Whereas it is represented to this Court that Samuel Strudwick had whipped one of his Slaves by which whipping & she afterwards died, It is thereupon Ordered by consent of the Solicitor General Edward Jones that recognizance be taken for the appearance of said Samuel Strudwick at the next Superior Court to answer for the Killing of said Negro. Whereupon Paoli Ashe, Richard Ashe & John Taylor Esqs entered into recognizance in the Sum

of £500 for his appearance. [Strudwick had beaten his slaves the day before this on Friday 29 May 1818 in connection, as the inquest and several white witnesses said, with a conspiracy among several of his slaves to poison the Strudwick family as well as the closely related family of Paoli Ashe. After being whipped with a riding crop several slaves confessed, though the last to be beaten, Bella, admitted only to being in possession of poison. The Strudwicks took pains to emphasize that Bella was beaten on the legs and buttocks, not on her torso and claimed that she late died of a violent hysterical fit caused, they said, by her taking some of her own poison, though what the actual facts of this case were remain unclear. The inquest formally ruled that the beating had not caused Bella’s death. However it is clear that Strudwick’s mistreatment of Bella and his other slaves was the ultimate cause of the entire incident. Strudwick was ordered to appear in Superior Court over this matter because it was not until Thomas Ruffin’s infamous ruling in State vs Mann in 1829 that it was clear under North Carolina law that a master had the right to discipline his slaves to the point of killing them. Surely Thomas Ruffin was well aware of this case in 1818 and had this incident partly in mind when he wrote his decision in State vs Mann. See Inquest images 83-92.]
