State of North Carolina, At a Court of pleas & quarter Sessions begun & held for Orange County at the Court house in Hillsboro on the fourth Monday of November 1805. Present: Abner B Bruce, John Cabe, David Allison} esqrs.

Grand Jury: Mann Patterson, Henry Pickard, James Clendening, William Andrew, John Coble, Isaac Harvey, John Wilkerson, John Kelly, Samuel Nelson, Thomas Brewer, Daniel Freeman, Robert Holliday, William Blackwood, Richard Cate, William Barbee.

William Andrews Sworn to attend the Grand Jury as Constable at this Term.

Remaining Jurors of the Original Pannell who have appeared & qualified, vizt: Page Patterson, Hugh Cain, John McDaniel, George Garrison, Joseph Tate, Levi Jackson.

A D Murphey Atto &c vs Baxter Boling} Jury charged: Page Patterson, Hugh Cain, John McDaniel, George Garrison, Joseph Tate, Levi Jackson, Henry O’Daniel, William Kirk, Thomas, McCulley, Joseph Tates, Thomas Love, Edward Walton. Find the Bond declared on to be the act & Deed of the Defendant, that the Value of the Money mentioned in said Bond is £20 & that after allowing pay’ts the ballance due in principal & Int is £22.14/ & Costs.

George Johnston a witness in behalf of the Defendant being called by the Sheriff & failing to appear according to the Subpoena served on him, he is [fined] accordingly to Act of Assembly.

Ordered that the Inquisition returned into Court by the Sheriff pursuant to the Order of last Court in the Case of Solomon Morgan be confirmed, and thereupon the Court proceeded to appoint Chesley P Patterson Guardian of the Person & Estate of the said Solomon Morgan and entered into Bond with Morgan Hart, John Morgan, John Taylor Sr his Securities in the Sum of £4000.

Wm Cain Sr vs Jesse Rice’s Exrs} Jury charged: Page Patterson, Hugh Cain, John McDaniel, George Garrison, Joseph Tate, Levi Jackson, Henry O’Daniel, William Kirk, Thomas McCulley, Joseph Tate, Thomas Love, John Walker. Find that the Def’ts Testator did assume & within three years, that there is no set off & assess the Plffs Damages to £85.0.3d & Costs, appeal prayed.

Find that the Defendant did assume, that there has not been a good & Sufficient tender, that there is no set off & assess the Plffs Damages to £53.5/ & Costs.

Henry Coble vs P & J Fogleman} Jury charged: Page Patterson, Thomas Browning, Samuel Couch, James Craig, John Shaw, Johnston Craig, Thomas Rhew, William Whit???, Daniel Cloud, Rich’d Stailey, John Sharp, Robert King. Find no pay’t or set off , that the Value of the Doll[ar]s mentioned in the bond be £31 & assess the plff Dams to £16.7.4 & Costs. [totaling] £47.7.4.

John Boyle vs Robert Carson} Same Jury. Find the Value of the penalty of the bond to be £500 & assess the plff Dams to £75 for breach of the Condition of said bond & Costs.

Ebenezer Large &c vs Benjamin Raney} Same Jury. Find the Value of the penalty of the bond declared on to be £2214.?? & that the Value of the Condition of said bond is £1107.8.9 ½ & assess the plffs Gams to 6d & 6d Costs.

Ebenezer Large &c vs Rainey & Wilson} Same Jury. Find the Value of the penalty of the bond declared on to be £2290.3/6, that the Value of the Condition of said bond is £1148.1.9 & assess the plff Dams to 6d & 6d Costs.

It appearing to the Court that the property of Edmund Green Dec’d which was sold by the Administrator is not sufficient to pay the Debts due by said Edmund Green Dec’d. It is therefore Ordered that the administrator of the said Edmund Green Dec’d have leave to sell the Negroes belonging to said Estate for the purpose of paying the Debts due by said Estate & effecting a proper division thereof.

The State vs Henry Younger} Jury Sworn: James Fossett, Henry Nail, Jarratt Yeargain, Charles Dunnagan, William Warren, Robert King, Cason Caps, Jeremiah Glenn, James Rogers, Joseph Weaks, Samuel Stewart, Caleb Harvey. Find the Def’t Guilty in manner & form as charged in the Bill of Ind’t.

The State vs Sam’l Turrentine} Ind’t. Same Jury Sworn. Find the Def’t not Guilty.

[OCPQS 7/99 – Nov 1805]

The State vs John Hawkins & Haughan} Jury No 1 Sworn. Find the Defendant Guilty in manner & form as charged in the bill of Indictment. Ordered that the Sheriff Defendant receive 20 Lashes on his bare back and that the Sheriff carry this Order into Execution immediately. After the defendant received that punishment Ordered above, he appeared in open Court & took the Oath prescribed for Insolvent Debtors.

Jacob Myers convicted at last Superior Court for a maim & sentenced to punishment which payment punishment has been remitted by the Governor by his pardon under the Seal of the State, was on Motion admitted to take the benefit of the Act for Insolvent debtors, which he did in open Court, and was thereupon discharged.

Administration on the Estate of William Couch Dec’d is granted to Edward Couch who enters into Bond with Samuel Hunter & Chesley P Patterson his Sec’s in the Sum of £300.

John King is appointed Guardian to David King & Joseph King minor Infants of Edward King Dec’d and enters into Bond with George Horner Sec’y in the Sum of £200.

Anderson King of lawful age comes into Court & chooses John King his Guardian who enters into Bond with George Horner in the Sum of £200.

Ordered that Gavin Alves Admr &c of the Estate of John Clark Dec’d have until next Term to return an Inventory & Acco of Sales of the Estate of the said Dec’d.
