Robert William vs Matthias Williams} Jury charged, to wit: Taylor Duke, Caleb Wilson, John McDaniel, Samuel White, Goodman Nevill, Edmund Herndon, Zaccheus Boroughs, John Trollinger, Israel Holt, Adam Douglass, Joseph Latta, John Boon – find no payment of set off that after [sic] & assess the Plffs Damages to $21.18 $13.15, that the Balance of Principal due is $121.12.

John Garrard comes into Court & is appointed Guardian to Thomas Garrard and enters into Bond with David Parker in the Sum of £1000.

Whereas the last Will & Testament of Thomas Cate [OWB D/490] was Proved at the last session of this Court [OCPQS 9/234] and William Moore & John Sykes were qualified as Executors of the said Will, believing that they had assented therein, Whereas in fact no Persons were named Executors thereof, It is therefore Ordered by & with the consent of the said William & John that the said qualification be & the same is declared void, and that Administration of the Goods & Chattels, rights & credits of the said Thomas Cate deceased according to said Will is granted to William Moore & John Sykes who married two of the daughters of the said Thomas Cate & entered into Bond in the Sum of two thousand pounds with Allen & Ephraim Cate their securities, and qualified according to law, therefore Ordered that letter Testamentary issue with a Copy of the Will annexed.

Whereas John Moore late of Orange County by his last Will and Testament [OWB D/471] authorized & requested this Court to appoint one or more Commissioners to assist his Executors in making certain divisions of his Property as mentioned in the will, It is therefore Ordered that Pleasant Henderson, Ezekiel Trice & Charles Trice be and they are appointed commissioners to aid & assist the Executors of said Will, to divide certain Property mentioned in the Will & allot to Nancy the daughter of the Testator now intermarried with Gilbert Hart her proportion & share of the said Property according to the Said Will, And make report.

Ordered that James Hamilton pay to Nancy Murray the Sum of twenty Seven pounds as follows: two pounds down, five pounds annually from the Birth for the Support & maintenance of a child of which he stands legally charged as the father. Ordered that John Duke pay to Kesiah Wood the Sum of twenty Seven pounds, vizt: two pounds immediately & five pounds annually for the Support & maintenance of a child of which he stands charged as the reputed father. [See Bastardy Bonds, images 1893, 1895.]

Administration with the Will annexed of the Estate of Aaron Bowles dec’d is granted to Jehu Bird who enters into Bond with William Criswell and James Lapslie in the Sum of £600. [See OWB D/494.]

Ordered that David Andrews pay to Polley Williams twenty Seven pounds, vizt: two pounds down, five pounds on 10th Jul next & five pounds annually thereafter until the whole is paid for the Support of a child of which she has been delivered & of which he stands charged as the reputed father. Administration on the Estate of Fredrick Gates Dec’d is granted to Thomas B Patterson who enters into Bond with William P Mangum & William B Jameson who enters Sec’s of £400.

Ordered that the Admr of Fredrick Gates dec’d have leave to sell the Personal estate of said Dec’d.

Administration pendente lite on the Estate of William Rainey dec’d is granted to Michael Holt & John King who enters into Bond with Thomas Sellars and William Holt in the Sum of £8000.

Ordered that the Administrator of William Rainey dec’d have leave to Sell the Perishable Estate of said dec’d including the Stock, Crop & Waggon.

Ordered that the Order made appointing William Murray Guardian to Henderson Bowls be rescinded. Jehu Bird is thereupon appointed Guardian to Henderson Bowls Haney & enters into Bond accordingly.

The Commissioners appointed by the last Court for the Purpose of letting the Building of a Bridge across Eno River at or near Bennehans & Camerons Mills Report that they have contracted with Thomas Atkins, John Arnold & William Leathers for the Building of the said Bridge and that said Bridge had been completed according to said Contract by said Thomas Atkins, John Arnold & William Leathers at the price of Six hundred dollars. Whereupon it is Ordered that the County Trustee pay to the said Thomas Atkins, John Arnold & William Leathers the said Sum of Sic hundred dollars the price of Building said Bridge.

Administration on the Estate of Sarah Whithed late Sarah Kirk now decd is granted to Thomas Whitted who enters into bond with William Leathers & James Leathers Isaac Holden Sec’s in the Sum of £500.

Jehu Bird & others, Petition for a road. It is Ordered that the report of the Jury be confirmed and that the County Trustee pay to Perry Sutton fifteen pounds damages sustained by the road running through his land.

Ordered that William Warren pay to Eliza Parish twenty Seven Pounds vizt forty Shillings down & five pounds annually from the Birth of her Child for the Support of a child of which Eliza Parish single Woman hath lately been delivered. [See Bastardy Bonds, images 1844, 1903.]

The Execution of the last Will & Testament of Jacob Umstead dec’d was duly proved in open Court by the oath of Thornton McFarling the Subscribing Witness thereto, and William P Mangum being called says on Oath that the Will & every part thereof is in the hand writing of Jacob Umsted dec’d the Testator. Whereupon it is ordered that said Will be recorded. The Executor therein named qualified accordingly. [See OWB D/495.]

North Carolina, Orange County} Court of Pleas & quarter Sessions. Be it known that at a Term of said Court begun & held before the Justices thereof at the Court House on the fourth Monday of November A D 1816, William Cain the younger exhibited to the said Court a Deed of conveyance from Zebulon Veasy & his wife Nancy Veasy both residing in Hancock County in Georgia to him the said William Cain, and the execution thereof by the said Zebulon & Nancy was proved by the oath of Isaac Cain one of the Subscribing Witnesses thereto. Also the said William Cain then & there exhibited to the said Court affixed to the said Deed, a commission issued from the Inferior Court of said County of Hancock under the hand of James H Jones & his seal of Office as Clerk of said Court, which duly authorized Richard B Fletcher, John A Lightfoot & Joseph Howell esquires or any two of them as commissioners, to take the acknowledgement of said Nancy, of the Execution of the said conveyance privily & apart from her said husband to examine her whether she executed the same freely & of her own accord without fear or compulsion of the said Zebulon Veasey her husband. And also the said William Cain then & there exhibited to the said Court affixed to the said Deed & commission the attestation made by said Richard B Fletcher & John A Lightfoot esquires (two of the said commissioners) under their Seals if the acknowledgement of the said conveyance by the said Nancy & that she executed the same freely & of her own accord without fear or compulsion of the said Zebulon her husband, she having been by them first viz 9th October A D 1816 personally examined touching the Execution of the said Deed of conveyance privily & apart from the said Zebulon her husband. And the said William Cain also then & there exhibited to the said Court annexed to said Deed, commission & attestation The Certificate of his Excellency David B Mitchell Governor &C of the said State of Georgia, duly authenticated under his hand & that of the other proper officers & under the great Seal of Georgia aforesaid, That James H Jones who signed the said Commission is Clerk of said Inferior Court for the said County of Hancock & that said Court is one of the Court of Records of the said State of Georgia. All of which being exhibited to the said Court of Pleas & quarter Sessions, upon the motion of the said William Cain, It is Ordered by the Court that the said Deed with the said commission, attestation & certificates annexed to or endorsed on said Deed & also this certificate be Registered.
