22. Buchanan Dunlap & Co vs John Taylor Esquire} Debt. Same Jury as in No 18, find no payment, Satisfaction or set off and assess Plaintiffs Damages to £4.13 & 6d Costs.

Robert Gray is fined 40/ peremptorily for leaving the Jury after they were charg’d and before they gave their Verdict.

On Motion of Hannah Jones and Affidavit filed, It is ordered that a writ of Habeas Corpus issue to John Marshill Of Orange County Planter requiring him on Wednesday next the 30th day of Nov Instant to have and produce to this Court the Body of Sarah Jones an Infant orphan and that the said John Marshill and there personally be and appear in this Court and abode by and perform the order and decree as may be made in the premises. Wm Courtny Esqr having Signified to this Court his determination to resign his appointment as Justice of the Peace and that he should consider himself no long a Justice of the Peace for sd C, the Court now siting therefore appoints James Carson Esqr Chairman of the Court of this County in the room and stead of the sd William who was heretofore Chairman.

Dav’d Tinnen of the age of Seventeen years & Mary Tinnen of the age of fourteen years Orphans of Rob’t Tinnen Dec’d comes into Court and chooses Catherine Tinnen (their mother) their Guardian and the sd Catherine enters into Bonds with Henry Mozon [and] Andrew Murdock her Securities &c. [See also purported will thrown out OCPQS 5/124.]

Ordered that Wm Ray son of Catherine Ray supposed to be of the age of seventeen years the 4th day of February next be bound to William Crutchfield until he arrives to the age of 21 years to learn the art and mistery of a Black Smith. [See Apprentice Bonds, image 299.]

Ordered that James Lindsey the son of Rachel Jamison of the age of four years the 25th of last September be bound to Mathew Lindsy until he arrive to the age of 21 years to learn the art of a farmer. [See Apprentice Bonds, image 301. Some years later, Rachel married Obediah Harlow (OMB G-H/529) and brought her boy home – see OCPQS 6/583 - Aug 1804.]

[OCPQS 5/142 - Nov 1796]

Ordered that John Baley the orphan son of John Wm Baley Dec’d of the age of 15th years [sic] the ?? day of June next be bound to Thomas Bane until he arrive to lawful age to learn that art and mistery of a Black Smith. [See Apprentice Bonds, image 287.]

The Execution of the last Will & Testament of John Boyle Dec’d was duly proved in open Court by Samuel Thompson & James Boyle Subscribing Witnesses thereto and ordered to be recorded at the same time James Boyle & Jno Boyle quallified as Ex’rs of the same. [See OWB C/90.]

John Ray, John Fitch & John Trousdale Jurors of the original pannel are excused from their attendance as Jurors at this Term for reasons shewn the Court on oath.

Tuesday morning 29th November 1796, The Court met according to adjournment. Present: Wm Raney, Wm Lytle & Absalum Tatom}.

The Execution of the last Will and Testament of Thomas Armstrong Dec’d was prov’d in open Court by the oath of William Elliott & Robert Taylor Subscribing Witnesses thereto and ordered to be recorded, at the same time John Taylor Enoe & Robert Faucet quallified as Executors of the same. [See OWB C/88.]

Wm Raney Entry taker of Orange County comes to Court and renews his Bond as Entry taker and gives Joseph Hodge and Andrew Gibson his Sec’ys in the sum of Two thousand pounds.

Soloman Debow orphan of Jno Debow Dec’d of the age of Seventeen years comes into Court and chooses Arch’d Murphey Esq of Caswell County his Guardian in the room of Rob’t Scoby heretofore appointed by the Court and the sd Arch’d Murphey enters into Bond with John Taylor Enoe, And[rew] Murdock & Abreham Thompson in the sum of £750 for the faithful discharge of his sd Guardianship.

Stephen Hart & others vs Thomas Hart} The Commissioners returns and ammended reported [sic] in the above Case, which is consented to by the parties attorney, and the sd report is ordered to be recorded.

Whereas it appears to this Court that Rob’t Scoby heretofore, to wit [May 1789] Term [OCPQS 4/198-199], appointed Guardian to the Estate of Solomon Debow & Stephen Debow has not for several years past exhibited any account of his Guardianship, and whereas this Court is inform’d that the sd Robert mismanages, and wastes the estate of the sd orphans, and whereas the sd Solomon has chosen an other Guardian And it is propper that the sd Robert Scoby should be remov’d from his Guardianship of the sd Stephen, It is therefore considered by the Court that the sd Robert be and he accordingly is remov’d from the Guardianship of the sd Stephen. Ordered that notice issue to Rob’t Scoby personally to be and appear at the next Term of this Court then & there to render and acco of his Guardianship of the Estate of Sol & Stephen Debow and to abide by and perform such order & decree as the Court shall make in the premises. Arch’d Murphey Esqr of Caswell County is appoint’d Guardian to Stephen Debow orphan of Jno Debow Dec’d of the ag of [blank] years, which Guard is appointed in the room or Rob Scoby & the sd Guardian enters Bond with [blank] & [blank] his Sec’ys in the sum of £[blank] for the faithful discharge of his Guardianship. [See OCPQS 5/95 for a discussion of this drama.]

Ordered that the following Jurors who have failed to attend at this Term be fined nisi according to Act of Assembly and that sci fa issue agt them returnable to the next Court, viz: David Wood, Samuel Wood, Robert Hodges, William Cabe, Abraham Anderson, Edward Green, James Garratt.

Administration of the Estate of Elza Hopkins is granted to Sarah Hopkins the widow of the Dec’d who enters into Bond with Samuel Torrentine, Wm Hopkins & John Ray (of William) in the sum of £250. [See also guardianship OCPQS 6/619.]

On motion of Benjamin Yeargan Guardian of John Morgan, ordered that the sd Benjamin sell at public sale all the perishable property of the sd John which has come to his possession, return whereof he has this day made, except a bead, bead stead & furniture which is to be reserved for the use of the sd John.

Mangom & others vs Carrington & others. By Consent of the parties, It is ordered that the accounts between these parties be refered to Walter Alves & William Cain, who shall have power to call upon both parties and their Books and accounts and all proofs, And ??mon shall report to the next Court a true Statement of the accounts between the parties and the balance due thereon – Which Report however shall be subject to all legal and proper Exceptions – and that in the mean time the said John Carrington shall stay all levels of suit.

Thomas Bird vs Hugh Mulholland} The said Defendant being an Infant under the age of twenty one years, comes into Court and names James Mebane Sr his Guardian to Defend the said suit for him. The said James Mebane is therefore appointed Guardian pending the said suit of the said Hugh, to Defend the same for him.

Ordered that summons issue to Thomas Connaly returnable to next Court requiring him under the penalty of twenty pounds according to act of assembly personally to be and appear at the next Court Term to prove the Execution of a Deed from Christopher Barbee to the Trustees of the University to which the said Thomas was a Subscribing Witness. Orange County November Term 1796. Whereas by an act of the General assembly the County Court of pleas and quarter Sessions are required at the first Court that may happen in the first day of January in each and every year to hold an Orphans Court, It is therefore Ordered that on the three last days of next term which commences on the fourth monday in February next, to wit, Thursday, Friday & Saturday an Orphans Court for said County as which time all Guardians heretofore appointed [by] said Court whose accounts remain unsettled are required to render ac account of their Guardianships and to have their accounts properly State. All Guardians failing will be Dealt with as the Law directs. The Clerk will punish this publish this order at the Court house and other public places in said County. Isu 6th Capias.
