johnston an orphan boy about fifteen years of age be bound to Andrew Brooks. [Bond not found. Jonathan was later removed from Andrew Brooks OCPQS 5/179 & bound to Robert Eaton OCPQS 5/180.]

Hugh Finley is Fined 10/ for not attending as a Juror at the Sheriffs call.

Same Jury is in No 17 Impannelled & Sworn. Wm Nash assignee Peter Maxwell vs John Estis} Default and enquiry

Jury Impannelled and ass the plaintiffs Damages to £48.8 & 6d Costs.

Ordered that all appeals be tried on tuesday the Second day of the court, in future, and that the Clerk notifie the same at the Court house & other publick places & that thursday be set apart for States day &c.

John Sloss esquire Sheriff vs John McCauley, Jno Carrington & Wm Trousdale his Securities. Judgment confessed by John McCauley for £51.13?

Ordered that John McCauley be allowed three pounds of furnishing the County of Orange with a room for the Court. Ordered that the County Treasurer pay the same.

Friday Morning 10 O’Clock Court met according to adjournment. Present: Sterling Harris, William McCauley, James Baldridge} Esquires.

Frederick Taylor is appointed Overseer of the road from the fork of the road by Samuel Thompsons to the five mile post by Thomas Mortise in the room of James Hastings.

Upon reexamination of the. Ordered that an Order made this Term in favour of William Ray one of the Securities of Lewis Jones who was in Custody of the Sheriff

Ordered that a Certiorari & Supercedias issue to Geo Horner Constable, James Moore esquire & Mary Scarlett to bring up the papers & proceedings & stay execution till the same be reheard in our County Court.

Ordered that Bry Gregory be allowed the Sum of Twenty four pounds nineteen shillings for building a bridge on new hope creek agreeable to an Order made at November Term 1792. Ordered that the County Treasurer pay the same. [See Dunaway's Bridge Records, page 16.]

[OCPQS 4/514 - Nov 1793]

On motion, Ordered that an Order made by this Court and entered on the Execution Docket in the Case of a Capias ad satisfaciendum, Thomas Farmer against William Ray & William McAdams [OCPQS 4/507] be recinded. It appearing to this Court on Examination of the Records, Executions & the Sheriff, that there was and is still a balance of Costs due on the aforesaid Ca Sa and that the said Defendants to the Ca Sa has been improperly discharged. It is therefore also Ordered by this Court that a Surifacias issue to the parties Defendants to come in at next court and shew cause if any they can wherefore they shall not pay the balance so due as aforesaid into Court.

Ordered that John Cook do pay to Mary Green on whom he has begotten a bastard Child on the 6th day of August 1794 five pounds immediately for her lying in expences and the further Sum of four pounds for one years maintenance of said Child to the end of the sixth day of August 1794 & from and after that time that he do pay yearly for four years the further Sum of four pounds a year for such future maintainance, and such payments to be made on the 6th day of August yearly the first of such last payments to be made on the 6th day of August 1795 and if such Child shall die before any of such payments become due, then that the said John Cook do pay to the said Mary Green a proportionable part of such maintainance for the time such Child shall live after rate aforesaid. Robert Faucet is appointed Overseer of the road from the cross road at Jacksons Mault house to Robert Fossetts & from thence to the corner of Lytles old field &c in the room of James Jackson.

Shadrick Forrest Comes into open Court & Records his Ear mark two crosses & two over keels &c.

At a Called Court for the Trial of a Negroe Woman Tamer the Property of Andrew Burke esquire. Present: Sterling Harris, Wm McCauley & Jas Christmass} Esquires and four free holders present. It appearing to the Court that the said Negroe Woman Tamer is not guilty of the charge brought against her, its therefore Ordered that she be discharged &c.
