Reuben Smith is sworn to attend the Grand Jury.

Samuel Thompson vs Joseph Marcum} Willie P Mangum a witness in behalf of the Plaintiff being solemnly called by the Sheriff at the Court house Door but failing to appear is fined according to act of assembly.

Den on Demise of Hugh Mulholland John Bane vs Hugh Mulhollan} Jury charged: Nath’l King, Benjamin Shearman, George Garrison, David Parker, David H Nunn, Thomas Robinson, James Robinson, John McFarland, William Kirkland, Martin Neese, Caleb Lindsy, Isaac Durham. Plff called & non Suit.

Shadrack Forrest vs Mangum & Mize} Same Jury charged. Find that at the time the Bonds became due there were pay’ts to the amount of £17.10. After deducting pay’ts the balance due is £41.2.6 which is principal Money, that there is no set off & assess the plffs Damages in Int £2.5.3.

The State vs Wm Hall} £100 recog to appear & answer for an ass’t on Geo Carrington.

The Same vs Jno Holden} £50 for the appearance of Wm Hall.

The Same vs Geo Carrington} £50 recog to appear & pros & give evid agt Wm Hall.

The Same vs Isaac Holden} £100 too appear & ans.

James Leathers vs Geo Carrington} Same Jury charged, find no pay’t or set off, that the principal is £70.6.6 & assess the Plff Dams to 3.17.3 which is Int.

Richard Crabtree vs John D Carrington & Geo Carrington} Same Jury charged, find pay’t or set off, that the Value of the Money mentioned in the Bond declared on is £56.5/ which is principal money and assess the Plaintiff Damages to £16.3 which is Interest. John Cain & Thos Hunt enter themselves Sec’y for the Stay of Execution according to Law.

Henry Womack vs John Taylor Jr} Pleas withdrawn. Judgment according to Specialty for $110 equal to £55 with Int from 25th Nov’r 1812 till pd. Sam’l Turrentine & Reuben Smith Sec’s for the Stay of Execution according to act of Assembly who are approved.

The Execution of a Deed from Ruebin Penny to Michael Graham was duly acknowledged in open Court by Reuben Penny the Subscriber thereto and Ordered to be registered. [See ODB 14/560.]

The Execution of a Deed from William Bond & David Yarbrough to David Yarbrough was duly proved in open Court by the Oath of James Child a Subscribing Witness thereto and Ordered to be registered. [See ODB 14/569.]

The Execution of a Deed from John Street to Josiah Turner was duly proved in open Court by the Oath of Samuel Bigalow a Subscribing Witness thereto & Ordered to be registered. [See ODB 14/570.]

The Execution of a Deed from John Newlin Atto in fact of Jonathan Lindly to James Laurence was duly acknowledged in open Court by the said John Newlin the Subscriber thereto & ordered to be registered. [See ODB 14/563.]

The Execution of a Deed from David Glenn to Reuben Carden was duly proved in open Court by the Oath of Thomas Reavis a Subscribing Witness thereto and Ordered to be registered. [See ODB 14/554.]

The Execution of a Deed from John Bason to Adam Sharp was duly proved in open Court by the Oath of George Campbell a Subscribing Witness thereto and Ordered to be registered. [See ODB 14/548.]

The Execution of a Deed from John Riley to Ezekiel Trice was duly proved in open Court by the Oath of Daniel Carlton a Subscribing Witness thereto and Ordered to be registered. [See ODB 14/557.]

Tuesday Morning 23rd Nov’r 1813, Court met according to adjournment. Present: John Thompson, Thomas Brewer, Joseph Clendening} esqrs.

Barnabas O’Farrill vs Parham L Kirk} The Defendant having shewn to the Satisfaction of the Court that the horses for which the bond was given in this case was reclaimed by the Owner, it is Ordered that the suit be dismissed at Costs of Def’t and that the bond be cancelled.

Jonathan Lindly vs Patterson & Patton} Jury charged: Nathaniel King, Benjamin Shearman, George Carrington, David Parker, David H Nunn, Thomas Robinson, James Robinson, John McFarland, William Kirkland, Martin Neese, Caleb Lindsy, Isaac Durham, find the Conditions not performed & assess the Plffs Damages to £2.17.10.

Jonathan Lindly vs Patterson & Patton} Same Jury, find Covenants not performed & assess the Plffs Damages to £2.4.11 & Costs.

Jonathan Lindly vs Patterson & Patton} Isaac Kirk a witness in behalf of the Plaintiff in this Case being Solemnly called by the Sheriff at the door of the Court house but failing to appear is fined according to act of Assembly.

Richard Freeman admr vs Mary Howell alias Milleson} Same Jury charged &c. Find the issues in favor of the Plaintiff & assess the Plffs Damages to £300. [Mary Howell had married John Millison in 1797 - see OMB M/597. See also OCPQS 8/516 where Mary is forced to sell assets.]

The Execution of a Deed from Luke Pendergast to David Davidson was duly acknowledged in open Court by the Subscriber thereto Luke Pendergast and ordered to be registered. [See ODB 14/556.]

The Execution of a Deed from Elisha Driskell to William Hatchet was duly proved in open Court by the Oath of Benjamin Shearman a Subscribing Witness thereto and Ordered to be registered. [See ODB 14/558.]

The Execution of a Deed from Benjamin Shearman to Sophia Lewis was duly proved in open Court by the Oath of Hall Garrison a Subscribing Witness thereto and Ordered to be registered. [See ODB 14/561.]

A Deed from Charles Merriweather and Mary his Wife to Burton Clark exhibited for probate heretofore in this Court. The Execution thereof being duly proved as to Charles Merriweather was returned here unto Court together with the Commission that issued by Order of said Court to William Trigg, William R Gibson, Ambrose Dudley, William Killegrew, Edward Gibson & John ???on or any two of them, the same bring returned by the said William Trigg & William R Gibson who thereon certifies that the Execution thereof was duly acknowledged by said Mary Merriweather and On Motion It is Ordered that the said Deed be registered. The Execution of a Deed from William P Mangum & Willie P Mangum to Absalom Alston was duly proved in open Court by the Oath of Joseph Marcum Subscribing Witness thereto & Ordered to be registered. [See ODB 14/567.]

The Execution of a Deed from James Strayhorn to Michael Graham and Ruben Penny was duly proved in open Court by the Oath of Abner B Bruce Subscribing Witness thereto and Ordered to be registered. [See ODB 14/564.]

[OCPQS 8/516 – Nov 1813]

Thursday Morning, Court met according to adjournment. Present: John Thompson, Tho Whithed, And’w McBroom} esqrs.

Ordered that John Thompson Guardian of Mary Howell alias Mary Milleson have leave to sell so much of the personal Estate of the said Mary Howell alias Milleson as may be sufficient to discharge a Judgment obtained at this Term by Rich’d Freeman adm’r vs said Mary Howell alias Milleson and on a Credit of of [sic] least Six Months. [Evidently necessitated by result in suit at OCPQS 8/511. Mary Howell had married John Millison in 1797 - see OMB M/597.]

Ordered that Anderson Watson Son of ??????? Watson Dec’d about the age of twelve years be bound to James Watson until he arrives to lawful age to learn the art & mistery of a Blacksmith. [Bond not found.]

Ordered that Ann Beamer daughter of about Seven Years old in the possession of Levi Gifford be bound to Levi Gifford until she arrives to lawful age to learn the art & mistery of a Spinster. [Bond not found.]

[OCPQS 8/517 – Nov 1813]

On petition of Nancy Rainey Widow of David Rainey dec’d, It is Ordered that James Mebane esqr, David Mebane, James Tate and James Palmer Freeholders be and they are appointed Commissioners to allott to the said Nancy Rainey so much of the Stock, Crop and provisions on hand of the Estate of the said David Rainey Dec’d as shall be sufficient for the maintenance of the said Nancy Rainey and her family one year from the fourth Monday of August last, at which time administration of the Estate was committed to Joseph Moore, & make report of their proceedings under their hands & seals to next Term.

Administration on the Estate of William Brown dec’d be granted to Lydia Brown & Hall Garrison who enters into Bond with Benjamin Jenpson? and James Faucett their Sec’s in the Sum of £1500.

Ordered that William Dickey esqr, Hardy Hurdle, Miles Wallace & Fredrick Fonville be appointed Commissioners to lay off & allott to Lydia Brown widow of William Brown Dec’d one years provision out of the Stock, Crop & provisions of said William Brown Dec’d and report to next Court.

Ordered that the administrators of Wm Brown Dec’d have leave to sell the perishable Estate of said Dec’d on a Credit of twelve Months.

[OCPQS 8/518 – Nov 1813]

Ordered that Walter Kinchen Dodson about the age of Sixteen years april next be bound to William Palmer to learn the Art & mistery of a Carpenter. [Bond not found.]

Ordered that Hyrom Lindsy about the age of Thirteen [or nineteen?] years in August next be bound to William Palmer to learn the art & mistery of a Carpenter. [Bond not found. See also OCPQS 6/619.]

George Johnston vs Robert Campbell} Ordered that Execution issue agt Plff for the Amount of James Barbee’s Ticket not heretofore taxed in the Bill of Costs.

Ordered that William Whitsell, John Harden, John Whitsell & Thomas Murdock be allowed the Sum of three pounds thirteen Shillings four pence each for their Services as patrollers last year and that they [sic] County Trustee pay the Same out of any Monies by him received for the Payment of Patrolls.

Ordered that the Sheriff bring to next Court two Children of James Desern’s for the purposes of having [them] bound out.
