Thomas Sellars & Wife vs Peter Brinkley} Petition. Issues: 1st Did Peter Brinkley the Elder or Peter Brinkley the Younger enter the Land in question, and to which of the said Brinkleys did the Grant issue, 2nd If Peter Brinkley the Elder entered the said Land, did he agree with the Defendant, that if the Defendant would pay the Consideration money agreed by him to be paid for the said Principal or right, he should have the said Land & the Grant might be issued in his name, 3rd Did the defendant pay the said Consideration or any part thereof & how much, 4th Did Peter Brinkley the Elder die seized of the Land in question or any part thereof and if so how much. Hugh Highmore heretofore convicted in the Superior Court of Law for the County of Orange of a maim on the body of John Freeman with an Intent to Kill And sentenced to be imprisoned in the Common Jail of Orange County until Tuesday 27th May Instant and that he stand in the Pillory for One hour between the hours of twelve & two o’Clock of that [day], having been brought into Court and it being represented that he had suffered said punishment, On motion, It is Ordered that the benefit of the Insolvent debtors Oath be extended to him. Whereupon he took said Oath and the Court thereupon Ordered that he be discharged from confinement.

John Bonner is appointed Guardian to John Cate & Dorothea Cate orphan children of Thomas Cate dec’d and enters into Bond with Thomas Brewer & Thomas Whitted esqs in the sum of £75 each.

Ordered that William Norwood, Thomas Ruffin esqrs, James Webb, Thomas Clancy & John Taylor Jr be appointed a Committee to contract alter the Bar form of the Bar & Jury Boxes & ??? Table in the Court house and contract for the Work necessary therefor and that the Treasurer of Public Buildings Pay the Expences of the Same.

John Young is elected County Trustee for the Present Year and enters into Bond with James Mebane, Thomas Clancy & Catlet Campbell.

James Allison is elected Treasurer of Public Buildings for this County and enters into Bond with Thomas Clancy & John Young his Securities.

Josiah Turner is elected Sheriff of this County for the Present year and enters into Bond.

John Taylor Jr is allowed fifty pounds for his Ex officio Services as Clerk of this Court for the last year.

Josiah Turner esqr Sheriff &c is allowed fifty pounds for his ex officio Services for & during the last year.

Samuel Child & Richard Ashe – Petition for a Mill. On Motion of the Plaintiffs, Ordered that a Summons be issued to James Millican & to Elias Millican to appear before this Court of the fourth Monday of August next and answer the allegation of said Petitioners, and it is further Ordered that James Morrow, William Moore, Alexander Pickard & John Bonner, Freeholds, be and they are appointed to view, lay off & value on oath, an acres of the land of the said James & Elias at or near where Cain Creek crosses the road leading from the University to Woody’s ferry, adjoining the said Creek, and an acres of the land of the Petitioners, opposite thereto and report their Proceedings to the next Court.

The Execution of the last Will and Testament of Barney Troxler dec’d was duly proved in open Court by the Oath of Daniel Albright a Subscribing Witness thereto And Ordered to be Recorded. George Albright Troxler one of the Executors therein named appeared & qualified Accordingly. Whereupon Elizabeth Troxler Widow of said Barnabas Troxler comes into Court and enters her dissent from the Will of Said Barnabas Troxler dec’d. [See OWB

Whereas it is certified by the Court by the Wardens of the Poor that William Daniel is a Pauper & Supported by the County, On motion it is Ordered that Mary Daniel daughter of said William Daniel now of the Age of seven years July next be bound to Robert Turner to learn the Art & mistery of a Spinster. Administration on the Estate of John Arnold Senr dec’d is granted to James Briggs & Fielding Leathers who enter into Bond with in £5000 with Herbert Sims & Sterling Harris Sec’y.

Ordered that

Whereas by an Order of this Court heretofore made [OCPQS 8/334], Elizabeth ?????? Dickey was bound to Joseph Ellison, It is Ordered that the Indentures be cancelled and that said Elizabeth Dickey be bound to Stephen Taylor until she arrives to lawful age to learn the Art and Mistery of a Spinster. [Bond not found.]
