Whereas it appears to this Court that the allowance heretofore made of the Support & maintenance of Judah Williams Widow & relict of Herbert Williams Dec’d late a Soldier in the Continental Line of this State in the revolutionary war is insufficient for her Support, It is therefore Ordered & adjudged that the said allowance be raised to the Sum of Twenty pounds.

The Execution of a Deed from Samuel Holloway & Polley Holloway his Wife to William Trice was duly acknowledged by the said Samuel Holloway. At the same time Polley Holloway was privily examined by James Webb esqr separate & apart from her husband and acknowledged that she executed the same without the compulsion or coercion of her husband. Find that the Defendant has fully administered except as to £13.14.2 & an old Negro of the Name of Ovus of no Value and that he has no other or further assets & that there is due besides from the said Estate to the Plff the Sum of £257.14.3. On Motion, Ordered that the County Trustee pay to Isham Haynes the Sum of Sixteen pounds Six Shillings & four pence that Sum having been paid by William Hall for a Stray horse. It appearing to the Court that the horse was the property of said Isham Haynes.

Ordered that John Duke pay to Leah Lingo the Sum of Twenty Seven pounds as follows Seven pounds immediately & five pounds annually until the whole is paid for the Support & maintenance of a Child of which she hath lately been delivered & of which he stands charged as the reputed father. [See Bastardy Bonds, images 1404, 1406 & 1345, which refer to him as John Duke son of William. See also OCPQS 8/492.]

Jonathan Thompson is appointed Overseer of the road from Richard Cates to Mortis’ old place with the usual hands.

William Hopson is appointed Overseer of the road from Cain Creek to William Andrews with the usual hands.

James Kirk is appointed Overseer of the road from Cain Creek at Wm Hobsons to Meadow Creek with the usual hands.

George Neese is appointed Overseer of the road from the Allemance to Albrights Branch in the room of Joshua Holt with the usual hands.

Ordered that Gavin Alves County Trustee, Catlet Campbell & Abner B Bruce be appointed a Committee to audit, adjust & settle the Accounts of Samuel Turrentine late Shff with the County of Orange and make report to next Court.

The State vs Short Vaughan} Confined. The defendant having been confined in the Gaol of Orange County under a Charge of Bastardy, And being brought into Court and the attorney for the County admitting notice, the said Short Vaughan took the Oath of an Insolvent debtor. Ordered that he be discharged. [The mother was apparently Nancy Blake. See Bastardy Bonds, image 1336.]

Joseph Lantorn having been confined in the Gaol of this County on Suspicion of being a runaway slave, being brought into Court and it appearing to the satisfaction of the Court that he is a free Man of Color and he having taken the Oath of an Insolvent debtor, It is Ordered that he be discharged from his Confinement.

Is the last Will & Testament of the said Thomas Brooks dec’d so far as the same relates to or concerns his personal property and that it is not his last Will & Testament as it respects his real estate. [Nevertheless, this will is not found in OWB.]

The Execution of a deed from Sam’l Holloway and Polly his wife to William Trice was duly acknowledged in open Court by the said Sam’l and thereupon James Webb Esquire one of the Justices of this Court was appointed to take the separate and private examination of the said Polly Holloway touching the deed that she had voluntarily executed the same it was ordered to be registered.

The Execution of a Deed from Andrew Gibson to Stephen White was duly proved in open Court by the Oath of John Merrideth a Subscribing Witness thereto and Ordered to be registered.

Administration on the Estate of William Strudwick Dec’d is granted to Mrs Martha Strudwick widow & Samuel Ashe who enter into Bond with William Shepperd & Henry Shepperd their Sec’s in the Sum of £25,000.

Francis Tapp Widow of Abner Tapp Dec’d produced in this Court a paper Writing purporting to be the last Will & Testament of Abner Tapp dec’d and offered that same for probate, which was objected to by Richard Tapp in his Own right & as Guardian to the minor Orphans of said Abner Tapp Dec’d, Whereupon the Court Orders that an Issue of deves??? be made up & submitted to a Jury to try the Validity of said paper the following Jury were impannelled & Sworn, to wit: William Parish, Nathaniel Harris, James Johnston, Fielding Lewis, John Fossett, Henry Albright, George Foust, Jeremiah Hubbard, William Hall, Anderson Stroud, James Harden, Sam’l Hunter – Who find the said paper writing

It is Ordered by the Court that Gavin Alves Trustee of the County receive from the Clerk of the Superior Court of Orange County all Executions on forfeited recognizances and attend to the Collection of the same for the benefit of the County and he is Ordered & empowered to attend to such Sales as may take place thereon in the County of Wake and in his discretion to bid for each property so as to procure Satisfaction for the same and that the reasonable expences of said Trustee in prosecuting this Business shall be allowed him over & above his legal Commissions.

Ordered that Isaac Holt Admr of Adam Smith dec’d have leave to sell the perishable estate of said Adam Smith dec’d.

Ordered that Michael Holt esqr Henry Keck & John Graves lay off & allott to Eve Smith Widow of Adam Smith dec’d one years provision.

Administration of the Estate with the Will annexed of the Estate of Abner Tapp Dec’d is granted to Frances Tapp & Allen Sykes who enter into Bond with Charles Christmas & ????? Cate Sr their Securities in the sum ?????. [See OWB D/272.]

Administration with the Will annexed of Thomas Brooks dec’d is granted to Andrew Brooks who enters into Bond with John Reeves & Robert Eaton his Sec’s in the Sum of £2000. [Not found in OWB.]

Administration of the Estate of Mary Phillips dec’d is granted to Nathaniel Newlin and George Maddin who enter into Bond with John Woody who enter into Bond with his Sec’y in the Sum of £50.

It appearing to the Satisfaction of the Court that a Certain Stray Sorroll horse entered with the County Ranger by Peter Williams in the Month of March 1809 shortly thereafter strayed from the possession of said Peter and hath not since been regained by the said Peter Williams. It is therefore Ordered that the said Peter be released from the payment of said Stray & that the County Trustee cancel said bond.

Ordered that Samuel Brockwell Son of Arch’d Brockwell dec’d now of the age of twelve years May next be bound to Joshua Horne until he arrive to lawful age and Ordered that said Horne learn said apprentice to read & write. [Bond not found.]

[OCPQS 8/135 – Nov 1810]

Ordered by consent of the Solicitor Gen’l that John Do???g be admitted to bail on his giving Security before James Webb, Abner B Bruce & Catlet Campbell esqrs or any two of them in the Sum of £100 himself and £50 each Security for his appearance at the next Superior Court to be held for this County to answer such for a charge of felony & Murder committed on the body of Abner Tapp.

Ordered that Chesley P Patterson late Guardian of Solomon P Morgan be allowed the Sum Twenty five pounds as Commissions for his Services & trouble in managing the estate of his said Ward & the further Sum of four pounds so much paid by him as Guardian aforesaid and that the present Guardian pay the same.

James Christmas vs Charles Christmas & William Gilbert Admrs of Rob’t Christmas} Petition for Division of Personal Property. Ordered that the Defendant William Gilbert one of the def’ts & enter his appearance within the 3 first days of next Term else Judgmt pro confesso to be entered agt him and this Ordered be published three Weeks successively at the Raleigh Minerva.

Friday 30th Nov’r 1810, Court met according to adjournment. Present: Catlet Campbell, Abner B Bruce, Thomas Whithed} esqrs.

Nancy Dunnagan vs Willie Mangum’s Admrs} On Motion Ordered that the administrators of Willie Mangum dec’d pay to Nancy Dunnagan the Sum of Fifty four pounds immediately for the Support & maintenance of two Children of which said Nancy hath lately been delivered and of which the said Willie in his life time stood Charged as the reputed father. [See Bastardy Bonds, image 1399.]

Ordered that the Sheriff summon a Jury of good & lawful men unconnected with the party either by Affinity or consanguinity to examine and pass upon the State of the Mind of Wilson Child and report their proceedings to next Court, And that the Sheriff be authorized to Summon such Testimony as may be required by those concerned in said proceeding.

The Execution of a Deed from William Horton & Magdeline his Wife to Doct Barnabas O’Farrill was duly acknowledged in open Court by the said William And thereupon Catlet Campbell & Abner B Bruce esqrs two of the Justices of this Court were appointed to take the separate & private examination of the said Magdeline Horton touching the Execution of said Deed, Who having reported that she voluntarily executed the Same, It was Ordered to be Certified.

Whereas the Execution of a Deed from Walter Galbraith, Robert Dixon & Mary his Wife & others to Archibald Murphy having been proved at last Term by the Oath of Jeremiah Holt one of the Subscribing Witnesses, It is therefore Ordered that a Commission issue to Isaac Holt and Michael Holt esqrs to take the separate & private Examination of Mary Dixon, Elizabeth Cunningham & Catharine McKamie, whether they executed the said conveyance freely & of their own accord without fear or compulsion from their husbands & report to next Term.

Thomas Hunt vs Willie Mangum’s Admrs} T F returnable to this Term. Ordered that a special T??? Facias issue to the Sheriff commanding him to levy of the Goods & chattels of the said Willie dec’d in the hands of his admrs sufficient to satisfy the Execution and if not sufficient assets to be found in the hands of the admrs then that he levy of the proper goods & chattles, Lands & Tennements of the Admrs sufficient to satisfy this Execution.

Samuel Turrentine is appointed Guardian to James Brooks natural Son of Hannah Brooks who enters into Bond with John Taylor Jr his Sec’y in the Sum of £300.

Administration on the Estate of James McCaleb dec’d is granted to John Stroud who enters into Bond with David Nunn his Sec’y in the Sum of £400.

The Execution of a Deed from Alexander McRae to John Cook was duly proved in open Court by the Oath of Isaac Holt a Subscribing Witness thereto and Ordered to be registered. [See ODB 13/411.]

The Execution of a Bill of Sale from Jesse Cate to Thomas Cate was duly proved in open Court by the Oath of Thomas Cate a Subscribing Witness thereto and Ordered to be registered. [See ODB 13/414.]
