Sessions begun and held for Orange County on the fourth Monday in November
1812. Present: Thomas Whithead, Joseph Clendening, James Hutchison} esqrs.

Joseph Rippy, William Cabe, Joseph Clark, Hall Garrison, Levi Crompton, Jacob
Umstead, John Rippy, Thomas Ellison, Eli McDaniel, William Armstrong, William
Jean, John Thompson, John Durham, Henry Goodrich.
Reuben Smith Sworn to attend the Grand Jury as Constable
during this Term.
Remaining Jurors who have appeared & qualified, vizt:

[OCPQS 8/401 – Nov 1812]
William Whitted produced a Deed of bargain & Sale to
him the said William Whitted from Alexander Anderson in open Court.
William Whitted produced a Deed of Bargain & Sale in
open Court from Alexander Anderson to him the said William Whitted by the name
of William Whitted Jr dated 30th Sep’r 1797 for 923 acres lying
& being in the County of Davidson in the State of Tennessee on the West
fork of Harpeth River and James Hart one of the Subscribing Witnesses also
appeared in open Court and being duly Sworn made Oath that he saw Alexander
Anderson the bargainer in said Deed named sign, seal and as his Act & Deed
deliver this said Deed to the said William on the day the Deed bears date and
that he & Absalom Tatom then signed their names as witnesses to said Deed
and said James further made Oath that said Absalom Tatom is dead and that he is
an Inhabitant of Orange aforesaid.

Henry Trice, William Brown, Samuel Evans, Lacey Lloyd, Zacheus Boroughs, Levi
Jackson, James Anderson, Peter Stout, Fredrick Taylor, Joseph Steel, Samuel
Thompson, Mark Pickett. Plaintiff called & non Suit. Green Bowers a witness
on behalf of the Plaintiff failing to appear at the Call of the Sheriff is
fined according to act of Assembly.

Wm Kirkland vs James Minnis} Same Jury charged. Find no
pay’t or set off & assess the plff damages to £8.7 & C. £199.14.1.

Thomas Yarbrough vs James Minnis} Same Jury charged, find
the Dollars mentioned in the bond declared on to [be] of the Value of £70.15/,
that there is no pay’t or set off & assess the plffs Damages to £2.17.5
& Costs.
It appearing to the Court that it is necessary to Sell all
the Slaves belonging to the Estate of Colo Charles Christmas Dec’d for the
purpose of discharging the debts due by said Dec’d, It is therefore Ordered
that the Executors of said Charles Christmas Dec’d have leave to sell the
stock the Slaves belonging to said dec’d on a Credit of twelve months for
the purpose of paying & discharging the debts due by said Charles Christmas
Dec’d.

Bennehan was duly ack’d proved in open Court by the Oath of Abner B
Bruce a Subscribing Witness thereto & ordered to be registered. [See ODB 14/152.]
The Execution of a Power of Attorney from Walter Alves &
Thomas D Bennehan to William Norwood was duly proved in open Court by the acknowledgment
of Thomas D Bennehan one of the Subscribers thereto and the hand writing of Walter
Alves the other Subscriber thereto was duly proved in open Court by the Oath of

Ordered that William Horton Standard Keeper of the County
procure a new stamp for Wooden measures with the Letters NC thereon, the old
one having worn out and that the County Trustee pay the expense thereof.
Samuel Carson vs Samuel Turrentine} Motion? To pay over
monies collected. On argument by council on both Sides, It is ordered by the
Court that the motion be dismissed as it appears to them that the Defendant
Samuel Turrentine has in his hands no monies of the Plaintiff unaccounted for.
The State vs John Weeden} It is ordered that John Weeden
Stand committed to the Jail of this County until he first ???? Security
for his good behavior himself to be bound in the Sum of £500 and his Securities
to be adjudged of by to [sic] Sufficiency by John Taylor Jr & Abner B Bruce
esqrs.
[OCPQS 8/408 – Nov 1812]
Ordered that the Order heretofore made binding to Luke Peacock
a Boy named Hemelius Patton be cancelled. Ordered that the Sheriff bring into
this Court at the next Term a Boy named Hemelius Patton for the purpose of
being bound out. [See Hemelius’s mothers accusations of neglect at Apprentice
Bonds, image 517.]
Ordered that an Attachment issue against Luke Peacock for
contempt of this Court in not producing Hemelius Patton agreeable to the order
of this Court [OCPQS 8/389].
Ordered that James Patterson Adm’r of Jno Smith Dec’d be
allowed 5 p ct on the amount of his accounts.
Ordered that Mann Patterson have leave to build a mill on
Newhope Creek on his own Land and that said mill when built shall be deemed a
public Mill.
The Execution of a Power of Attorney from David Yarbrough
& wife to William Bond was duly proved in open Court by the Oath of Samuel
Child a Subscribing Witness thereto & Ordered to be registered. [Not found

Ordered that James Faucett pay to Phebe Cole Twenty Seven
pounds vizt Seven pounds immediately & five pounds annually until the whole
is paid for the support & maintenance of a child of which said Phoebe Cole
hath lately been delivered and of which he stands charged as the reputed
father. [See Bastardy Bonds, images 1551, 1571, 1658, 1763, 1765.]

Friday Morning, Court met according to adjournment. Present:
Catlet Campbell, Thomas Whithed, Abner B Bruce} esqrs.
On motion, Ordered that Henson Colter pay to Holley Watson
the Sum of Twenty Seven pounds, vizt Seven pounds instanter five pounds on 14th
March next and five pounds annually thereafter until the whole is paid for the
Support & maintenance of a Child of which she hath lately been delivered
and of which he stands charged as the reputed father and that Execution issue
for the sum now due. [See Bastardy Bonds, image 1586.]
Ordered James Thomas adm’r &c have leave to sell the
personal estate of his Testator &c.
Ordered that Peggy Crabtree daughter of Hetty Crabtree now
of the age 5 years Sep’r last be bound to William Chambers to learn the Art
& mistery of a Spinster. [Bond not found. Peggy’s father was evidently
William Chambers - see OCPQS 7/418 & Bastardy Bonds, images 1160 & 1257.]
The Execution of a Deed from Frances Few & others to
Samuel Scarlett was duly proved in open Court by the Oath of John Flintham a
Subscribing Witness thereto and Ordered to be registered. [See ODB 14/370.]

Saturday, Court met according to adjournment. Present:

It is ordered that the Sheriff take into his possession two
Children of Color by the name of Whittaker now in the possession of James
Thompson (of Thos) and them safely keep and that he produce them to the next
Court.
John Crawford is appointed Guardian to Jane Elliott, James
Elliott, William Elliott, Joseph Elliott, John Elliott, Caty Elliott,
Mary Elliott, Alfred? Elliott Orphans of William Elliott Dec’d and enters into
Bond with John Taylor Jr & William Norwood his Securities in the Sum of £500.
It having been represented to the Satisfaction of the Court that the Personal
Estate administered by the administrators of William Elliott Dec’d are not

sufficient to discharge the debts due by said William Elliot
Dec’d and that it is necessary to sell the real Estate of said William Elliott
dec’d for the purposes of discharging the ballance due, It is therefore Ordered
that the Guardian of the Orphans of said William Elliott do have leave to sell
at public Sale on a Credit of twelve Months the real estate of the said William
Elliott Dec’d for the purpose of discharging said debts.
