On Motion, Ordered that John Southerd an infirm man be released from the payment of a poll Tax by reasons shewn the Court on Oath.

The State vs Benjamin a Negro Slave the property of Nicholas Atkins} Jury Sworn: Jesse Nevill, Daniel Wilkerson, Hugh Mulhollan, Joshua Walker, Henry Neal, William Chambers, David Woods, Robert King, Thomas Holloway, William Horton, Abel Rainey, John Brown - find the Defendant not Guilty of the felony as charged with Bill of Indt. It is adjudged that the Witnesses whose names are enclosed on the Bill of Indictment were material & necessary on behalf of the State.

Ordered by the Court that Doct’r Barnabas O’Farrell be fined Twenty Pounds for profanely Swearing before the Court in Contempt of the Court.

On Motion, It is Ordered that the fine of Doct’r O’Farrell be remitted to five pounds. Paid to J T.

Ordered that Elizabeth Merritt daughter of Patty Merritt now of the age of Eleven years be bound to Joseph Hamilton Phoebe Faucett until she arrives to lawful age to learn the Art & mistery of a Spinster. [Bond not found.]

Administration on the Estate of Robert Faucett dec’d is granted to James Mebane and George Faucett who enters into Bond with Joseph Moore and Robert Murray his Sec’s in the Sum of £1500, the Widow reli[nqui]shes her right to administration on said Estate.

John Taylor Clerk of this Court comes into Court agreeably to Law entered in a to Bonds payable to the Justices present in Court for the Sums directed by the Act of Assembly for the due performance of his duties as Clerk with John Taylor Senr, Archibald D Murphy, James Mebane ???????, William Shaw who are approved of by the Court.

The Execution of a Deed from William Stockard to George Foust was duly proved in Open Court by the Oath of Daniel Foust a Subscribing Witness thereto & Ordered to be registered. [See ODB 15/87.]

Ordered that

The Committee appointed to examine & Settle the Accounts of Duncan Cameron Guardian to Samuel Strudwick made their report which is ordered to be confirmed. Duncan Cameron Guardian to Samuel Strudwick comes into Court and resigns his Guardianship which is accepted by the Court.

Ordered that Joseph Moore esqr, James Hutchison, John King & William Murry freeholders are appointed a Committee to lay off & allot to Phebe Faucett Widow of Robert Faucett Dec’d one years provision out of the Crop, Stock & provisions of said Dec’d and if there should not be sufficient of the Stock, Crop & provisions of said Dec’d then that they shall as proceed to assess a Sum in money sufficient for said Support and Report to next Term.

The Execution of the last Will & Testament of George Coble Dec’d was duly proved in open Court by the Oath of M G Cly??? A Subscribing Witness thereto & Ordered to be recorded. At the Same time Isaac Patterson & Catharine Coble the Exr & Ex’x therein named qualified accordingly. [See OWB D/432.]

Administration of the Estate of William Clark dec’d is granted to Thomas Clark & Rachel Clark Widow who enters into Bond with Willie Chaw and David Allison his Securities in the Sum of £1500.

Ordered that Abner B Bruce, Catlet Campbell & David Yarbrough are appointed Committee to examine & Settle the Accounts of Samuel Turrentine late Sheriff &c & report to this Court.

Administration on the Estate of Nathan Hubbard Dec’d is granted to John O’Farrill who enters into Bond with Isaac Holt Sec’y in the Sum of £50.

Ordered that Berry Workman 7 years old last Septemb November be bound to John Workman until he arrives to lawful age to learn the art & mistery of a Hatter. [Bond not found.]

Administration with the Will annexed of the Estate of Willis Roberts Dec’d is granted to Sterling Harris who enters into bond with William Hall & John Brown his Securities in the Sum of £2000. [See OWB D/436.]

Administration of the Estate of Johnston James Webb dec’d is granted to Elizabeth Webb Widow who enters into Bond with Alexander Russell her Sec’y in the Sum of £100.

Ordered that Thomas Scott esqr, David White, Joseph Baker & Eli McDaniel freeholders be appointed a Committee to lay off & allott to Elizabeth Webb Widow of Johnston James Webb Dec’d one years Provision out of the Stock, Crop & provisions of said dec’d & if there should not be sufficient of stock, Crop & provisions then they will assess a Sum of Money sufficient for said Maintenance.

Administration of the Estate of Joseph Harder dec’d is granted to Thomas Sellars who enters into Bond with James Hutchison & John King Sc’s in the Sum of £500.

Administration of the Estate of Andrew Faddis Dec’d is granted to John Mason who enters into Bond with James Mebane & Joseph Moore Sec’s in the Sum of £250.

Ordered that Alsa Barnett [DOES THIS SAY BURNETT?] an Orphan Boy of Color of the age of 11 years 15th Sept next be bound to Wm McPherson who enters into Bond according to Law with James McPherson Sur. [See Apprentice Bonds, image 547.]

The Execution of a Deed from Thomas Andrews [Thomas Anderson] to Robert Tinnin was duly Acknowledged in Open Court by Thomas Anderson the Subscriber thereto & ordered to be registered. [See ODB 15/92.]

The Execution of a Deed from Wm Faucett & wife to Robert Eaton was duly ack’d in open Court by William Faucett the Subscriber thereto. Whereupon James Mebane & William Shaw esqrs were appointed by the Court a Committee to take the Private examination of said Elizabeth Faucett wife of said William Faucett who report that she signed said Deed freely without the compulsion or coercion of her said Husband. [Not found likely this was to be certified to be recorded in another county.]

Administration on the Estate of William Stewart dec’d is granted to Thomas Thompson who enters into Bond with Samuel Woody & John Thompson in the Sum of £200.

Ordered that Joseph Clendening esqr, Robert Thompson, Thomas Bradshaw Senr, Joseph Thompson are appointed a Committee to lay off & allot to Salley Stewart one years provision out of the Stock, Crop & provisions of the Estate of Wm Stewart dec’d for the Support of herself & family for One year and if there be not stock, Crop & provisions sufficient for one years maintenance, then they will assess a Sum in money sufficient therefor & report to next Court.

Administration on the Estate of William Izzel Dec’d is granted to John Woods who enters into Bond with David Turner & Joseph Clendening Sec’y in the Sum of £100.

Ordered that William Holt esqr, Mason Tapley, Ephraim Cook & Capt Wm Holt be appointed a Committee to lay off & allot to Elizabeth Harder Widow of Joseph Harder Dec’d one years provision out of the Stock, Crop & provisions of said Joseph Harder dec’d for herself & family and if there be not sufficient of the said Crop, Stock & provisions of said Dec’d then to assess in money a Sum Sufficient for said Support & report to next Court.

Ordered that Wm Holt esqr, Jeremiah Holt, Daniel May, Geo Albright be appointed a Committee to lay off & allot to Learina Willis Widow of Stephen Willis Dec’d one years provision out of the Stock, Crop & provision of said Dec’d for herself & family and if there be not Sufficient of the Stock, Crop & provisions of said dec’d for said Support, then to assess a Sum in money sufficient therefor & report to next Court.

The Execution of a Deed from Frederick Bason to Joseph Bason was duly proved in open Court by the oath of William Anderson a subscribing Witness thereto & ordered to be registered. [See ODB 15/93.]

Ordered that a Tax of Two Shillings on each poll, two Shillings on each One hundred pounds Value of Town property, two shillings on each three hundred Acres of Land be levied & collected for the payment of County contingencies. Ordered that a Tax of One Shilling on each black poll be levied & collected for the payment of patrolls.

The Committee appointed at last Court to examine into the State of the Records in the Registers Office having made their report, It is Ordered that Thomas Ruffin, Thomas Clancy & John Street esqrs are appointed a Committee to correspond with the Courts of the adjoining Countys on the Subject of Transcribing Certain Books in the Registers Office of this County mentioned in said report and that they report to the next Court. [The oldest books contain many deeds for land which was, by this time, in Chatham, Caswell, Person and Guilford Counties and Orange County was seeking their help in paying for transcriptions to be made.]

John Young is elected County Trustee and enters into Bond [with] Henry Neal, John Taylor Jr, Thomas Ruffin, James Mebane his Securities.

James S Smith is elected Treasurer of Public Buildings and enters into Bond with John Craig & James Mebane.

Josiah Turner esqr is elected Sheriff of the County of Orange for the present Year and enters into Bond with James Webb, William Whithed, William Kirkland and James Mebane his Security.

Thomas Bilbo qualifies as Deputy Sheriff of this County.

Ordered that John Taylor Clerk of this Court be allowed fifty pounds for his ex Officio Services.

Ordered that Josiah Turner Sheriff of Orange be allowed fifty pounds for his ex officio Services.

The Execution of a Deed of Sale from William Jopling to Thomas Smith was duly proved in Open Court by the Oath of Tho Pendergast a Subscribing Witness thereto & ordered to be registered. [See ODB 15/87.]

The last Will & Testament of John Alston dec’d having been offered for probate and a Caveat thereto entered. It is Ordered that Letters ad Collegendum be granted to ?????? Carrington who enters into Bond with [See OWB D/440.]

Fredrick Nash, James Webb & James Child are appointed Assessors for the Town of Hillsborough for the Present year.

Thomas Clancy, James S Smith & John Taylor Jr are appointed a Committee to examine & Settle the Accounts of John Young County Trustee and report to next Term.

Whereas Abner Benton Bruce & Catlet Campbell esqrs & David Yarbrough the Committee appointed to settle the Accounts of Samuel Turrentine late Sheriff of this County against the County returned & filed their report whereby they State a Balance of Fifty three pounds, twelve Shilling & two pence to be due to the said Turrentine after deducting the Amount of the Judgment lately has in the Superior Court of this County in the names of James S Smith County Trustee against the said Turrentine. It is therefore Ordered by the Court that the said report be received & confirmed & that the said Samuel Turrentine be and he is released and discharged from the said Judgment, the Costs of said Judgment excepted, and that the Sheriff proceed no further on the Execution issued on the said Judgment. And it is further Ordered that the County Trustee pay to the said Samuel Turrentine the aforesaid Sum of fifty three pounds, twelve Shilling & two Pence.

Thomas Bilbo comes into Court & qualified as Deputy Sheriff of this County.

The Sheriff returns that pursuant to an Order of Court that he did summon a Jury of lawful men to view & lay off a road to leave the Old Salisbury road East of Wm Holts esqr, West by Daniel Albrights Post Office to the Guilford road at Powell Troxlers, and that the said Jury did say that the road is to stand where it now runs to begin at the East end of said road until we come to Christian Witsells fence & there it is to be made straight, and the said Christian Whitsell shall be allowed forty Shillings for damage, and the said road it to leave the road on the right hand down an Old road to the corner of Mew land cut down by Christian Whitsell so as to keep the line on the left hand & pursue the marks to a white Oak sapling this side of the branch at Daniel Mays. Whereupon on Motion, It is Ordered that the said report be confirmed & that William Holt esqr be appointed Overseer from the second Branch abbe Jeremiah Holts to within one quarter of a mile of Daniel Albrights with the following Hands, William Holt esqrs three hands, John Prather one hand, Jeremiah Holt four hands, William Mor???? Captain two hands, John Holt one hand, Hezekiah Mebane? One hand, Benjamin Whitey two hands.

It is also Ordered that William Montgomery be appointed Overseer from the second branch above Jeremiah Holts to Daniel Albrights P No, to the Guilford road near Powell Troxlers with the following hands: Daniel Albright three hands, George Albright One hand. Daniel May one hand, Christian Whitsell three hands, Jacob Boon & hand, Peter Sharp one hand, Mr Montgomery one hand.
